Subject: SUB 2013– 00069 Robert Dameron Jr. - Family
The County of Albemarle Division of Current Development will grant or recommend approval of the
Family Subdivision plat referenced above once the following comments have been addressed: [Each
comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless
otherwise specified.]
1. [14-400 and 14-303i] Minimum Lot Requirements. As depicted County Staff is unable to determine
the frontage of the Residue lot. Assure that each lot has a minimum of 250’ of road frontage on
State Route 795. On the plat clearly label the frontage for the lot. If the required 250’ of frontage
for each lot is unattainable, then the lot shall be revised to have a minimum of 150’ of frontage on
an internal private road. Revise appropriately. Rev 1. Comment addressed.
2. [14-302(A)10]Right of further division of proposed lots. The required development rights note needs
to be revised. It should read: “Parcel A is assigned 1 development right and may not be further
divided. The residue of TMP 123-11 is retaining 4 development rights and when further divided it
shall not consist of more than 21.8 acres.” Rev 1. Comment addressed.
3. [14-303(Q)]Water supply. The property is not within the service authority jurisdictional area, thus
the following statement must be provided on the plat: “Under current county policy, public water
and/or sewer service will not be available to this property.” Rev 1. Comment addressed.
4. [14-302(B)(7)] Reservior watershed. A notation as to whether the land is within an Albemarle
County and/or City of Charlottesville water supply watershed or an agricultural-forestal district.
Provide the required water supply note: “A portion of Parcel A is located in the Totier Creek
Reservoir Water Supply Watershed, the remaining portions of the properties are not located in a
water supply watershed.” Also, add the required note: “The property is not located in an agricultural
forestal district.”
Rev 1. Comment not addressed. Per discussions with Mr. Graff no portion of the property is
located in a water supply area. Staff differs to the surveyor on this finding, regardless the required
note stating such is required to be put on the plat. Thus on the plat provide the following required
notes: “The properties are not located in a water supply watershed.” and “The properties are not
located in an agricultural forestal district.”
5. [14-303(S)] Control Points. Provide at least 4 control points, evenly distributed across the property
and located at survey property corners. At the option of the subdivider, the control points may be
shown on a copy of the final plat, rather than the original signed/notarized version for recordation.
Revise. Rev 1. Comment not addressed.
6. [14-302(B)(1)] General Information. When the plat is revised, please provide the date of the last
revision on the plat. Rev 1. Comment not addressed.
7. [14-212(C)] [14-316] Approval of entrance onto public streets. For this subdivision provide VDOT
approval of the proposed entrance for Parcel A onto State Route 795.
Rev 1. Comment not addressed.
8. [14-309 & 14-310] Soil evaluations; Health Director Approval of wells and septic systems. Provide
three copies of the results of percolation tests or other methods of soil evaluation used to
determine the suitability of the soil for septic systems with conventional drain fields for review and
approval by the Health Department. (This requirement is for both Parcel A and the Residue) This
information will assure each lot has the capability to obtain both a primary and a reserve drainfield
onsite. Rev 1. Comment addressed.
Comments for the applicants
9. [14-212] Affidavit. Please provide the required signed/ notarized affidavit verifying the grantee is an
immediate family member of the grantor. For your convenience a blank affidavit form is attached.
Once provided this document will be provided to the County Attorney for his review/approval.

10. [14-212(B)] Family subdivisions; conditions of approval. The subdivider shall place a restrictive
covenant on the lots created by the family subdivision prohibiting the transfer of the lots so created
to a person who is not a member of the immediate family for the retention period after the date of
recordation. A template for this covenant is attached. Please submit a draft of the restrictive
covenant to me, and I will review them and forward them to the County Attorney for his review/
approval. Rev 1. Comment not addressed.

The method to determine the last portion of the note is based on the total acreage of the original
property: 47.8 acres, then you subtract out a 21 acre parcel (bc this size lot does not need a DR) that
gives you 26.8 acres. Then you subtract out the new lot (Lot A) at 5 acres, this leaves you with the
remaining acreage (21.8 acres) for the remaining DRs.
