SWPPP -Submit using county template for Dunlora Village VSMP Tree Removal ONLY plan. 1. Elements of SWPPP submitted with 5-sheet plan are helpful, but insufficient. Template essential. a. For this plan /future Amendment (and all projects), please always use county template. b. County template, this link. c. Sec. 13 of template is furnished by Engineering, once the WPO plan is approved. (Engineering appends the approved plan to the approved SWPPP via .PDF editing; digital SWPPP must exist as print copy on -site (with Approved plan), marked approved.) SWM Plan 2. Please revise plan title to this, exactly: Dunlora Village VSMP Tree Removal Only, WPO#202100063, Phase 1. This is important. Multiple documents will reference this plan by title, precisely. This title allows reference in documents, and subsequent Amendment, for example: Dunlora Village Subdivision, WPO#202100063, Phase 2 Improvements, Amendment 1. Note: Please accept comment, provide SWPPP, and re -submit revised plan asap —if comments addressed with care, if SWPPP submitted, Engineering can approve plan, 17-Feb. Engineering anticipates (prior submittal) approx. 18.5 Ac. FOS to meet state stormwater water quality requirements, once plan is amended. By revising VRRM.xIs (sheet 5) to show 7.50 Ac. FOS and 0.5 Ac. impervious post-dev tree removal land cover, nutrient purchase requirement is reduced to a 0.03 lb. credit. No purchase is required, if 7.50 Ac. FOS post-dev land cover. • Note: If there is unmet tree removal phase nutrient purchase requirement (positive value /no credit), then Applicant must complete purchase prior to receiving a Grading permit. A grading permit is required to cut trees. • 7.50 Ac. FOS land cover requires an easement, yet trees may be cut with an approved plan /WPO plan bond /Grading Permit, since F05 easement may be shown on first final subdivision plat. • Pls. delineate /show /label 7.50 Ac. FOS easement via linework, notes and labels, on sheet 3. Please rely on discussion to -date when revising calcs. or SWM plan. ESC plan 5. Include VESCH details, plates Plate 3.13-2 (ST); 3.14-2 (SB). a. Although neither trap nor basin detailed design is required at this time, it is important that these typ. details appear on the plan. 6. Include prominent label centered on graphic image of areas to be cleared of trees, to read: 'Apply mulch, 50' wide ground cover upslope of TP' a. Locate label in center of site, for example, between contours 440' and 450', sheet 3, with multiple leader lines to indicate where. b. Provide additional existing contour labels, sheet 3. c. Include Additional Notes, sheet 3 to read: i. New Note 1: 'Trees > 3" DIA at breast height may not be cut, Apr-1 thru Nov-14, of any year (TOYR), per ESA Section 7 species -specific protections for the Northern Long Eared Bat (NLEB), pending further USFWS guidance.' ii. 'Albemarle recommends mulch cover from chipping limbs on -site for any area logged, and requires mulch ground cover for 50' (Min.) width upslope of any tree protection fencing, and upslope of any limit of tree -clearing.' iii. 'County ESC inspector may direct placement of additional ESC measures not shown if deemed necessary to control or limit erosion and off -site sediment transport during or after tree - clearing.' iv. 'No cutting of trees is permissible within jurisdictional wetland areas without U.S. Army Corps of Engineers (USACE) permit clearance. Jurisdictional wetland areas are identified, and labeled' v. Tree protection measures are to be maintained throughout the course of the project and are to be replaced if damaged' d. Revise sheet 3 Notes, as follows: i. Ex. Note 1: Add lead phrase: 'During NLEB TOYR, prior to...' ii. Note 3: Delete reference to brush barriers. iii. Note 4: Delete iv. Note 6: Replace 'Proposed preliminary limits of disturbance is concurrent' with 'Proposed preliminary limits of tree harvest area are concurrent...'. v. Note 7: Delete first sentence, then revise remainder to: Tree protection shall be implemented on uphill slopes where applicable or as directed to preserve stands of trees that shall remain' vi. Note 8: Revise to state contractor (not county inspector) to mark preserved steep slopes. vii. Note 10: Append this to end of note: '(is permissible) during tree removal Phase 1.' viii. Note 11: Revise to read: 'Total tree harvest area = 22.0 Ac' ix. Note 13: Append to Note: 'See also WPO202000034 Amendment #2, approved 1/10/23' 7. Mulch is not required if tree -cut area is downslope of limit of tree -clearing with runoff to interior of site, but such areas are few, if any. In any case, mulch is recommended for exposed earth. 8. Mulch is not required for existing agricultural land, meadow, pasture, etc., unforested areas with no tree - clearing. Objective is mulch to bare earth, and any tree cut area 50' upslope of limits of tree clearing. 9. Albemarle does not approve brush barriers. 10. Brush barriers are ineffective on sloped terrain or with clay soil. Brush barriers would also obstruct and impede access for Phase 2 development. 11. Remove brush barrier (BB) symbol from legend, BB linework /labels from plan, and reference to brush barriers in notes. 12. Remove super silt fence SSF linework /legend /label /notes from sheet 3 of plan, but retain detail on sheet 5, for use if needed (similar to ST /SB plates). 13. Show WPO202000034 Amendment #2 2.80 Ac. LOD linework (off -site Belvedere V grading at end of Miranda and Fowler, on Dunlora Farm parcel). 14. Sheet 3: Delete 'Limits of Clearing & Grubbing' Label. Grubbing is impermissible. 15. Tree protection (TP) linework /legend /labels /notes are fine —please do not revise, or remove. 16. Show (linework) 1,500-1,800 LF construction road, beginning at existing Dunlora Farm road. General 17. There is urgency: Northern long-eared bat (NLEB) USFWS designation as a federally endangered species imposes time of year restriction (TOYR) on tree cutting. 18. NLEB TOYR begins Apr-1, 2023. Endangered Species Act (ESA) Section 7. 19. After Mar-31, trees > 3" DIA (breast height) may not be felled until tree -cutting restriction ends November 14, of any year. 20. Conduct tree removal activities outside of the NLEB pup season (June 1-July 31) and/or the active season (April 1-November 14). b. Avoid clearing suitable spring staging and fall swarming habitat within a5-mile radius of known or assumed NLEB hibernacula during the spring staging and fall swarming season (April 1-May 14 and August 16-November 15). c. Manage forests to ensure a continual supply of snags and other suitable maternity roosts trees. d. Conduct prescribed burns outside of the pup season (June 1-July 31) and/or the active season (Aprill- November 14). Avoid high -intensity burns (causing tree scorch higher than NLEB roosting heights) during the summer maternity season to minimize direct impacts to NLEB. e. Perform bridge repair, retrofit, maintenance, and/or rehabilitation work outside of the NLEB active season (April 1-November 14) in areas where NLEB are known to roost on bridges or where such use is likely. f. Do not use military smoke and obscurants within forested suitable NLEB habitat during the pup season (June 1-July 31) and/or the active season (April 1-November 14). 24. No grading is permitted with proposed Tree -removal only plan except as needed to level for construction haul road. RGA estimates 1500 LF construction road. Rev. VRRM.xls allows 1,815' x 12' w haul road. 25. Amendment #1 (future submittal) a. We anticipate RGA will rely on email /comments /meeting guidance, and will submit an Amendment #1 (incl. SWM /Calcs.) in the near future. b. Amendment #1 requires separate application fee, additional WPO plan bond amount, and SWM /public drainage easements (may record with first subdivision plat). c.
