This letter is being provided to notify you as an adjoining property owner to above listed property that
a special exception application has been submitted for an exception from County Code § 18-5.1.28
requirements on Parcels 03200-00-00-00100 and 03200-00-00-00200 that relate to the required
access setbacks, the 2-acre maximum fill area, and an extension of the 1-year completion deadline.
PROJECT: SE202200068 Kindrick Farm - Clean Earth Fill
PROPOSED: Pursuant to County Code § 18-5.1.28(d), the applicant has applied for an exception from
County Code § 18-5.1.28 requirements on Parcels 03200-00-00-00100 and 03200-00-00-00200 that
relate to the required access setbacks, the 2-acre maximum fill area, and an extension of the 1-year
completion deadline.
ZONING CATEGORY/GENERAL USAGE: RA Rural Areas
SECTION: §18-5.1.28
COMPREHENSIVE PLAN LAND USE/DENSITY: RA Rural Areas - agricultural, forestal, and fishery
uses; residential uses at a density of 0.5 dwelling units/acre in development lots.
ENTRANCE CORRIDOR: No

TAX MAP/PARCEL: 03200-00-00-00100 and 03200-00-00-00200
MAGISTERIAL DISTRICT: White Hall
This petition will be reviewed at the ALBEMARLE COUNTY BOARD OF SUPERVISORS MEETING
ON WEDNESDAY, FEBRUARY 15, 2023. The meeting will also be conducted through electronic
communication means.
Special exceptions must be acted on by the Board of Supervisors, and may be granted after notice to
abutting property owners and upon consideration of whether:
I. There would be any adverse impact(s) to the surrounding neighborhood;
ii. There would be any adverse impact(s) to the public health, safety, or welfare;
iii. The proposed special exception would be consistent with the Comprehensive Plan and any
applicable master or small -area plan(s); and

iv. The proposed special exception would be consistent in size and scale with the surrounding
neighborhood.
If you have comments or concerns regarding this application, please provide them to Bart Svoboda by
MONDAY, JANUARY 23, 2023. The comments submitted for the January 18, 2023, meeting will be
included with the February 15, 2023, meeting information.
