(the "SPCA") How will the proposed use affect adjacent property? The proposed special use of placing outdoor fenced exercise areas on the property will not adversely affect adjacent property. The SPCA currently operates an animal shelter on this property and has done so in this exact location since July 2004. Thefenced areas will not be used to house dogs permanently but will be•used as an exercise area. The fenced exercise areas are for the purpose of providing a venue for dogs to play and get exercise to improve their overall health and well- being. Dogs will be taken into the fenced exercise areas by volunteers, staff and potential adopters. Volunteers and staff will take dogs out to the fenced areas to play with, exercise and train the ddogs,thereby making them more adoptable. Adopters will be able to take dogs into the pens to play and interact with them to determine whether the dog would make a good addition to their family. Dogs that are well-exercised and trained will be quieter in their kennels and are generally adopted more quickly. All progressive animal welfare organizations seek to provide a healthy environment where dogs can play and exercise while waiting to find their new homes. In addition,evergreen screening at the property line and in proposed dog exercise locations will be provided. How will the proposed special use affect the character of the district(s) surrounding the property? The proposed special use will enhance the character of the district surrounding the property. The use of the property as an animal shelter has existed favorably with the surrounding district for many years. Office and retail space surround the SPCA, including Pet Food Discounters. The SPCA seeks to enhance the existing use by continuing to take measures that are characteristic of progressive animal welfare organizations. The Charlottesville-Albemarle community is a pet-loving community. These measures include making the SPCA facility an inviting place for the community to go and interact with animals. In addition,the Charlottesville-Albemarle SPCA works with local schools to provide humane education opportunities. How is the use in harmony with the purpose and intent of the Zoning Ordinance? The Zoning Ordinance is intended to improve public health, safety, convenience and welfare of citizens of the county. The proposed use will reduce existing noise at the facility. Dogs bark for primarily one thing,to seek the attention of human companions. The fenced exercise areas will provide a venue for people to answer this call for attention and take the dogs out to play fetch and other activities and to exercise the dogs during the day. How is the use in harmony with the uses permitted by right in the district? The proposed use will not adversely affect the uses permitted in the district. What additional regulations provided in Section 5.0 of the Zoning Ordinance apply to this use? Section 5.1.11 contains regulations regarding uses by animal shelters. Most of these provisions address confinement areas for the dogs. The proposed fenced areas are not intended to he used for dog confinement but for temporary exercise areas. The dogs at the SPCA will continue to be confined in the kennels inside the facility. The exercise areas will improve the health and well-being of the dogs and thereby reduce overall noise levels. How will this use promote the public health, safety, and general welfare of the 'community? This use will improve public health, safety, and general welfare of citizens of the community. The Charlottesville-Albemarle SPCA continues to achieve success in providing exceptional care and treatment for the lost and abandoned animals of the community. The SPCA provides a community service that is legally required to be provided by the county and the city. In addition, the SPCA has received national and regional attention for its life-saving efforts (receiving awards from the No Kill Advocacy Center and the Virginia Foundation of Humane Societies). The proposed use is consistent with providing an exceptional level of service to the homeless and abandoned animals in our community and to the public looking for lost pets or adopting a new pet.
