Glenn, The owner has plans to add a porch on a portion of the patio which will require relocation of the underground propane (see attached). The swale captures the runoff from the owner's roof and sheet drainage from the existing slope. in this case the owner solely benefits from the swale and it doesn't provide relief from an upland concentrated source. Therefore I recommend vacating the entire dedicated easement through this lot The owner wants to start construction as soon as weather permits. , 3 need your input before preparing the plat and can meet at your convenience, Thanks for your assistance. Here is the email string. Let's chat when you have a minute. The safest thing for my guy is to have the propane tank out of the easement. If that does not prove possible,then he can rely on Brooks' email as he wishes, but if when he goes to sell the property there is a problem I don't readily see any other place that he can put that tank, I.e., where he has his ten feet. So maybe we have to compromise: a smaller screened-in porch and a narrower drainage easement. Anyway, let me have your thoughts. Thanks. I represent Arthur W. May. I have already met with Francis MacCall,who in turn spoke with you about the issue, being relocation of a propane tank into a drainage easement. Francis indicated that you, as Zoning Administrator for Albemarle County, had no issue with the relocation. I am requesting a letter from you to that effect, and if more convenient a reply email. The home is located in the Stonegate subdivision,which forms a part of Western Ridge. I am attaching a physical survey of the property,which I believe was performed by Kirk Hughes. What my client wishes to do is to construct a screened-in patio off of the master bedroom.The master bedroom is located, if you are facing the front door of the subject residence,on the back left of the residence. The roof of the proposed patio would tie into the roof of the residence, and accordingly I understand that the tank has to be at least ten feet from the residence. And that is the rub:there is not enough room, indeed anywhere on the lot,to relocate the propane tank in order to maintain the ten foot separation from the new patio area, except into the relatively new drainage easement. There is no rip rap or anything of the sort in the drainage easement, it just being a depression to collect run-off water. Lastly,the propane tank as you know is located underground, and so the line would be extended approximately six feet and the tank buried, in full compliance with Code, approximately only six feet into the drainage easement. As I say, Francis indicated that he had spoken with you and that the County would approve the relocation of the propane tank as set out herein. It would be helpful, indeed necessary, before proceeding to receive written approval from your Office. Let me know how you wish to proceed. I am happy to meet with you at your convenience to discuss this matter, or to receive your letter or reply email, setting out the County's approval. I appreciate your time and your assistance.
