What type of change is requested?:

Describe the variation being sought(may attach separate sheets):
With the Block 2B Initial Plan for Old Trail,we are requesting a waiver modification to allow a variation in the overall height requirement of the proposed Building.
The proposed Hotel will be a 3-story structure with a basement and with a Penthouse area that will have permanent structures on the roof,
which under the ordinance counts as a 4-story building,because of the Penthouse areas. The code of development allows 4 story buildings on this block,if the buildings
meet the spacial enclosure guidelines. Based on the distance of the r/w and proposed building to the existing building on Block 1,Table 6A indicates that the number of stories
should be between 3 and 3 1/2 stories. Therefore,we are requesting a variation to allow a four story building on Block 2B,with the Penthouse area counting a the 4th story.
What is the reason for each of the requested variations?:
Old Trail Village is a traditional neighborhood development with pedestrian-friendly streets
and guidelines to ensure proper spacial enclosure of the streets to make sure it fits with the
human scale of the development. Based on the spacing between the buildings on Block 1 and 2 (80' +1-)
the Code of Development states that buildings should be between 3 and 3 1/2 stories in height. The building on Block 1 is 3 stories,and we are proposing a
building on Block 2B which will be 4 stories in height(counting the top penthouse structures);therefore a variation is necessary to allow for the Penthouse structures.

In accordance with § 8.5.5.3 c) of the Zoning Ordinance, in order to grant the variation, the Planning Director must
make positive findings under 5 criteria. Please provide information about these criteria for the Director's
consideration (may attach separate sheets).
1. Is the variation consistent with the goals and objectives of the comprehensive plan?
yes-the neighborhood model is intended to protect the natural environment and enhance the natural beauty with appropriate design-this variation will
provide maximum use of development lots and help create a better and more attractive streetscape by being able to vary the building forms on the lot.
2. Does the variation increase the approved development density or intensity of development?
No. The level of density proposed is not proposed to change. It helps to better define the streetscape and give the ability to create variations in the
building forms along the street.
3. Does the variation adversely affect the timing and phasing of development of any other development in the
zoning district?
This proposed change has no impact on the phasing or timing of any portion of the development of Old Trail Village.
4. Does the variation require a special use permit?
The proposed change does not require a special use permit.
5. Is it in general accord with the purpose and intent of the approved rezoning application?
The streetscapes approved with the original rezoning application will not change. Adequate off-street parking remains the same.
The desired mixture of uses and unit types will not change.
§ 8.5.5.3 VARIATIONS FROM APPROVED PLANS, CODES,AND STANDARDS OF DEVELOPMENT
The director of planning and community development may allow a site plan or subdivision plat for a planned
development to vary from an approved application plan, standard of development and, also, in the case of a
neighborhood model district, a general development plan or code of development, as provided herein:
a. The director is authorized to grant a variation from the following provisions of an approved plan, code or
standard:
1. Minor variations to yard requirements, maximum structure heights and minimum lot sizes;
2. Changes to the arrangement of buildings and uses shown on the plan, provided that the major elements
shown on the plan and their relationships remain the same;
3. Changes to phasing plans;
4. Minor changes to landscape or architectural standards; and
5. Minor variations to street design.
d. Any variation not expressly provided for herein may be accomplished by rezoning.
