(Mr. Early, you know this already, as we have met on-site and discussed it.) Section 17-317 establishes a buffer area on all streams. Any disturbance or removal of vegetation within 100 feet of the riverbank requires a mitigation plan according to section 17-321. A map of the parcel and buffer is attached for your reference. Please provide a completed water protection ordinance application, application fee, and a mitigation plan by the 16th of August 2013. Failure to respond to this notice may be cause for civil action according to section 17-326 of the Water Protection Ordinance. Your plan should show details on how you intend to restore the area. An example might be to re- plant understory trees in an area at least 100' from the creek,with at least 8' on-center spacing, along with ground cover and matting and rip-rap for the stream bank. A good reference for this is the Riparian Buffers Modification and Mitigation Guidance Manual found at this link; (http://www.dcr.virginia.gov/stormwatermanagement/documents/BufferManual_06Rev.pdf) The Water Protection Ordinance application is attached. You can also find a native plant list on the county website at http://www.albemarle.org/nativeplants/. When we met last month after the disturbance and I explained to you the nature of the violation, you said you were going to immediately re-seed the area and stabilize the stream bank. On the 22nd of July, this had not yet happened. As you know from being copied on previous correspondence to your neighbor, I am forced to take action against the actual property owner.
