As a condition for the final site plan approval for the development of Grantee's Property, the Virginia Department of Transportation is requiring the _establishment of a sight distance easement along Haden Lane (State Route 1209) along a portion of the front of the Property of Declarant as shown on the Plat. 1 IOW" ' D. Dedication and Conveyance NOW, THEREFORE, in consideration of the premises and the sum of One Dollar ($1.00), cash in hand paid, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Declarant hereby declares and certifies that this dedication is hereby made in accordance with the desires of Declarant, and Declarant further declares that the Property is and shall be held, transferred, sold, conveyed and occupied subject to the sight distance easement as shown on the Plat which is hereby dedicated to public use in order to satisfy the Virginia Department of Transportation's sight distance requirements. The covenants, conditions and agreements of this Deed of Dedication and Easement shall run with and bind the land, and shall inure to the benefit of and be enforceable by the Declarant and Grantee, and their respective successors and assigns.
