This is a reminder that your second deferral will end by the last day of January. SDP2016-39 was deferred for the 2n1
time on 7/31/2017.
Please see the last two messages in reference to details on the deferrals and your possible resubmission.
As specified previously, a resubmission of the Final Site Plan, addressing the previous comments, must take place on or
prior to 6 months (1/31/2018) or the project will be withdrawn for inactivity.
Also, because of our previous communication, please keep in mind that if the changes to the Final Site Plan are
significantly different from the previous submission, and are not consistent with the Initial Site Plan, there is a possibility
that a new Initial Site Plan submission may be required.
We look forward to your resubmission.
If you do not plan to resubmit by 1/31/2018, and wish to withdraw it, please let me know and I will withdraw the
project sooner.

Also, from your description below I cannot tell the level significance of the changes you will be including in the
resubmission. I won't be able to tell that until you officially submit the site plan.
Please keep in mind that if the changes to the Final Site Plan are significantly different from the previous submission,
and are not consistent with the Initial Site Plan, there is a possibility that a new Initial Site Plan submission may be
required.
This is something that would be determined by the Director of Planning.
We can discuss this more if you wish. I just wanted to make sure I mentioned it just in case the changes you will be
proposing are significant.

Thank you for the information.
I will extend the deferral for SDP201600039 Mill Creek Industrial Park Lot 11- Final Site Plan for 6 months from today.
However, please keep in mind two things:
1. This is your second deferral. That is the most a project is supposed to have. If it is not resubmitted before that
date you will have to submit a new site plan.
2. In reference to the timeline, the sooner you submit the better because of our review periods. Although we
have preferred deadlines for reviews sometimes, and recently this has often been the case, the review periods
can be significantly longer when workload levels are high. We cannot guarantee the length of the review period
beyond those specified in the County Code which are significantly longer than the preferred deadlines.

Hi, I apologize for the delayed response. I've been out of the office.
Regarding your questions below,
1) I've been adjusting the position of the building to optimize it's placement and orientation given the requirements to
move the entrance from it's initially proposed location, as well as keeping a larger buffer between the neighboring parcel
and the drainage easement, while allowing for better parking orientation, and building access.
Also, I have taken advantage of seasonal changes to observe how different sunlight, neighbor noise, and prevailing wind
patterns affect the proposed building and its windows/entrances.
2) As the revised plan addresses these and the other minor comments, little needs to be done to re -submit.
3) 1 doubt the additional work should take very long -all of the above mentioned analysis is done - I can't say for sure but
a couple months I'd think, hopefully much sooner. I don't know how it affects your work but I'd like to keep a new deferral
open as long as possible though, for maximum flexibility. Does it make any material difference to you how long the
deferral period is?
I'll note that after the initial delays we lost our window of opportunity with the contractors, so the "pressure was off' so to
speak. That's part of the delay in resubmitting. We are now approaching another good window so I am very motivated to
resubmit sooner rather than later.

I just wanted to make sure that you knew that with a deferral that there is a 6 month limit.
I have your official deferral date as 2/1/2017. Unless there is a resubmission within 6 months of that date the
site plan will be automatically withdrawn for inactivity.
If that amount of time will not be sufficient, or you wish to withdraw the site plan from review, please let me
know.

It has been almost 6 months since the comments on SDP201600039 Mill Creek Industrial Park Lot
11 - Final Site Plan. Six months will be February 3rd, 2017, this coming Friday
If you intend to resubmit this week, by Thursday, then there will be no issue.
If you do not intend to resubmit right away, but hope to do so in the future, then prior to this coming
Friday (February 3rd, 2017) respond to this email asking for the project to be deferred and specify the
date by which you plan to have the site plan resubmitted (32.4.3.5(a)).
Important: If we do not get a response in reference to this prior to February 3rd, 2017, this coming
Friday, then the site plan will automatically be withdrawn from review because of inactivity
(32.4.3.5(b)). If the project is withdrawn from review then if the site plan is submitted for review at a
later date it will be considered a new submission and will require the application fee.
Please let me know as soon as you can, and prior to February 3rd, 2017 - this coming Friday, if this
project should be deferred or withdrawn.

1) I've been adjusting the position of the building to optimize it's placement and orientation given the requirements to
move the entrance from it's initially proposed location, as well as keeping a larger buffer between the neighboring parcel
and the drainage easement, while allowing for better parking orientation, and building access.
Also, I have taken advantage of seasonal changes to observe how different sunlight, neighbor noise, and prevailing wind
patterns affect the proposed building and its windows/entrances.
2) As the revised plan addresses these and the other minor comments, little needs to be done to re -submit.

3) 1 doubt the additional work should take very long -all of the above mentioned analysis is done - I can't say for sure but
a couple months I'd think, hopefully much sooner. I don't know how it affects your work but I'd like to keep a new deferral
open as long as possible though, for maximum flexibility. Does it make any material difference to you how long the
deferral period is?
I'll note that after the initial delays we lost our window of opportunity with the contractors, so the "pressure was off' so to
speak. That's part of the delay in resubmitting. We are now approaching another good window so I am very motivated to
resubmit sooner rather than later.

