'Plat appears to have 3+ dwellings/parcels and will need to submit road plans proving the 3 -5 lot standards per 14- 412.A.2 has been met. 'Should the road require grading then a mitigation plan may be required for disturbance in the stream buffer. In an effort to continue my own research I re- pulled the minutes from the 2 -10 -10 BOS Public hearing on the item: STA2009- 00001. If we do not have to authorize a private street then 14 -412 does not apply. We don't have to authorize a private street because they are exempt from needing required frontage on an existing or proposed street and from having to establish a street per 14 -403 and 14 -404 respectively. From: Megan Yaniglos Sent: Thursday, August 01, 2013 10:31 AM To: Christopher Perez; Francis MacCall Cc: Ellie Ray; Johnathan Newberry; David Benish; Bill Fritz Subject: 14 -412 Chris: 1 have looked into this, and 1 think since a new private street is not being requested, that this section does not apply to your subdivision. The private street is not required for frontage, since that doesn't apply, then we are not approving a new private street. If they were requesting a new private street, then the requirements of 14- 412 would apply. I believe this section only applies for those subdivisions that are requesting new private streets. This is my interpretation of the ordinance, and 1 think it's correct. But, we can discuss this with Bill when he gets back next week and get a final determination if you like. 1 do understand that point of it now serving 6 lots, 1 am not sure we have had this issue yet with these 2009 dwellings. And I can't seem to find a checklist. 1 think 1 may have been thinking of the Special Lot checklist and not this type of subdivision.
