Ed,
I believe the name should be spelled “Frederic” as this is the way it was spelled throughout the deed for the life
estate, it also appears that’s the way Mr. Scott Jr. signed his name on the life estate, and County real-estate
records have it spelled this same way. Thus I have no record of it truly being spelled with a “k”. Potentially check
with the clients legal advisor or consult Mr. Scott.

Subject: SUB 201300161 Bundoran Farm – Subdivision Plat
The County of Albemarle Planning Division will grant or recommend approval of the Final Plat referenced
above once the following comments have been addressed: [Each comment is preceded by the applicable
reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [14-212.3] The plat under review by this office was submitted as a Rural Subdivision Plat; however, per the
ordinance this plat does not qualify as a Rural Subdivision. The definition of a Rural Subdivision is “A type
of subdivision that is located in the rural areas which results in two or more lots for the purpose of transfer
of ownership or building development, such that: (i) each lot created is at least five (5) acres in area; and
(ii) each lot created has at least two hundred fifty (250) feet of frontage on an existing public street which is
part of the primary system or secondary system of state highways.” Lot X is neither a minimum of 5 acres,
nor is this lot being divided on an existing public street. Upon review of the plat it appears the division could
be categorized as a Re-subdivision per Section 14-212.3 of the Albemarle County Subdivision Ordinance.
The application fee for this type of plat review is the same as what you previously paid; $690. Thus no
additional fee is necessary. Please completely and accurately fill out and sign the attached application.
This item shall be processed as a resubdivision (check that box).
2. [14-302B. 14-303(D), (O)] On the plat the owner information and signature for TMP 86-45 only provides
for Matthew Spence, CEO of Bundoran Farm; however, County real-estate records provides this parcel of
land with two (2) tax map parcels, with the second being TMP 86-22B, which is 2 acres owned by A Life
Estate For Fredrick W Scott Jr. Parcel X appears to be within, or very close to, the 2 acre Life Estate of Mr.
Scott Jr, and as a life tenant, he has the right to the use and enjoyment of that Estate.
Staff has put a request into the County Attorney’s office to determine if the owner information for TMP 86-
22B is required to be provided on the plat and whether or not Mr. Scott Jr. is required to sign the plat prior
to the approval of the plat.
To aid in the County Attorney’s review of the above please provide the following information:
Has the applicant already worked this proposal out with Mr. Scott Jr, and is Mr. Scott Jr in agreement with
the proposed subdivision? Please provide any pertinent information regarding Mr. Scott Jr’s acquiescence to
this proposed subdivision.
3. [14-317] Does the existing maintenance agreement for Bundoran Farm Drive (private road) provide for
additional subdivisions on residue lots served by the road? If so, provide the section of the agreement which
covers this for County review; otherwise, a revised Maintenance Agreement for Bundoran Farm Drive will
be required to be submitted and reviewed with the subdivision plat. If this is the case please submit a revised
Maintenance Agreement for County review/approval.

4. [14-309 & 14-310] Soil evaluations & Health director approval of septic systems. The submitted soils
evaluations were forwarded to the Health Department for review/approval on 11-13-13; staff is awaiting the
results of the HD review. The plat cannot be approved until their approval is received. Once received I will
let you know.
5. Engineering reviewed the proposal and has no objections as the “Private road is designed to handle
additional lots as allowed by County Code.”
