A sworn complaint has been made by the Inspector, Raymond W. Lilly, who indicates that grading has not taken place in accordance with the approved erosion and sediment control plan 2470 -A. This STOP WORK ORDER shall remain in place for seven (7) days from the date of receipt. If satisfactory repairs have not been made within seven days, the County may elect to issue.another Stop Work Order, and /or petition the Circuit Court for penalties and relief with regard to this violation. Required Correction(s): You are hereby required to grade the site in accordance with the approved erosion and sediment control plan WPO -2004- 00007. The existing disturbed areas associated with plan WPO- 2004 -00007 are not in accordance with the approved erosion and sediment control plan. Sec. 17 -214 (B) of Albemarle County Code dated 8 -5 -98 states "the owner has failed to comply with the corrective measures stated in a notice issued pursuant to section 17 -213, the program authority may issue a stop work order requiring that all or part of the land disturbing activities permitted on the property be stopped until the specified corrective measures are taken." The area along the property line behind the proposed Harris Teeter building and north along the property line shall not be graded to the proposed plan until the plan is approved. Grading will be permitted in areas that meet the approved erosion and sediment control plan WPO- 2004 -00007 only. Specifically, you stated in your message that the County had inspected the site, were satisfied with the slope stabilization and sod work that we and the adjacent property owner had completed and were therefore lifting the Stop Work Order effective December 21, 2007. Your message indicated that we should expect to receive the notification from Mr. Lilly that the order was lifted within about a week of your message. To date, we have not received such notification and would be grateful if you could forward it at your earliest convenience. Thank you again for your patients and support. Ray Lilly, County Erosion Control Inspector, conducted an inspection on the referenced site to determine the status of the corrections required to rescind the Stop Work Order that was issued on September 10, 2007. This inspection determined that the required corrections had been satisfactorily completed. This letter is to serve as notice that the stop work order issued on September 10, 2007, has been rescinded.
