Subject: SUB201300044 – Lewis Dudley Miller – BLA
The Albemarle County Planning Division will grant or recommend approval of the subdivision
plat referenced above once the following comments have been addressed. The following
comments are those that have been identified at this time. Additional comments may be added or
eliminated based on further review.
1. [14-302(A)1] Name of subdivision. Please add a name to this subdivision, such
as “Lewis Dudley Miller Boundary Line Adjustment” or similar.
2. [14-302(A)10] Right of further division of proposed lots. Please add a note
to reflect the total number of development rights. The note should
state “The new 5.619 acre lot will contain three development
rights. Two development rights exist within the boundary of
‘Parcel A’ as shown in D.B. 836, P. 410 and one development right
exists within the 1980 boundary of Tax Map 26, Parcel 47B.”
3. [14-302(B)5] Zoning Classification. On Sheet 1, please add that this
property is also located in the Flood Hazard (FH) Overlay district.
4. [14-302(B)8] Yards. On Sheet 2, please either remove the note regarding
setbacks or modify the setback around the shared driveway from
75 feet to 25 feet.
5. [14-303(E)] Dimension standards and information on all lots, streets,
alleys, easements, and shared driveways. On Sheet 2, please label
the shared driveway as a “shared driveway easement” and identify
the easement holders. Please also add a note that states the
“Maintenance shall be by the owners of the lots affected by the
shared driveway easement, not by the Virginia Department of
Transportation or the County of Albemarle.”
