Samuel Miller Magisterial District. (TM 73 , Parcel 17) . ZONING: Rural Areas . PROPOSAL: To divide 64 . 35 acres into six (6) lots ranging in size from 5 . 0 to 21. 0 acres. REASON FOR PLANNING COMMISSION REVIEW: Private easement serves proposed division. TOPOGRAPHY OF AREA: Moderate slopes with streams . CONDITION OF ROADS SERVING PROPOSAL: This segment of Rt. 637 carries an average 547 vehicle trips per day, Rt. 682 carries 33 vehicle trips per day. Both road segments are considered non-tolerable. WATERSHED IMPOUNDMENT: This property is located in the South Fork Rivanna Watershed Impoundment Area. SOILS : The Soil Conservation Service reports area soils are deep, well-drained loam soils . COMPREHENSIVE PLAN RECOMMENDATION: Property located in Rural Area III , recommended for ten acre density. SCHOOL IMPACT: The total projected enrollment is about three students with slight impact to Murray Elementary, Henly Middle and Western Albemarle High School. TYPE UTILITIES : No public facilities are available. STAFF COMMENT: The Virginia Department of Highways & Transportation recommends that the road be built to state standards to provide for possible future dedication to secondary system. Sight distance to the southof the entrance is less than the 250 ' that would be acceptable. A sight distance easement would be necessary to assure that the area is kept properly cleared. The County Engineer recommends the road be constructed as a public road. ***The applicant is requesting that the Planning Commission waive Section 18-36 (d) of the private road provisions of the Subdivision Ordinance which states, "any lot fronting on any such road (private road) shall enter only onto such road and have no immediate access to any public road. " The applicant proposes a joint entrance off Rt. 682 to serve lots three and four. If the waiver is granted by the Planning Commission, the private road would only serve four building lots . The road is now a gravel road in fair to good condition. The Subdivision Ordinance requires private roads serving six or more lots shall be treated with prime and double seal . The applicant has submitted a soil scientist report which indicates buildable areas on each proposed lot. The soil scientist report does outline a spring and stream which originates on lot 2 , flows through lot 3 and joins the stream indicated on lot 4 . This stream should be shown on the final plat with the 100 ' septic setback noted. The final plat may be signed when the applicant has met the following conditions : a.
