Senior Center— Belvedere Block 1, Preliminary Site Plan Variation #49 1. Table 10 of the Belvedere Code of Development must be updated prior to Final Site Plan approval. Variation #50 1. The 'Pergola and Garden' feature along Belvedere Boulevard, as shown on the exhibit, will be required in addition to all standard street tree, parking lot, and site plan landscape requirements. 2. An updated description of Block 1 in the Belvedere Code of Development must be provided prior to Final Site Plan approval. Variation #51 1. A minimum nine foot (9') paved parallel parking area must be provided on each side of the road section. Travel lanes will remain twelve feet (12') in width, free of on- street parking. Five feet (5') striped bikes lanes will be provided on both sides of the road section as indicated in the Code of Development. A minimum six feet (6)' planting strip is required between the road and the 8' multi - purpose trail, as previously approved. A four foot (4') planting strip and five feet (5') sidewalk must be provided on the opposite side of Belvedere Blvd for safety and pedestrian access. 2. The full width of the multi - purpose trail must be within the Belvedere Blvd right -of -way. Either a boundary line adjustment or realignment of the road section will be required. 3. As shown on the exhibit, bike lanes must be provided on both sides of Belvedere Blvd. 4. Revised road plans must be approved by the County Engineer and VDOT. Work with the County Engineer to provide additional traffic calming measures to their satisfaction. 5. A revised Water Protection Ordinance plan must be approved by Engineering. 6. VDOT acceptance of Belvedere Boulevard. 7. An updated Table 8 showing the changes listed above (and variations #49 & #50) must be provided as part of an updated Code of Development and Application Plan reflecting all variations approved since February 2, 2010 (the latest Code revision date) comprehensively prior to Final Site Plan approval. SDP - 2012 - 00071. Special Exception for Temporary Construction Yard 1. The temporary construction yard for Dominion Virginia Power's Dooms -Bremo Rebuild Project shall be located in those areas of Tax Map and Parcel Number 07300 -00 -00 -02800 shown on the drawing titled "Dooms - Bremo Rebuilt Project's Temporary Laydown Yard at Ivy Landfill," dated January 18, 2013 (Attachment B). 2. The temporary construction yard shall be used only for the storage of construction or development materials, supplies, equipment, and tools, and the on -site stockpiling and recycling of useable construction materials and other items of Dominion Virginia Power for its Dooms - Bremo Rebuilt Project. 3. Because this special exception authorizes only the temporary construction yard to be located off - site from the construction project, the temporary construction yard shall comply with all other requirements of County Code § 18- 5.1.18(b). 4. Any activities associated with the temporary construction yard shall be conducted during Ivy Material Utilization Center's hours of operation. SP- 2012 - 00029. 5th Street Station 1. Disturbance of the floodplain shall be limited to that part of the attached exhibit which is labeled as "Proposed fill areas as of 27 Feb 2013 ". This area may be increased if determined necessary to accomplish the grading associated with an approved variation to plan. The County Engineer shall have the sole authority in making the determination if this modification to the disturbed area is necessary. 2. Final plans and construction shall provide a stable, non - erodible surface for fill materials, subject to County Engineer approval. 8 3. The applicant shall obtain Program Authority approval for an erosion and sediment control plan, and obtain a land disturbance permit according to the Water Protection Ordinance requirements prior to the start of construction. 4. The applicant shall obtain all necessary federal and state agency approvals (Army Corps of Engineers, Department of Environmental Quality, etc.) prior to commencing construction in the floodplain 5. The applicant shall obtain Program Authority approval of a mitigation plan, and provide mitigation according to the Water Protection Ordinance prior to commencing construction in the County regulated stream buffer. Stream bank mitigation on the Willoughby subdivision property shall be included in the mitigation plan if deemed necessary by the Program Authority and the property owner consents to the improvements in the mitigation plan being constructed on its property. Such mitigation plans shall be consistent with the intent of the proffers. 6. The applicant shall obtain approval from FEMA for changes to the floodplain prior to commencing construction in the floodplain and shall submit all documentation needed by FEMA to accurately reflect the as- built construction for a map revision following construction, Community Development shall not release erosion and sediment control bonds for this area until FEMA has all information needed to update the maps to reflect this change. 9 ALBEMARLE COUNTY CODE A. If the development is located or an area of infill and redevelopment, stream buffers shall be retained if present and establis e w ere they do not exist on any lands subject to this article containing perennial streams and/or nontidal wetlands contiguous to these streams. The stream buffer shall be no less tha measured horizonta y om the e ge o t e nontida wet an s, or the top of the stream bank if no wetlands exist. B. If the development is located within a water supply protection area or other rural land, stream buffers shall be retained if present and established where they do not exist on any lands subject to this article containing perennial or intermittent streams, nontidal wetlands contiguous to these streams, and flood plains. The stream buffer shall extend to whichever of the following is wider: (i) one hundred (100) feet on each side of perennial or intermittent streams and contiguous nontidal wetlands, measured horizontally from the edge of the nontidal wetlands, or the top of the stream bank if no wetlands exist; or (ii) the limits of the flood plain. The stream buffer shall be no less than two hundred (200) horizontal feet wide from the flood plain of any public water supply impoundment. C. On agricultural lands used for crop land, whether located in a development area, an