I concur with Francis and Megan.
In an effort to continue my own research I re- pulled the minutes from the 2 -10 -10 BOS Public hearing on the item:
STA2009- 00001. At this meeting the BOS approved the modifications to the ordinance:

I agree. If we do not have to authorize a private street then 14 -412 does not apply. We don't have to authorize a
private street because they are exempt from needing required frontage on an existing or proposed street and from
having to establish a street per 14 -403 and 14 -404 respectively.

Chris:
1 have looked into this, and 1 think since a new private street is not being requested, that this section does not
apply to your subdivision. The private street is not required for frontage, since that doesn't apply, then we are
not approving a new private street. If they were requesting a new private street, then the requirements of 14-
412 would apply. I believe this section only applies for those subdivisions that are requesting new private streets.
This is my interpretation of the ordinance, and 1 think it's correct. But, we can discuss this with Bill when he gets
back next week and get a final determination if you like. 1 do understand that point of it now serving 6 lots, 1
am not sure we have had this issue yet with these 2009 dwellings.
And I can't seem to find a checklist. 1 think 1 may have been thinking of the Special Lot checklist and not this
type of subdivision.
