We are very close to resubmitting for this project but have a clarification question for you:
"An easement plat must be submitted and recorded before the final site plan can be approved. The easement plat will
need SWM and drainage deeds which the county will provide when that plat is ready for recordation."
We understand that Mark Fontaine dropped off the easement plat on 9/20. Is the plat recorded? If so, have the SWM
and drainage deeds been sent to him?
This is the last item we need to confirm before we resubmit hopefully for the final time!

"An easement plat must be submitted and recorded before the final site plan can be approved. The easement plat will
need SWM and drainage deeds which the county will provide when that plat is ready for recordation."
We understand that Mark Fontaine dropped off the easement plat on 9/20. Is the plat recorded? If so, have the SWM
and drainage deeds been sent to him?

I've reviewed with Omega and there are still concerns with the deed. I've attached a clean and marked version that is
acceptable to Omega. I can have this signed if it will be acceptable to the municipality. Issues are:
1. Omega will not agree to make reps/warranties of any kind in this deed. If the municipality wants to do
investigations about title or any other aspect of the easement area to get comfortable, it will need to do that.

2. There should be no right for the municipality to be able to assign the easement. What need would the
municipality have to assign?
3. All construction would be at the municipality's cost.
As you can see, Omega has agree to give on other issues (e.g. interference, indemnity, insurance, etc.) and we are
hoping this is a good compromise that will get the agreement finalized.

I've reviewed with Omega and there are still concerns with the deed. I've attached a clean and marked version that is
acceptable to Omega. I can have this signed if it will be acceptable to the municipality. Issues are:
1. Omega will not agree to make reps/warranties of any kind in this deed. If the municipality wants to do
investigations about title or any other aspect of the easement area to get comfortable, it will need to do that.
2. There should be no right for the municipality to be able to assign the easement. What need would the
municipality have to assign?
3. All construction would be at the municipality's cost.
As you can see, Omega has agree to give on other issues (e.g. interference, indemnity, insurance, etc.) and we are
hoping this is a good compromise that will get the agreement finalized.

We are very close to resubmitting for this project but have a clarification question for you:
"An easement plat must be submitted and recorded before the final site plan can be approved. The easement plat will
need SWM and drainage deeds which the county will provide when that plat is ready for recordation."
We understand that Mark Fontaine dropped off the easement plat on 9/20. Is the plat recorded? If so, have the SWIM
and drainage deeds been sent to him?
This is the last item we need to confirm before we resubmit hopefully for the final time!

No, the site plan, SDP2021-73, is still currently under review. Comments were sent to the Applicant back in January and
they have not resubmitted since. The plat, SUB2022-53, is also still under review, but I believe they have addressed all
comments, so we're just waiting for them to submit the final copies for approval. The plat has to be approved and
recorded prior to the site plan approval, which of course is still pending a resubmission anyways.

Based on the phone conversation on 1/18/2022 with Albemarle County Engineer, Frank Pohl, Fire Rescue has no
objection to the proposed design of the entrance off Greenbriar Drive to the proposed Wawa at Rt 29 and Greenbriar
Drive.
This is based on:
1) Another entrance to the site off of Rt. 29 in compliance with the 10 % grade or less in code.
2) The Greenbriar Drive entrance is paved.
3) Width of entrance does not limit access for emergency apparatus
0
4) The grade for the Greenbriar Drive shall not exceed 16%
5) Exemption requests to the 10% requirement are evaluated on a case by case basis, with consideration of surrounding
road design, topography and limitations presented. The design proposed in this exemption is in line with exemptions
granted for other projects.
6) The proposed design is an improvement to the current entrance from Greenbriar Drive to the business
currently located on this site.

I have reviewed the plans with revision date of 11-19-21 resubmitted for ARB-2021-110: Greenbrier Wawa against the
comments in the 11/15/21 ARB action letter. I have the following comments.
1. Comment #4 from the November 16, 2021 ARB action letter required shrubs to be added between Greenbrier Rd. and
the 8-space parking row. Creeping St. John's Wort was added, which is a ground cover — not a shrub. The intent of the
comment was to provide plants that would have more visual impact from the streets than the ground covers that were
shown in that area. Revise the plan to add shrubs between Greenbrier Rd. and the 8-space parking row.
2. Comment #5 required additional landscaping between the Greenbrier sidewalk and the new path connecting the
sidewalk to the parking lot. Ground cover was added along the path above the monument sign, but no plants were added
between the Greenbrier sidewalk and the new path. The intent was to provide plants with more visual impact than the
ground cover to help compensate for the lack of trees. Revise accordingly.
3. Comment #6 required low level planting along the Rt. 29 and Greenbrier frontages. A row of mixed plants
(coneflower and fountain grass) was added, but the plants won't have impact year-round. Revise the plant choices in
this new row for increased year-round impact.
If I've missed something in the plans, please let me know. Otherwise, a revised plan addressing these comments is
required. A resubmittal form is attached for your use. Please let me know if you have questions.

Response: We have replaced the Coneflower Perennial with Red Twig Dogwood which should provide year round
interest, along with the proposed evergreen shrubs. We've also replaced the lower Abelia shrub with a taller
evergreen shrub, Skip Laurel.

No, I can't imagine it would be ready for approval by then. They have several additional elements that will need to be
approved prior to Final Site Plan that have not yet been delivered. For example, the Applicant has indicated that an
easement plat will be submitted for the easements shown on the FSP, but that easement plat has not yet been
submitted. They also need WPO Plan approval, that special exception approval, and need to address any other
outstanding comments from reviewers.

1. Comment #4 from the November 16, 2021 ARB action letter required shrubs to be added between Greenbrier Rd. and
the 8-space parking row. Creeping St. John's Wort was added, which is a ground cover — not a shrub. The intent of the
comment was to provide plants that would have more visual impact from the streets than the ground covers that were
shown in that area. Revise the plan to add shrubs between Greenbrier Rd. and the 8-space parking row.
2. Comment #5 required additional landscaping between the Greenbrier sidewalk and the new path connecting the
sidewalk to the parking lot. Ground cover was added along the path above the monument sign, but no plants were added
between the Greenbrier sidewalk and the new path. The intent was to provide plants with more visual impact than the
ground cover to help compensate for the lack of trees. Revise accordingly.
3. Comment #6 required low level planting along the Rt. 29 and Greenbrier frontages. A row of mixed plants
(coneflower and fountain grass) was added, but the plants won't have impact year-round. Revise the plant choices in
this new row for increased year-round impact.

I took a look at this Final Site Plan and the "no objection" comment stands. Water and sewer will be provided by public
utilities and the plan shows that removal of the existing monitoring wells will be conducted in accordance with VDH
standards.

I just sent reminder emails again. Charlottesville Utilizes did have some comments on the Initial so hopefully they will
complete their review shortly. VDH's is outstanding but they did have "no objection" to the initial, so I assume that one

Is there any update on the Wawa at Greenbrier? Looks like their final went in about a month ago. Do you think it will be
