RE: SP202200018 St. Paul's Ivy Church Preschool Action Letter
Dear Ms. Kelly and Ms. Kretlow,
On January 18, 2023 the Board of Supervisors took action on the above noted Special Use Permit on Tax Map Parcel
Number 058A2-00-00-01800, 15.32 acres in the Samuel Miller District.
The Special Use Permit was approved by the Board's adoption of the attached Resolution & Conditions.
Please be advised that although the Albemarle County Board of Supervisors took action on the project noted
above, no uses on the property may lawfully begin until all applicable approvals have been received and
conditions have been met. This includes:
• compliance with the approved SPECIAL USE PERMIT;
• approval of and compliance with a BUILDING PERMIT; and
• approval of a ZONING COMPLIANCE CLEARANCE.

RESOLUTION TO APPROVE
SP202200018 ST. PAUL'S IVY CHURCH
PRESCHOOL
WHEREAS, upon consideration of the staff reports prepared for SP 202200018 St. Paul's Ivy
Church Preschool and all of their attachments, including staffs supporting analysis, the information
presented at the public hearings, any comments received, and all of the factors relevant to the special use
permit in Albemarle County Code §§ 18-10.2.2(7) and 18-33.8(A), the Albemarle County Board of
Supervisors hereby finds that the proposed special use would:
1. not be a substantial detriment to adjacent parcels;,
2. not change the character of the adjacent parcels and the nearby area;
3. be in harmony with the purpose and intent of the Zoning Ordinance, with the uses permitted by
right in the Rural Areas zoning district, with the applicable provisions of County Code § 18-5, and
with the public health, safety, and general welfare (including equity); and
4. be consistent with the Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED that the Albemarle County Board of Supervisors
hereby approves SP 202200018 St. Paul's Ivy Church Preschool, subject to the conditions attached
hereto.
I, Claudette K. Borgersen, do hereby certify that the foregoing writing is a true, correct copy of a

SP202200018 St. Paul's Ivy Chureb Preschool Special Use Permit Conditions
Development of the use must be in general accord with the conceptual plan submitted on
7/15/2022. To be in general accord with the conceptual plan, development must reflect the
following major elements essential to the design of the development:
a. Location of buildings, preschool, and playground areas;
b. Location of parking areas;
c. Site access, including pick-up and drop-off location
Minor modifications to the plan that do not conflict with the elements above may be made to
ensure compliance with the Zoning Ordinance. Modifications to pick-up and drop-off may be
made at the time of a Zoning Clearance and subject to approval by VDOT.
Playground fencing is required at the time of Zoning Clearance.
Signage for pick-up and drop-off location and circulation may be required at the time of Zoning
Clearance to ensure safe vehicular circulation.
Enrollment may not exceed hventy-four (24) children/students.
The hours of operation for the preschool may not exceed 8:30 a.m.-2:30 p.m. Monday through
Friday.
