The Albemarle County Planning Services Division will grant or recommend approval of
the subdivision plat referenced above when the following comments have been
addressed. [Each comment is preceded by the applicable reference in the
Subdivision/Zoning Ordinances, unless otherwise specified.]
1. [General Comment] On Sheet 1, please remove the note entitled "Family
Subdivision Notes."
2. [General Comment] On Sheet 2, please revise the names of the owners of each
lot. Please show the owner of Lot 1 as "Charlene Preston Bennett." Please show
the owner of the Residue as "Margo Preston Scott."
3. [14- 302(A)1] Name of subdivision. On Sheet 1 and Sheet 2, please revise the
name of this subdivision to "Two -lot Subdivision Plat."
4. [14- 302(A)2] Vicinity map. On Sheet 1, please show the vicinity map at a scale
of 1 inch equals 2,000 feet.
5. [14- 302(A)12] Topography. On Sheet 2, please add the topography for critical
slopes as shown on the attached map.
6. [14- 302(A)15] Identification of all owners. On Sheet 1, please add the mailing
addresses of both owners.
7. [14- 302(B)5] Zoning classification. On Sheet 1 and Sheet 2, please revise the
magisterial district to show this property as located within the "White Hall
Magisterial District."
8. [14- 302(B)7] Reservoir watershed; agricultural forestal district. On Sheet 1,
please revise note #6 to specify that this property is located in the Beaver Creek
Reservoir water supply watershed. Please also add a note that this property is not
located in an agricultural- forestal district.
9. [14- 302(B)8] Stream buffers. On Sheet 1, please add a note that states "The
stream buffers shown hereon shall be managed in accordance with the Albemarle
County Water Protection Ordinance." On Sheet 2, please show the stream buffers
as shown on the attached map.
10. [14 -317)] Instrument evidencing maintenance of certain improvement. After
reviewing the private street maintenance agreement recorded on D.B. 3703 P.
280 -286, it has been determined that the following changes need to be made
within the agreement to bring it into compliance with the review of this plat. The
following changes are needed before final approval of the agreement by the
County Attorney's office:
a. Update the date of the plat referenced in the agreement.
b. Remove references to Deed Book 3703, Page 273 (leave this area blank).
c. State that the improvement will be maintained to a standard that, at a
minimum, assures that it will remain in substantially the condition it was
in when approved by the county; for a private street, shared driveway, or
alley, the instrument also shall state verbatim: "The travelway shall at all
times be maintained so that it is safe and convenient for passenger
automobiles and emergency vehicles at all times except in severe
temporary weather conditions."
d. Define "maintenance" by stating verbatim: "For purposes of this
instrument, `maintenance' includes the maintenance of the private streets
or alleys, and all curbs, curbs and gutters, drainage facilities, utilities,
dams, bridges and other private street improvements, and the prompt
removal of snow, water, debris, or any other obstruction so as to keep the
private street or alley reasonably open for usage by all vehicles, including
emergency services vehicles."
e. Describe the condition of the improvement when it was approved by the
county.
f. State verbatim: "No public agency, including the Virginia Department of
Transportation and the County of Albemarle, Virginia, will be responsible
for maintaining any improvement identified herein."
