Staff has reviewed the information provided in your application package submitted on January 3, 2023. Based on this review, and in accordance with Albemarle County Code § 14-209(C), the application for SUB202200215 TMP 18-18C Rural Subdivision is denied, based on the following applicable sections of the County Code: 1. [§ 14-106] The application was submitted as a Rural Subdivision Application. The proposed subdivision does not meet the definition of a rural subdivision. The proposed lots are all less than five acres in size, but would need to meet the specifications in the following definition for the plat to be approved. Rural subdivision. The term "rural subdivision" means a type of subdivision that is located in the rural areas which results in two or more lots for the purpose of transfer of ownership or building development, such that: (i) each lot created is at least five acres in area; and (ii) each lot created has at least 250 feet of frontage on an existing public street which is part of the primary system or secondary system of state highways. 2. [§ 14-404] The proposed lots do not have a single point of access. The single point of access requires each lot to access Allen Rd (State Route 666) from a single shared driveway or private street established at the same time as the subdivision. The plat must be revised to show a new private street entering onto Allen Road at a single entrance point, which would then serve as the sole access point onto Allen Road for all three lots. Single point of occess required. Each lot, other than a corner lot within the development areas, shall have reasonable access to the building site from only one street, shared driveway or alley established at the same time as the subdivision; provided that, if the subdivision is in the rural areas, each lot created from the subsequent division of any lot within the subdivision shall enter only onto such street(s) established at the same time as the original subdivision and shall have no immediate access onto any other public street 3. [§ 14-232(A) and § 14-234(A)] Private streets serving three or more lots in the rural areas can only be approved by the Albemarle County Planning Commission. The applicant will need to submit a private street authorization request to the County for review. The subdivision Ordinance requires such private street authorization requests to be submitted with a preliminary subdivision plat application. Therefore, to pursue this subdivision as proposed, the applicant must submit a preliminary subdivision plat application for review with the County. a. The private street authorization request can be included with the preliminary plat application. The authorization request must include the information listed in Section 14-234 (A)(1)(a). b. Please be aware that the Planning Commission can only approve the private street authorization request if one or more of the circumstances listed under Section 14-234 (C) exist. In the authorization request, the applicant should clearly identify which circumstance(s) apply in this case. The disapproval of the plat may be appealed as provided in County Code § 14-209 (F) and § 14-231.
