" Please note that a final plat must be submitted to the Department of Planning & Community Development within six (6) months of the date of approval of the preliminary plat or the preliminary plat approval shall be null and void. The final plat may be approved administratively and must be recorded within six (6) months of the date it is signed, or the approval will be null and void. RE: Withdrawal of Indefinite Deferral Request (Wholley Preliminary Plat) Dear Members of the Planning Commission, On behalf of Mike Wholley I hereby request that indefinite deferral be removed from his preliminary plat. A meeting with the highway department took place on Friday, January 6, 1984 to ascertain that site distance could be obtained at both entrances in question and I am in the process of getting the planning staff's recommendation for changes in the proposed lot structure. The members of the Planning Commission were concerned about the number and nature of the waivers requested from the Private Road Provisions of the Subdivision Ordinance. Specifically, some of these concerns were: 1. The property is located in the South Fork Rivanna Watershed area; sensitivity to the natural environment in the construction of roads and grading should be addressed; 2. There is some question about the availability of sight distance at both the private street commercial entrance and the private driveway to serve Lots 3 and 4 . The location of the driveway should be delineated by markers to allow sight distance to be calculated by the Virginia Department of Highways and Transportation. Areas of possible grading should be identified. A sight distance easement needs to be obtained by the applicant from the adjacent property owner to the south of the private street commercial entrance, or the applicant should request a waiver from the Planning Commission of Section 18-37 (o) of the Subdivision Ordinance , which states: "Each entrance onto any public road . . . shall be constructed in accordance with the design standards of the Virginia Department of Highways and Transportation. " 3. RE: Mike Wholley Preliminary Plat Dear Members of the Planning Commission, Upon being informed Friday, December 16, 1983, of three additional sections of the subdivision ordinance of which his proposed preliminary subdivision has been found in violation of, Mr. Wholley has advised me to do the following: 1) Redesign Lots 1, 2 and 3 and 2) Request waivers of sections 18-37 k, 18-37 e, and 18-36 B3 to the extent the above redivision will not remedy these areas of the ordinance. One comment that seems particularly relevant to Mr. Wholley's situation is that the subdivision ordinance is really geared to designing subdivisions with lots less than five acres. By definition , if a lot contains the required state road frontage and is over five acres , it does not fit the definition of a subdivision. With this in mind, because of an average lot size of ten acres , there are areas in the ordinance which technically apply to this sub- division which I feel create an unfair hardship in designing a large lot subdivision. RE: Waiver Request - Wholley Preliminary Subdivision Dear Members of the Planning Commission, On behalf of Mike Wholley, I hereby request a waiver of Section 13-34 dealing with Double frontage of Lots 1 and 2. Also to the extent Lot 1 could possibly be interpreted as being in violation of Section 18-29 dealing with the shape of lots , I request a waiver. Gale: The Albemarle County Planning Commission, at their meeting of November 22 , 1983 , voted unanimously to defer action on the above referenced preliminary plat until their regularly scheduled meeting on December 20 , 1983 . Please submit five (5) copies of a revised plat to the Planning Department no later than 5 : 00 p.m. Tuesday, December 13 , 1983 . Please note that the Planning Commission discussed but did not grant the requested waiver of Section 18-36 (d) , Private Road Provisions of the Subdivision Ordinance . It was determined at the meeting, if the applicant intends to persue the original preliminary plat, a waiver of Section 18-34 of the Subdivision Ordinance will be necessary. This section states , ."double frontage or reversed frontage lots shall not be permitted except where essential to provide separation of residential development from streets or to overcome disadvantage of topography. " Members of the Planning Commission were concerned about the irregular shape of Lot 1, (see Section 18-29 Shape of lots , Subdivision Ordinance) . The Planning Commission would like the revision to further address the issue of the proposed joint access easement for Lots 3 and 4 from Rt. 682 , and particularly the problem of site distance at the proposed entrance location. Waiver Request: Wholly Preliminary Plat Dear Members of the Planning Commission, I hereby request a waiver of section 18 - 36(d) of the subdivision ordinance requesting all lots fronting on a private road to access off the private road. Specifically, it is requested that lots 3 and 4 share a joint entrance off State Route 682 and that all other lots be required to access off of the private road. Mr. Wholly had originally intended for lots 2, 3 and 4 to have sep- arate entrances off State Route 682 and had been under the impres- sion there would be no problem since the lots would not come under the subdivision ordinance if platted separately. However, upon learning of the Highway & Engineering Departments concerns, he has agreed to a joint access for lots 3 and 4 and has added additional land to lot 2 to accommodate private road access.