area of infill and redevelopment, a water supply protection area or other rural land, the stream buffer shall include all perennial streams, non -tidal wetlands contiguous with these streams, and a twenty -five (25) foot buffer, measured horizontally from the edge of contiguous non -tidal wetlands, or the top of the stream bank if no wetlands exist. On these lands, the stream buffer shall be managed to prevent concentrated flows of surface water from breaching the buffer area. Each owner of crop land with a stream buffer shall have developed by the Thomas Jefferson Soil and Water Conservation District a soil and water conservation plan, or a component thereof, which, shall be based on an assessment of existing conservation practices of the crop land. D. Each stream buffer shall be maintained and incorporated into the design of the land development to the fullest extent possible. E. Except for the activities pertaining to the management of a stream buffer identified in section 17 -318, the types of development authorized in a stream buffer identified in section 17 -320, and the additional types of development which may be allowed in a stream buffer identified in section 17 -321, no indigenous vegetation within the stream buffer shall be disturbed or removed, regardless of the size of the area affected. (§ 19.3 -41, 2- 11 -98; § 19.2 -8, 6- 19 -91; Code 1988, §§ 19.2 -8, 19.3 -41; Ord. 98 -A(1), 8 -5 -98; Ord. 08- 17(1), 2 -6 -08) State law reference - -Va. Code § 10.1-2108. Sec. 17 -318 Management of stream buffer. Each stream buffer required to be retained or established pursuant to section 17 -317 shall be managed as provided herein: A. In order to maintain the runoff, erosion, nonpoint source pollution control, stream temperature, and ecological values of the stream buffer, indigenous vegetation shall be preserved to the maximum extent possible. The target vegetative cover in the stream buffer shall be an indigenous riparian forest with ground cover, shrub, and tree canopy layers. Removal of vegetation in the stream buffer shall be allowed only as provided in paragraphs (B) and (C). B. Within twenty -five (25) feet of the top of the stream bank and on land classified as nontidal wetland: 1. Indigenous riparian vegetation shall be preserved or allowed to evolve by natural succession where it does not exist; 17 -31 Supp. #19, 7 -08 L t - S ( .1c. r (s 1 v- c t1 skf k+s ALBEMARLE COUNTY CODE Officials guidelines. The temporary turnaround shall be extended to the abutting property line unless a waiver is granted as provided in section 14- 409(D). The temporary turnaround shall exist until the street extensions are accepted into the secondary system of state highways. D. Alleys. Alleys with a right -of -way or easement width of not less than twenty (20) feet may be provided in the rear or side of all commercial, industrial, and residential lots. The design specifications shall be determined by the county engineer, subject to the following: (i) the alley design shall allow emergency services vehicles such as police cars and ambulances to use the alley; and (ii) an alley need not be designed to accommodate the largest emergency services vehicles, except that if firetrucks do not have adequate access to one or more lots from a street, the county engineer shall require that the alley be designed to accommodate firetrucks. The agent may authorize an alley to be established with a right -of- way or easement width of less than twenty (20) feet if the county engineer determines that the proposed design incorporates features that assure public safety and welfare. The county engineer shall consider the provision of adequate access to required onsite parking and/or garages, unimpeded vehicular circulation along the alley, an adequate clear zone along the alley, and other safety issues deemed appropriate for the conditions. Alley rights -of -way may either be established as privately held fee simple interests or as privately held easements. E. Reserved or spite strips. Reserved or spite strips restricting access from adjoining lands to an existing or future street or alley shall not be permitted; provided that nothing herein shall prohibit areas for scenic planting and landscaping where adequate access to the adjoining lands is otherwise available. F. Principal means of access to subdivision. The principal means of access to a subdivision shall be either a public street or a private street. The principal means of access shall conform, in the case of a public street, to Virginia Department of Transportation standards, or, in the case of a private street, to the standards of the county as set forth in section 14 -412, throughout the street's length, including any distance between the boundary of the subdivision and any existing public street. If discharge water of a twenty -five (25) year storm could be reasonably anticipated to inundate, block, destroy or otherwise obstruct a principal means of access to a residential subdivision, the following shall also apply: 1. The principal means of access shall be designed and constructed so as to provide unobstructed access at the time of flooding; and /or 2. An alternative means of access which is not subject to inundation, blockage, destruction or obstruction, and which is accessible from each lot within the subdivision shall be constructed. G. Drainage. Adequate drainage control shall be provided for streets by installing culverts under streets; side, lead, or outlet ditches; catch basins; curb inlets; or any other devices, including piping, as determined to be necessary by the county engineer. All of these improvements shall meet the standards of the county or, in the event no county standards exist, Virginia Department of Transportation standards. H. Curb, curb and gutter, sidewalks and planting strips. In the development areas, streets shall be constructed with curb or curb and gutter, sidewalks and planting strips. Sidewalks and planting strips shall designed and constructed in compliance with section 14 -422. I. Waiver of requirement for curb or curb and gutter. The requirement for curb or curb and gutter may be waived by the commission as provided in section 14- 225.1. A request for a waiver may be made prior to or with submittal of a preliminary plat or with an application to rezone the land, as follows: 1. Information to be submitted.
