Upon a brief review by planning staff it appears sections of the document do not coincides with the table of contents, page numbers are off as are sections missing...etc For example: 1) Exhibit C is not listed in the table of contents; however, it is a part of the document (page 38) 2) Section 11 Successor Declarant, is missing from the table of contents; it is a part of the document(page 32) 3) Exhibit B is listed in the table of contents as page 36; however, in the document it's truly found on page 37. 4)Exhibit A is listed in the table of contents as page 35; however, in the document it's truly found on page 36. There may be more errors, I did not do a thorough review of that aspect of this document. Christopher P. I believe this document be revised to reflect the revised date of the plat as well? 2) Page 19,Restrictive Covenants, D. Removal of Trees, states: "D. Removal of Trees. Except as required for proper vehicular sight lines, no tree with a diameter greater than four inches (4") measured two feet (2') above ground level shall be removed without the approval of the ARB. "I wonder if this section should mention/reference something about prohibiting removal of trees within the 25' screening and landscaping easement. As currently it reads that it appears they could take down a tree in that area if it was less than 4" diameter measured two feet. General Observations 1) Page 1, under Recitals B, the declaration lists the open space depicted on the plat as: "Open Space A through E, inclusive, Whittington Subdivision" This is the appropriate open space being set to record with this plat. Notably the maintenance of this open space seems appropriately covered in the document which fulfills proffer#1. 2) Page 3, Definitions, Section 9 "Common Facilities" lists trails and paths. On the plat the required trails are planned to run through the 10' access easements, 20' access easements, and 25' screening and landscaping easement at the front of the property. The plat lists this on sheet 5 of 5 and classifies these as "A 5'nature trail is proposed within said easement. " Both of these sections appear to be referring to the same items. 3) Per proffer#8, the maintenance of the 25' screening and landscaping easement shall be outlined in the covenants and restrictions document. I believe this is covered in Section 8 "Common Area" and throughout the document. 1 • ,40,0 Nue 4) Page 25, Article X Easements, Section 11. "Trails" it states that "all trails shown on the Plat shall be constructed as "primitive" trails consistent with the Class B trail standard established by the County of Albemarle, and shall be maintained in substantially the same condition as when approved by the County. [14-317 and Proffer 1 & 8 ] Instrument evidencing maintenance of certain improvements. Documents relevant to dedication and/or maintenance of open space, 25' screening and landscape easement, and 10' and 20' access easement must be provided for review to the County Attorney in order for final subdivision plat approval. Please submit a draft of this document to me and I will review it and forward it to the County Attorney for his review/approval. 11. [14-317,303L] Instrument evidencing maintenance of certain improvements. A Deed of Dedication and Deed of Easement is needed for the drainage easements shown on the plat. The applicant should contact the County's Attorney's Office for the most recent deed template for drainage easements to be included with the next submittal of the plat. Here are my thoughts on the two issues Chris has raised. Proffer 1 for ZMA 2006-011 refers to the open space being privately owned, which appears to be already satisfied for Open Space areas A through E as noted in Recital B of the Declaration. Proffer 1 also requires that the open space be privately maintained, which the Declaration addresses. Yes, the Open Space needs to be owned and maintained by the HOA and shall be outlined in the Covenants and Restrictions of the HOA. Thus if it's in the declaration, then I believe we're covered on that item. I don't know if there is any other open space required to be dedicated to public use or if something has changed since the ZMA was approved, but it appears that the open space issue is outside of the scope of the declaration. With respect to drainage, VDOT requires drainage easements for those required improvements that drain water 1 off public streets, and requires that the twtrunty be the easement holder. I believe*necessary public drainage easements for the public roads throughout the subdivision(Kendra Street and Victor Place) should be handled by a Deed of Dedication which would be recorded with this plat. The above item was the subject of comment #11 from my May 22, 2013 comment letter to the applicant. (I believe the deed of dedication Pete provided in the email would cover that).Proffer 6 expressly requires the dedication of drainage easements in conjunction with the dedication of ROW from the centerline of SR 631. I don't know if resolution of these issues requires any changes to the declaration, or its exhibits (the plat and open space description). If not, the declaration addresses my prior comments and it can be approved. About the second half of proffer#6 "..together with the dedication and conveyance of all necessary drainage easements and the conveyance of necessary construction easements for improvements to State Route 631. " This section of the proffer makes reference to the 55' dedication of the right of way and all necessary drainage easements and construction easements for the improvements to state route 631; however, at this point there are no road plans to construct that road. Thus staff feels that there are no easements which are necessary at this point in the review, thus that portion of the proffer is complied with until the road is planned. Attached is a PDF of the 9-16-13 Zoning Determination that states this portion of the proffer is complied with. Other items which I believe need to be handled/provided for in the Covenants and