Subject: SDP202200005 Chick-Fil-A #3187 Canopy Project - Minor Site Plan Amendment
The site plan amendment referenced above has been reviewed by the Planning Services Division of the Albemarle County
Department of Community Development (CDD) and by other members of the Site Review Committee (SRC).
The Planner will approve the plan when the following items (from the Planner and other SRC plan reviewers) have been
satisfactorily addressed and when all SRC plan reviewers have indicated in writing their tentative approvals. [Each
comment is preceded by the applicable reference to the Albemarle County Code.]
1. [Comment] Application number. This application has been assigned an application number. Please update the plan
set and future submission materials to reference SDP202200005. Rev. 1: Please also add the application number
to the first sheet of the plan set. Plan sets are used as the primary reference document for site developments.
Including the application number on the plan set will help minimize confusion for staff and field inspectors in the
future. Rev. 2: Comment addressed.
2. [Comment] Format. Please combine all plan sheets together into one document. As this is one request to the
County, it will be approved as a single document. Rev. 1: Comment addressed.
3. [Comment] Dates.
a. Relatedly, in the plan set, all of the plan sheets should have the same original drawing date and note the
same revision date. The County refers to plans by their original drawing date and date of last revision.
(Note: The ordinance stipulates that revised plans include the original date of drawing and the revision
dates) for each subsequent version of the plan.) Rev. 1: Comment not addressed. County ordinance
requires that revised plans include two dates, the original drawing date and the last revision date (if there
are revisions over the course of the County review/approval of the plans). Please include a date of last
revision on the plan sheets. There appears to be a placeholder container for this information within the
title blocks already.
Rev. 2: Reminder that revised plans must include the original date of drawing and the revision date(s) of
each subsequent version of the plan.
Rev. 3: There appears to be a clerical error. The latest revision date - for what the plan calls Revision #4 -
is listed as "2/9/2022", prior to the first submittal of the document to the County. Revise the date block
to reflect a more accurate revision date for Revision #4 (likely late 2022 or early 2023) and provide a
subsequent revision date for the revised plan (e.g. Revision #5).

b. The Project Narrative that was submitted with the application was dated July 28, 2021, however this
document was not received by the County until the February 7, 2022 submission date. Please revise the
narrative to update the date to either the original submission date (2/7/2022) or a future revision date.
Rev 1: Comment addressed.
4. [Sec 35.1] Fees. There looks to be an outstanding balance on the account for this application in the amount of
$14.10. The total cost for this application is $615.68, not including any transaction fees. Please submit the
outstanding balance through the County Portal and email a copy of the transaction receipt to the Planning
reviewer. Feel free to follow up with the Planner if you feel this is a mistake. Rev 1: Comment addressed. Thank
you.
5. [Comment] Previously approved changes. The Minor Site Plan Amendment should reflect the three previously
approved Letters of Revision (LORs) on this site. Staff will email the approval documents and materials for each of
the aforementioned LORs. In the past, some applicants have integrated this information by identifying on an
overall plan map the location of each LOR and noting the LOR number (LOR #1, LOR #2, LOR #3) and changes
made by the respective LOR. Rev. 1: Comment partially addressed. Thank you for including this information. Please
revise the label for LOR #3 to note that LOR #3 was the "Addition of a payment booth and removal of some
shrubs." Rev. 2: Comment addressed.
6. [32.6.2(k)] Lighting schedule.
a. The symbology depicted in the Luminaire Schedule on Sheet ES-1.0 does not seem to match the lighting
symbols used on the plan map. Please review and revise for better alignment. Rev. 1: Comment
sufficiently addressed. The luminaire labels provided with the mapped symbols make clear where
proposed lighting fixtures will be located. (Be advised, the plan map symbol for fixture "L" looks more
similar to the symbol earmarked to represent fixture "OG-1 ETR" by the Luminaire Schedule Table.)
b. There appears to be one additional light along Luxor Rd, close to the intersection of State Route 250,
east of the building, that is not being accounted for in the Luminaire Schedule. Please revise accordingly.

c. Please see additional comments provided by the ARB reviewer, Margaret Maliszewski, below. Rev. 1:
ARB comments related to the lighting schedule have been addressed.
d. [Rev. 1] This revision included two (2) additional sheets, Sheets ES2.1 and ES2.2. These sheets appear to
be taken from the approved final site plan, SDP201400053, for informational purposes. This was not
immediately clear to staff, but became clear over the course of the review. To avoid future confusion,
please include the following language: "Submitted for reference only. Sheet showing the Lighting Plan
previously approved with the approval of SDP201400053." Rev. 2: Comment addressed. Thank you.
Additional comments based on the revised plan submitted on 5.3.2022:
7. [Comment] Landscape Plan. County Policy for site plan amendments requires that minor amendments "incorporate
all the changes approved with the LORs"; however, based on the limited nature of the changes proposed by the
applicant, staff is satisfied by the plan simply locating and providing brief descriptions of the changes approved
with each LOR. However, with multiple changes to the Landscape Plan made by LOR 1, LOR 2, LOR 3, and this
Minor (as suggested by Sheet A-5), staff will be requiring an updated Landscape Plan to be submitted and
approved with this minor amendment. Please include an updated Landscape Plan in the next plan set submittal.
Rev. 2: Staff has reviewed the Landscaping Plan sheet and has the following comments (see below). Overall, the
landscape plan is not currently showing the level of detail needed for approval.
a. The Landscape Plan on Sheet L-100 should clearly indicate plantings: (1) To Remain, (2) Be removed, and
(3) Be added. The current plan map is difficult to decipher with both grey and black linework being used to
represent existing plantings that will remain and the trees to remain being represented by two symbols -
one grey, one black. Revise the Landscape Plan to show one symbol for each plant species and reorganize

