Your erosion and sediment control plan submittal has been reviewed. It does not meet the
minimum standards required by the state. You may find the minimum standards at the state
website under this address;

The plan you have provided does not contain anything from the Virginia Erosion and Sediment
Control Handbook (link provided below). It is not even legible. You are encouraged to seek the
services of a professional engineer for your plan.

This instruction from your original notice of 27 June 2013 should be used as a guide in creating
the plan. (Of course, the minimum state standards and the handbook specifications are to be
used.)
“According to section 17-202C, you are hereby instructed to remove the sediment deposits from
the road, roadside ditches, and entrance culverts, placing the sediment on-site in a stable manner.
All of the site, entrances, and ditches must be re-seeded and covered with straw, mulch, or
erosion control matting. A sediment trap must be located in the swale, and all ditches must be
lined with a non-erodible liner.”

We are approaching 1 year since this violation was identified, and I contacted you by phone to correct
the problem. It has been 3 months since you were informed of the requirement for an erosion control
plan. Please provide a plan that meets the state minimum standards, and can be approved and bonded,
prior to 4 October 2013. I cannot let this problem, and the damage to Dudley Mountain Road right-of-
way, and neighbors’ properties, continue into another winter.
I have attached copies of the state plan checklist, the county’s review and approval documents, and
design manual checklists to give you an idea of what the erosion control plan should entail. You should
also be aware that the plan will need to be bonded. By my rough estimates, you disturbed and need to
permanently stabilize about 24 acres, in addition to traps, diversions, and cleanup of the right-of-way and
entrances. Under normal circumstances, this would require a bond of around $150,000. You should
anticipate this.