Restrictions to be maintained by the HOA are: - 25' screening and landscape easements (as depicted on the plat and subject of comment #10 from my May 22, 2013 comment letter to the applicant) - 10' and 20' access easement meandering through the Residue Lot and through the Open Space and through a couple Residential Lots which are for the trails (as depicted on the plat and subject of comment #10 from my May 22, 2013 comment letter to the applicant) If they do not wish to put these items in the Covenants and Restrictions then they should provide a maintenance agreement of these items in the deeds for the individual easements. Planner Chris Perez mentioned something to my clients about needing deeds of dedication for stormwater drainage and open space, but this Declaration provides for those items to be owned and maintained by the HOA. Additional comments or conditions may be added or eliminated based on further review.): [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] 1. [14-302(B)5] Zoning classification. Proffers apply to this site. Appropriate reference to them must be noted on this plat as well as future plats and plans. 2. [ZMA2006011 Application Plan, 18-19.9.1, 14-213A, 14-302(B)8] Setbacks. General Note #15 appears to be incorrect with regard to front setbacks to existing public r/w (currently listed as 45’ on the plat); however, the rezoning application plan specifies 75’ to existing public r/w. Revise. It is advisable that the applicant delineate and label the 75’ setback on the plat as this setback is measured from the new right-of-way line, thus it appears this may impact buildable area of Lots 1, 51, 52, 53, 54, and 56. Also, an additional setback note shall be included on the plat for Rear Yard Setbacks. The rezoning specifies that “Rear lots adjoining RA districts shall have 35’ rear setbacks.” Please add this setback note to General Note #15, as it appears Lots 56 and 57 will be affected by this provision. Also, there is also a ‘build-to’ distance of 30’ for single-family detached; please add this information to the setback notes as well. 3. [ZMA2006011 Proffer 6] As submitted the right-of-way dedication fronting Open Space B, Lot 1, and Kendra Street (entrance to the property) does not appear to meet the required 55’ dedication from the centerline of Rte 631 as described in proffer #6. Revise. 4. [ZMA2006011 Proffer 1] The maximum number of lots permitted in Whittington is 96. A table providing the existing and proposed lots and total permitted must be provided on the plat and updated with each submittal for various phases. Revise. 5. [ZMA2006011 Proffer 2] Lot Size. Each lot is required to be a minimum of 40,000 gross Square Foot in area. Provide a note on the plat which states the minimum lot size requirement for this development. Also, on the plat provide the Square Footage calculations for each lot rather than the acreages. Most notably, it appears “Lot 56” is below the required square footage. Revise appropriately. 6. [ZMA2006011 Application Plan and 14-303F] Identification of sections, blocks, and lots. The lot numbers within the subdivision do not match the lot numbering provided/ approved in the application plan. Staff has noted that the road plans utilize these same incorrect lot designations; however, the road plan does not create the lots, rather the subdivision plat does. Thus the lot numbers on this plat should be revised to match the application plan. Revise. 2 7. [ZMA2006011 Application Plan] The 25’ screening easement is mislabeled on the plat, the appropriate title of this easement is “25’ screening and landscape easement”. Revise. 8. [18-19.6] Minimum Area Requirements for Open Space and Recreational Uses in PRD District. On the plat provide the percentage of open space which is being provided in this phase. 9. [ZMA2006011 Application Plan, 18-19.6.2 and 18-4.16] Recreational Area Requirements and Recreational Regulations. It appears there should be a Pocket Park located in Open Space B, and a Rain Garden located in Open Space A, and a Pocket Park w/ Picnic Shelter located in Open Space D per the application plan. Please indicate these items on the plat. 10. [14-317 and Proffer 1 & 8 ] Instrument evidencing maintenance of certain improvements. Documents relevant to dedication and/or maintenance of open space, 25’ screening and landscape easement, and 10’ and 20’ access easement must be provided for review to the County Attorney in order for final subdivision plat approval. Please submit a draft of this document to me and I will review it and forward it to the County Attorney for his review/ approval. 11. [14-317, 303L] Instrument evidencing maintenance of certain improvements. A Deed of Dedication and Deed of Easement is needed for the drainage easements shown on the plat. The applicant should contact the County’s Attorney’s Office for the most recent deed template for drainage easements to be included with the next submittal of the plat. Please submit a draft of this document to me and I will review it and forward it to the County Attorney for his review/approval. 12. [14-302(A)9] Building sites on proposed lots. Depict the proposed 20’ water line easement which appears to be within the proposed r/w (Kendra Street). Please work with VDOT to assure correct location of this easement and depict it on the plat. 14. [14-303S] Control points. Control points must be submitted. Emergency Apparatus access and water supply will be addressed on final site and road plans. SNM Per a 5-22-13 phone call with Shawn, Planning Staff discussed the above comment and explained the status of the project and where the project is at in the review. Namely this phase of the subdivision (phase A) has an approved road plan from 2011. Also there will be no site plan associated with this project being that it does not contain multi family housing. Thus the final subdivision plat for phase A which is under review in our office and the approved road plans for this phase of the project are the final steps in the review for this phase.