colors and/or notes to fit into the three aforementioned categories. Staff have provided an amended
Landscaping Plan from another development as an example of an approvable plan (see document
attached). Rev. 3: See Comment 7n below.
b. Show the three maple trees that front the property in the right-of-way along Rt. 250/Richmond Rd. Staff
wants to ensure that these trees will not be accidentally removed by future work on this parcel. Rev. 3:
Comment addressed.
c. On Sheet A-5, remove Notes 1 and 3 and allow Sheet L-100 to provide the accounting of the shrubs and
ground cover. These notes, as they currently exist, create confusion as they seem to direct the GC and the
County, in determining onsite compliance, to refer to 4 plans (the original site plan and all of the previously
approved LORs (3)). This site plan amendment should instead act as the single, consolidated, updated
Landscape Plan for this site moving forward. Rev. 3: Comment addressed.
d. On the Landscaping Plan, give an accounting of the shrub plantings on the property, similar to the example
landscaping plan and approved landscaping plan for this development. Information to be provided includes
the botanical name, common name, planting size (e.g. caliper or height at planting), and quantity. Rev. 3:
Comment addressed.
e. Consider combining the planting lists under Section A. Site Tree Canopy and the bottom of the page into
one table that includes botanical name, common name, planting size (e.g. caliper or height at planting),
quantity, and canopy square footage for all trees and shrubs that will be greater than 5ft in height at 10-
years maturity, per Sec. 32.7.9.8(b)). Rev. 3: Comment addressed.
f. There seems to be a discrepancy between the plant lists on this page. Is the fourth tree species supposed
to be Black Gum or Wildfire Tupelo? Please review and revise accordingly. Rev. 3: Comment addressed.
g. Staff cannot confirm the Canopy Square Footages (SF) noted under the Landscape Requirements Section
A. What is the source of this information? Staff use the County Plant Canopy Calculations document
(https://www.albemarle.org/home/showpublisheddocument/l020/637551114418370000) when
reviewing canopy calculations. Staff suggest aligning the canopy calculations provided in the plan with this
document to expedite review. Rev. 3: Comment partially addressed. Revise the "provided" site tree
canopy calculations as follows to align with the Plant Canopy Calculations document, County Code
requirements, and tree species listed on the previously approved plan (unless there is reason to believe a
different species has been used):

ii. Remove the 44 Emerald Arborvitae tree species in the tree canopy requirements. In accordance
with Sec. 32.7.9.8(b), trees and other plant materials used to meet this regulation must exceed
five feet in height at a maturity of ten years after planting. The Plant List notes the height of the
Emerald Arborvitae as 4ft. Thus, the species does not meet the height criteria and cannot be used
to satisfy the requirement.
h. Since this property falls within the Entrance Corridor overlay district, update Section B. Street Trees to
note that the street tree requirement for Richmond Rd. is 198LF/35LF and Luxor Rd is 458LF/40LF. Rev.
3: Comment partially addressed. The required number of plantings along Luxor Rd is 12 street trees
(458/40=11.45. County policy rounds up to the nearest whole number. Thus, the requirement is 12). The
plan currently demonstrates compliance with this standard, the notes just need to be updated. Revise the
notes to indicate that 12 street trees are required, 12 are provided, and specifically 6 black gum trees are
provided along Luxor Rd.

m. Staff suggest reordering the sheets such that the Landscape Plan and Partial Landscape Plan are back-to-
back, generally for clarity and also ease of reference. Rev. 3: Comment addressed.
n. Reminder that Sheets L-100 and A-5 must be in alignment with one another.
Rev. 3: Comment partially addressed. Sheet L-100 should show the final planting scheme. It currently
appears to show the planting scheme before some plantings are relocated to make way for the proposed
canopies. Revise the sheet to reflect the final planting scheme. (Be advised, County inspectors will use
the Landscaping Plan sheet to determine whether the site is in compliance with the approved plan once
the site work has been completed.)
o. [Rev. 3] The revised plan shows a deficit in the required tree canopy for the site. Revise the Landscaping
Plan to show compliance with this requirement.
Additional comments based on the revised plan submitted on 9.28.2022:
8. [Comment] Under Project Data on the Cover Sheet, update Note 3 to state that the Landscaping Plan is being
revised. Rev. 3: Comment addressed.
9. [Comment] Under Project Data on the Cover Sheet, update Note 5 to state that the subject property is within the
Entrance Corridor and Managed Steep Slopes Overlay districts. Rev. 3: Comment addressed.
