The purpose of the easement(s) was a question Peter had in the comment response letter and I realized after sending out the comments on Friday that I had not answered his question. Since the easement that was put in place prior to submitting it to the County for review appears to only include to the back of curb, there are required improvements that I need to ensure are perpetually maintained. If this requirement has already been met elsewhere please just forward me that information. Please note in the comments I have also specified resubmitting the easements that were already put in place along Wahoo Way, highlighted and numbered for all of the private maintenance requirements. The highlighting and numbering is required prior to submitting it to the County Attorney's office for review. If the maintenance of the sidewalk and street trees on the adjoining property is already included in that document please just be clear to delineate that in any attached letter with that resubmission. Also, just to point out the new comment that was added at the end. To my knowledge no waiver requests (with justifications based on the waiver request ordinance requirements) for the street improvements (street trees, sidewalk, etc.) being on both sides of all private streets have been submitted to date. Early on in the process the comments stated that staff may be able to support such a waiver for some of the requirements in some places. However, even if staff may support such a waiver the waiver request must be submitted. If you are just waiting for such a submission and review until some later date that if of course your choice. However, this could cause layout conflicts and changes being required if any portion of the waivers requested are not granted. In order to meet the setbacks, we are proposing a boundary line adjustment of 20' as noted on the site plan sheet (C4). The main change is that I revised Comment 20. IV. to specifically state that the additional easements, outside of the private street right of way along Wahoo Way, on the adjoining parcel are for maintenance of the sidewalk and street trees. Any other minor changes to the comments in this update were to remove some redundancy and typos. The purpose of the easement(s) was a question Peter had in the comment response letter and I realized after sending out the comments on Friday that I had not answered his question. Since the easement that was put in place prior to submitting it to the County for review appears to only include to the back of curb, there are required improvements that I need to ensure are perpetually maintained. If this requirement has already been met elsewhere please just forward me that information. Please note in the comments I have also specified resubmitting the easements that were already put in place along Wahoo Way, highlighted and numbered for all of the private maintenance requirements. The highlighting and numbering is required prior to submitting it to the County Attorney's office for review. If the maintenance of the sidewalk and street trees on the adjoining property is already included in that document please just be clear to delineate that in any attached letter with that resubmission. Also, just to point out the new comment that was added at the end. To my knowledge no waiver requests (with justifications based on the waiver request ordinance requirements) for the street improvements (street trees, sidewalk, etc.) being on both sides of all private streets have been submitted to date. Early on in the process the comments stated that staff may be able to support such a waiver for some of the requirements in some places. However, even if staff may support such a waiver the waiver request must be submitted. If you are just waiting for such a submission and review until some later date that if of course your choice. However, this could cause layout conflicts and changes being required if any portion of the waivers requested are not granted. So my parcel would be split zoned. Then I would multiply the number of acres of each zoning district by its applicable density and get a total. I could then place that total anywhere in the cluster PROVIDED that the use proposed would have to be permitted in that particular zoning district. I couldn't put a townhome in R-2 for example, but SFD is allowed in both R10 and R2 so that would be ok.
