County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to act on any VSMP permit by issuing a project approval or denial. This project is denied. The rationale is given in the comments below. The VSMP application content requirements can be found in County Code section 17-401. A. Stormwater Pollution Prevention Plan (SWPPP) The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary. 1. [17-402.C.4] Identify the person holding a certificate of competence required code who shall be in charge of and responsible for carrying out the land disturbing activity. 2. Fill out the Registration Statement. A State permit will be required prior to starting land disturbing activities. If it was filled out, the information was stripped when uploaded to our system. Please be sure to "flatten" the PDF document before resubmitting it. 3. Update drawings after corrections are made Oust a friendly reminder). B. Pollution Prevention Plan (PPP) The PPP content requirements can be found in County Code section 17-404. 1. Notes: Remove reference to "grading". 2. Update as needed to reflect other comments. C. Stormwater Management Plan (SWMP) VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a SWMP. This plan is disapproved, and the reasons are provided in the comments below. The stormwater management plan content requirements can be found in County Code section 17- 403. 1. Provide a copy of the nutrient credit affidavit after the transaction has been completed. This is required for approval. Engineering Review Comments Page 2 of 3 D. Erosion and Sediment Control Plan (ESCP) Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP. This plan is disapproved, and the reasons are provided in the comments below. The erosion control plan content requirements can be found in County Code section 17-402. 1. General a. Include prominent label to all sheets centered on areas to be cleared of trees, to read 'Tree Clearing Only - Mulch All Areas' or something to that effect. 2. Cover Sheet a. Change the WPO number on the cover sheet to WPO202300009. b. Remove/delete the sheet titles from the Sheet List Table that are not included in the submitted plan set. c. Remove unused abbreviations and symbols. d. Remove the signature block. e. Remove reference to the initial site plan in the revision block. f. Revise Note 12 to reflect clearing of trees only. The listed improvements are not reflected in the drawings. g. Remove Note 13. h. Update other notes to reflect current scope of work, which is to clear and mulch the site only. 3. Sheet 2 a. Note 5 - change 'and' to 'and/or' mulched. 4. Sheet 3 a. Change 'disturbance'to 'clearing'. For example, 'limits of disturbance' should be 'limits of clearing'. 5. Sheets 9 and 10 a. Change'Tree & Forest Demolition' to 'Tree Clearing Limits'. b. Change 'disturbance'to 'tree cutting'. c. Add Safety Fence (SF) around all wetland areas. If the permit is issued at a later date, the SF can be removed with a field change to the SWPPP. d. Notes: i. Change the title to 'Tree Clearing Notes'. ii. Note 2 - remove 'demolition'. Revise last sentence to read: 'spread on site as mulch as an erosion...'. iii. Note 4 - Change 'disturbance' to 'tree clearing'. iv. Note 6 - change 'disturbance'to'clearing'. Change 'demolish' to 'clear' or 'cut'. 6. Sheets 11 and 12 a. Add 'to be installed upon demand of the County ESC Inspector' under the ESC BMP callouts except MU. Or add a prominent note stating that mulch is being used as the primary ESC measure and all other BMPs shown on this plan will be installed upon demand of the Engineering Inspector. b. Add a note stating, 'County ESC inspector may direct placement of additional ESC measures not shown if deemed necessary to control or limit erosion and off -site sediment transport during or after tree -clearing'. c. Change 'disturbance' to 'tree clearing'. d. Change'wood chip'to'wood chip mulch' wherever MU is indicated. e. Replace silt fence from alongside channels within the project with rock check dams within the channels instead. Silt fence should only be installed level with Engineering Review Comments Page 3 of 3 contours. 7. Sheet 13 a. Note 3 - revise accordingly. b. Revise all notes to reference tree clearing only. The VSMP permit application and all plans may be resubmitted for approval when all comments have been satisfactorily addressed. For re -submittals please provide 2 copies or submit digital PDF of the complete permit package with a completed application form. Engineering plan review staff are available from 2-4 PM on Thursdays, should you require a meeting to discuss this review. Process: After approval, county staff will enter project information in the DEQ database for state application processing. DEQ processes the application based on local VSMP authority approval. DEQ will email and bill the operator directly for their portion of the application fees, which will need to be paid directly to DEQ and include instructions on how to pay the fee. When DEQ approves the application and receives payment, they will issue a permit coverage letter, which must be posted at the construction site. After DEQ coverage is issued, via the coverage letter, the County can hold a pre -construction conference. Applicants must complete the request for a pre -construction conference form and pay the remainder of the application fee. The form identifies the contractor and responsible land disturber, and the fee remaining to be paid. This will be checked by county staff, and upon approval, a pre -construction conference will be scheduled with the County inspector. At the pre - construction conference, should everything proceed satisfactorily, a grading permit will be issued by the County so that work may begin.
