I recall the SPCA representative saying those were their operating hours and the PC used that. My suggestion is that the concept plan be changed to indicate the area to be planted with the row of trees. Also, the wording of the conditions (your attachment) should be run by zoning and Greg K. Finally, while we can be working to finalize the wording of the conditions, we should not consider them final until Sharon has gotten last night's action memo approved by the PC. Please get with her on the timing of that. I know we want to have the SPCA package for the Board agenda done by next Friday, December 21. A public hearing before the Planning Commission has been tentatively set for December 11, 2007. Your application has been reviewed by the Department of Community Development, which includes the Planning Division and the Zoning and Current Development Division. The County Engineer, Albemarle County Service Authority, Fire/Rescue Department, and the Virginia Dept. of Transportation also reviewed the project and indicated that they did not have any comments or concerns about the Special Use Permit. Two of them need to be addressed as part of your request for a Special Use Permit Amendment. First, Section 5.1.11a requires a 500-foot setback for animal confinements, which will apply to the proposed exercise and socialization areas. In addition to the setbacks that are required for animal confinements mentioned above, your facility is also subject to the usual building and parking setback requirements for Commercial districts listed in Section 21.7 (Commercial Districts — Generally) of the Zoning Ordinance. For any portions of your property that are adjacent to public streets, including both Berkmar Drive and the proposed Western Bypass, the building setback is 30 feet from the street and no off-street parking or loading spaces can be closer than 10 feet from the public street right-of-way. Where your property is adjacent to residential districts, the building setback is 50 feet from the residential district (measured to the property line) and no off-street parking or loading space can be closer than 20 feet from the residential district. r�tu 1 (7 Staff is raising the issue of setbacks for two reasons. First, one of the fenced areas close the west side of the property (behind the main building) appears to encroach on the setback CO, /teA` line. Show the "Existing Conditions" on one sheet; all the items currently in place. This sheet should be labeled "Existing Conditions" and dated. 2. The Existing Conditions sheet should indicate who owns the adjacent properties and what the current zoning is. 3. Show the proposed changes on a second sheet along with the existing conditions. This sheet should be labeled "Concept Plan," and should also be dated. 4. Include a legend on both sheets that identifies the different types of lines and other symbols. 5. Clarify which lines are the proposed new fences and which are existing ones. In some areas it looks like fence lines are crossing one another. 6. Please reference ZMA 2000-005 and SP 2000-022 on the plan. The Charlottesville-Albemarle SPCA currently operates under the following conditions (SP2000-022, approved 8/9/2000): 1. The proposed use shall not accommodate the seasonal "Rummage Sale" or any other fundraising activities without amendment to this special use permit, or appropriate permitting by the Department of Building Codes and Zoning Services. 3. The site shall be developed in accord with the attached site plan dated May 12, 2000; revised June 12, 2000.0. Animals shall be confined in an enclosed building from 10:00 pm to 6:00 am. 5. Full frontage improvements as required by VDOT shall be installed. . Uses shall be limited to an animal shelter and a veterinary hospital with associated offices only. As I mentioned in an earlier message, we will be sending you a formal "comment letter" in mid-October. As we review your application and prepare the letter, it would be very helpful for me to see the site as it is currently developed and to ask you some questions. This would also be a good time for me to explain two regulations that you will need to request waivers and/or modifications of, as part of your application. One is the 500-foot setback requirement and the other is the requirement for a certain type of fencin . The proposed Dog Pens are not shown on the plan referenced in the Special Use Permit. They may not be approved without amendment of the conditions of the special use permit. 2. The proposed trails may be constructed provided: a. No trees are removed. b. In the area of the Tree Conservation Area(see condition 1 of SP 2000—22)the Current Development Division, acting on behalf of the Agent, approves the trail location and design. 3. The proposed parking area shown on the plan in the VDOT right of way should be removed. 4. The proposed building near the entrance appears to be a reconstructed building. The building may be reconstructed at the same dimensions as pre-existed. Any increase in the building size will require amendment of the special use permit. Subject: Bypass Right of Way Issue John, I have a real good question for you here—and need some guidance on how VDOT would like for me to handle it. The Charlottesville-Albemarle SPCA, located on Berkmar Drive, has applied for a special use permit to construct outdoor exercise and socialization areas for the animals (mostly dogs) that they are holding for adoption. One of the major concerns is that, according to County regulations, they have to keep these outdoor areas 500 feet from residential lot lines. The right-of-way that VDOT has purchased for the Western Bypass runs behind and directly adjacent to the SPCA's property. The question is, what does VDOT plan to do with this ROW? If it is going to be sold back to people who might want to build residences on it, the County needs to know that. Any advice you can give me would be much appreciated. Full frontage improvements as required by VDOT shall be installed." I need to know if this condition has been met. If there is anything outstanding, then I'll need to update the condition. The proposed Dog Pens are not shown on the plan referenced in the Special Use Permit. They may not be approved without amendment of the conditions of the special use permit. 2. The proposed trails may be constructed provided: a. No trees are removed. b. In the area of the Tree Conservation Area(see condition 1 of SP 2000—22)the Current Development Division, acting on behalf of the Agent, approves the trail location and design. 3. The proposed parking area shown on the plan in the VDOT right of way should be removed. 4. The proposed building near the entrance appears to be a reconstructed building. The building may be reconstructed at the same dimensions as pre-existed. Any increase in the building size will require amendment of the special use permit. I have a question regarding the application. On page 3, in the written description of the request, you give hours of operation. I have typed in the section below adding "am" or"pm" in boldface as seemed appropriate. Would you please verify these hours and let me know if I have added them correctly? The outside fenced exercise areas are for the purpose of providing a venue for the dogs to play and get exercise to improve their overall health and well-being. In addition, the areas will be used by potential adopters to socialize and play with the dogs, to interact with the dogs to see if they would be a good addition to their family.