It has been almost 6 months since the comments on SDP201600039 Mill Creek Industrial Park Lot
11 - Final Site Plan. Six months will be February 3rd, 2017, this coming Friday.
If you intend to resubmit this week, by Thursday, then there will be no issue.
If you do not intend to resubmit right away, but hope to do so in the future, then prior to this coming
Friday (February 3rd, 2017) respond to this email asking for the project to be deferred and specify the
date by which you plan to have the site plan resubmitted (32.4.3.5(a)).
Important: If we do not get a response in reference to this prior to February 3rd, 2017, this coming
Friday, then the site plan will automatically be withdrawn from review because of inactivity
(32.4.3.5(b)). If the project is withdrawn from review then if the site plan is submitted for review at a
later date it will be considered a new submission and will require the application fee.
Please let me know as soon as you can, and prior to February 3rd, 2017 - this coming Friday, if this
project should be deferred or withdrawn.

It was nice meeting with you today to discuss the final site plan for SDP201600039 Mill Creek Industrial Park
Lot 1.
As requested I have reached out to others in the Community Development Department and have the
following answers to your questions:
1. If you wish to change the light fixtures after the final site plan is approved that will take a Letter of
Revision (LOR). Please see the attached document that discusses the Site Plan Amendment Policy and
also the Site Plan Review Manual that outlines the processes including the one for LORs.
2. Engineering agrees with my comment that the storm drain easement needs to be expanded for the
proposed storm drain pipe. I was referred to page 15 of the Albemarle County Design Standards
Manual (see attached) for the calculation on how far beyond the edge of the pipe the easement will
need to extend. It was also pointed out to me that the DI-3C inlet, at the corner of the front parking
spaces, should be entirely within the expanded easement. The issue with the drain inlet being within
the easement goes a bit beyond my comment so it is important that Shimp Engineering be made aware
of this before the next revisions to the site plan are completed.
3. For your non -site plan specific question, about parking off of the Five Springs Road private access
easement, it was suggested that you have someone pull the deed that created the easement to check
its wording and also the site plans for TMP 761V11-22 and TMP 76M1-12A to see if the parking you are
concerned about was shown in those site plans. Of course chatting with a lawyer about the portion of
the parking that is not within the access easement and infringing upon your property might be a good
step as well. Any of the above mentioned research is beyond my purview with this site plan
submission.
Also, I just wanted to list some of the more important items we discussed today:
• Comment 1, if there is anew deed from when the ownership transferred in January including that in
the legal references will help with this.
• See above for information on Comment 10. d. and the storm drain easement.
Although comments 15. a, b, c, e & f will still be required comment 15. d. will not be required. We will
allows the area of tree canopy outside of any easements to be counted towards the tree canopy
calculation without any additional information (specific tree location, size and species etc.).
• Comment 22 is now only a recommendation.

Each time it is resubmitted a new deadline time period begins.
So the best thing to do is get the comments thoroughly addressed before resubmittal rather than resubmit
quickly with more likelihood of having some comments not addressed in a way the County could approve.
The "preferred" deadline for resubmission, which generally is not happening currently because of work load,
is 2 weeks.
The deadline specified in the County Code is 60 days.

Each time it is resubmitted a new deadline time period begins.
So the best thing to do is get the comments thoroughly addressed before resubmittal rather than resubmit
quickly with more likelihood of having some comments not addressed in a way the County could approve.
The "preferred" deadline for resubmission, which generally is not happening currently because of work load,
is 2 weeks.
The deadline specified in the County Code is 60 days.

David asked me to look into this and Paty and I sat down today to look at it closely. I agree that the ordinance
doesn't require the wheel stops for the full size parking space. However, it looks like there is space to adjust the
landscaping. I know you have concerns with the utilities, but the shrubs are already on top of them, and to
further ensure that they are protected, it would be good to shift them, even one foot, away from the curb.

You even said in your comments on the preliminary you didn't know how they
were going to fit the landscaping because of all the utilities. So it shouldn't be a surprise

Curbing works if the landscaping is not right on the curb. That is why I mentioned a 2'
separation between the landscaping and the curb in my comment. Otherwise the overhang of
the cars/trucks will destroy the shrubs.
Have you looked at the landscape plan yourself? They are showing the plantings going right
up to the face of curb.
You can have them pull the plantings back but then they might start having conflicts with the
easements and utility pipes.

To protect the landscaping on the front of the lot, adjacent to the parking they need them
unless the landscaping is far enough away from the face of curb. They are showing the shrubs
right up to the curb.

Sorry if I worded that poorly.
To protect the landscaping on the front of the lot, adjacent to the parking they need them unless the
landscaping is far enough away from the face of curb. They are showing the shrubs right up to the curb.
32.7.9.9 INSTALLATION AND MAINTENANCE OF REQUIRED LANDSCAPING AND SCREENING
b. Method of installation.... Wheel stops, curbing or other barriers shall be provided to
prevent damage to landscaping by vehicles.
At the back of the lot adjacent to the wall, I should have said I highly suggest it. Otherwise that wall and the
vehicles are going to get a lot of damage.
