It appears the revised plat has a mix of both the new language and the previous language. The inclusion of the previous ordinance language ".... any reference to future potential development is to be deemed as theoretical. All statements affixed to this plat are true and correct to the best of my knowledge." is not permissible and should be removed from the consent to division section. Only the new ordinance language should be utilized: "The platting or dedication of the following described land [insert a correct description of the land subdivided] is with the free consent and in accordance with the desire of the undersigned owners, proprietors and trustees if any. " If the applicant would like to continue utilizing the previous ordinance language `Any reference to future potential development is to be deemed as theoretical. The plat has been revised to reflect your comments dated December 31, 2013. 1. The statement of consent has been revised in accordance with the new ordinance change. 2. In accordance with our phone conversation today, item 2. (Dam Break Inundation Zone) has been stricken from the comments. This parcel is not in a state regulated dam break inundation zone. 3. A revised date has been added to the plat. 4. Comment 4 was addressed by the applicant in an email dated January 2, 2014. [14- 303(A)] Statement of consent to division. Changes to the State Code and to the County of Albemarle Subdivision Ordinance require changes to the consent to division statement. Please revise the statement to read: "The platting or dedication of the following described land [insert correct description of the land subdivided] is with free consent and in accordance with the desire of the undersigned owners, proprietors and trustees, if any." Revise. 2. [14- 302(A)(16)] Dam Break Inundation Zone. Changes to the State Code and to the County of Albemarle Subdivision Ordinance require the Dam Break Inundation Zone to be labeled and the limits of the dam break inundation zone depicted on the plat. Per the County's web -GIS, portions of this property lie within a Dam Break Inundation zone. Revise to show the required information. 3. [14- 302(8)(1)] General Information. When the plat is revised, please provide the date of the last revision on the plat. 4. [Comment] The proposed Boundary Line Adjustment involves an existing structure. It is recommended that the applicant assure both primary and reserve drainfields for the home are located within the boundaries of parcel X.
