Signature of person completing t is checklist Scott Collins 9-20-21 Date 434-293-3719 Print Name Daytime phone number of Signatory CONVENTIONAL DISTRICT ZONING MAP AMENDMENT CHECKLIST 09-2020 Page 2 of 2 eK I075PG0256 THIS DEED, dated the 12th day of June, 1989, by and between COLONNADE ASSOCIATES LIMITED PARTNERSHIP, a Virginia Limited Partnership, Grantor, and the ALBEMARLE COUNTY SERVICE AUTHORITY, Grantees W I T N E S S E T Hs For and in consideration of Ten Dollars ($30.00), and other good and valuable consideration, the receipt of which is hereby acknowledged, the Grantor does hereby GRANT, BARGAIN, SELL and CONVEY with General Warranty and English Covenants of Title unto the Albemarle County Service Authority all that certain lot or parcel of land shown and identified as 10.48 Ac to be Acquired" on plat of Lumsden Associates, P.C., dated June 6, 1989, entitled "Plat Showing 0.48 Acre of Land and Easements to be Acquired by the Albemarle County Service Authority and Later to be Conveyed to the Rivanna Water and Sewer Authority for Public Utility Purposes (Being a Portion of Tax Map Parcel 60-4008), Jack Jouett District, Albemarle County, Virginia,* (the "Plat"), a copy of which is attached hereto as a part of this deed. Reference is made to said Plat for a more particular description of the property conveyed herein. This property is a portion of the property conveyed to Colonnade Associates Limited Partnership by deed recorded in the Clerk's office of the Circuit Court of Albemarle County, Virginia in Deed Book 741, page 538. This conveyance is made subject to all easements, restrictions and conditions contained in duly -recorded deeds, 1 BK 1075PG0257 plats, or other instruments constituting constructive notice in the chain of title to the above -described property which have not expired by time limitations contained therein or otherwise become ineffective. The Grantor further GRANTS and CONVEYS unto the Albemarle County Service Authority a permanent 40-foot utility and drainage easement as shown on said Plat. The Grantor further GRANTS and CONVEYS unto the Albemarle County Service Authority a slope and landscape easement, containing 25,103 square feet, as shown on the Plat. The slope and landscape easement shall be a permanent easement for grading, landscaping and a 20-foot width undisturbed area. The Grantor further GRANTS and CONVEYS unto the Albemarle County Service Authority a 25-foot access road easement, the temporary location of which is shown on the Plat and the permanent location of which is to be determined at a later date by the parties hereto, sufficient to provide for the construction of a 25-foot access road across the subject property to the 0.48 acres acquired herein and for use as an access road to the water tank to be constructed on the 0.48 acres. At such time as the permanent access easement is created and constructed, the temporary access easement shall be vacated. As a part of the above easements, the Grantee shall have the right to enter upon the above -described property within the easements for the purpose of installing, constructing, maintaining, repairing, replacing and extending water lines and 2 BK I075PG0258 appurtenances thereto within such easements and for landscaping, slope, and a roadway. Whenever it is necessary to excavate earth within the easements, the Grantee agrees to backfill such excavation in a proper and workmanlike manner so as to restore surface conditions as nearly as practicable to the same condition as prior to the excavation, including the restoration of such Paved surfaces, if any, as may be damaged or disturbed as a part of ouch excavation, The easements provided for herein shall include the right of the Grantee to cut any trees, brush and shrubbery, remove obstructions, and take other similar action reasonably necessary to provide economical and safe water tank and water line installation, operation and maintenance. Any facilities constructed within the permanent t0-foot utility and drainage easement shall be the property of the Albemarle County Service Authority.
