(Attachment A). The property is zoned Rural Areas (RA), and REVIEWED BY: VWC
Entrance Corridor(EC), and designated as Rural Areas 4 by
the Comprehensive Plan.

BACKGROUND: This proposal is for road improvements and a bridge over Route 53 which will provide
access to Monticello and create a connection with the pedestrian trails along the Thomas Jefferson
Parkway. Road plans for this project have been reviewed and approved by the Virginia Department of
Transportation, and a minor site plan amendment has been required to address the proposed changes on
properties adjacent to the bridge site (Attachment C).
Section 4.2.3.1 states, "No structure or improvement nor earth disturbing activity to establish such structure
or improvement shall be located on slopes of twenty-five (25)percent or greater, except as otherwise
permitted under section 4.3.01." Section 4.3.01 (Fill and Waste Areas) states that the establishment of
waste areas shall be permitted in all zoning districts, and must be in compliance with section 5.1.28 which
sets forth the requirement of a grading permit for these types of activities.
In accordance with section 5.1.28, the applicant has requested Engineering approval of a grading permit to
establish a waste area for approximately 28,000 cubic yards of excess fill on a portion of Mountaintop
Farm(Tax Map 77/Parcel 31). As a condition of approval of the grading permit for this waste area the
Engineering Department County has required that the applicant obtain a waiver to allow disturbance of the
critical slopes. A letter from the owner of Mountaintop Farm, granting permission for the proposed grading
and fill activity, is included as Attachment D.
DISCUSSION:
Waiver for Critical Slopes:
The applicant is proposing to create a waste area by placing fill dirt from the road project within an area
that contains critical slopes. Section 4.2.3.2 of the Zoning Ordinance restricts earth-disturbing activity on
critical slopes and section 4.2.5.2 allows Planning Commission to waive this restriction upon finding that a
strict application of these provisions would not forward the purposes of the Ordinance.
The applicant's waiver request and justification is attached(Attachment E). An approximately two (2) acre
with critical slopes will be filled, compacted and re-established at grades no steeper than 3:1

(approximately thirty-three percent slopes). Engineering and Planning staffs review of this proposal
concentrates mainly on the five(5)health, safety, and welfare concerns set forth in Section 4.2.
The Engineering Department has addressed concerns with movement of soil and rock, excessive
stormwater run-off and siltation, and recommends approval of this request (Attachment F). Engineering
analysis has determined that proper slope construction and vegetation can be effective in preventing large-
scale movement of soil. Finished slopes will be comparable in grade to the existing slopes,with
stormwater being conveyed into a new twenty-four(24)inch pipe to be placed below the fill. Therefore,
Engineering Staff has identified that there would be no increased potential for excessive stormwater run-off
as a result of this proposal. Inspection and bonding of silt traps and other erosion control measures,by
County staff,will help to ensure that the concern with siltation is addressed appropriately. Because fill dirt
is often more vulnerable to erosion than the naturally occurring soils it is Engineering staffs opinion that
inadequate stabilization in the areas where fill will be introduced could result in increased erosion of a
natural swale at the foot of the mountain where the slopes are located.
Engineering Department's original analysis of this request supported this proposal to disturb the critical
slopes,but a recommendation was withheld pending the submittal of additional information. Engineering
staff requested that the applicant demonstrate that no alternatives to placing the fill on the critical slopes,
which would require piping of the streams, or concentrating drainage in swales on top of the fill exist. The
applicant has provided additional information(Attachment G), and upon further review the Engineering
has recommended approval (Attachment H).
Because there are no existing or proposed septic fields located within area where critical slopes will be
disturbed, concern for the effect of this proposal on septic effluent is not a factor in staffs analysis.
Planning staffs review of this request relates to the concern for the possible loss of aesthetic resource. The
property proposed for this waste site is adjacent to Route 53, an Entrance Corridor. The Architectural Review
Board [ARB] has reviewed the bridge and all related improvements for their aesthetic impact on the Entrance
Corridor. The ARB recommends approval with conditions, including one which states that the applicant must
revise the plan in order to demonstrate how the waste site will be re-vegetated. The amended site plan will not
be approved until these conditions satisfied and the Design Planner has issued a Certificate of
Appropriateness.
Although none of the other resources that are identified on the Open Space Plan Concept Map are present at
the specific site of the waste area, some of the adjacent properties are designated as Registered Historic Sites,
and have portions that are identified as Surveyed Historic Sites and mountains by the Open Space Concept
Map and Resource Inventory Map. The largest portion of the are where critical slopes will be disturbed is
covered in pastures, and is barely wooded. Staff recognizes that this project would have the most aesthetic
impact during the construction stages. However, once the waste activity is finished and the area has been re-
vegetated, staff is of the opinion that the slopes would not be excessively different. This is the existing critical
slopes proposed for disturbance are mainly grassed pastures that will be returned to a grades that are similar to
that of the existing state. Therefore, Planning staff has found no conflict with the proposal to fill and the
critical slopes and recommends approval with conditions.
RECOMMENDATION: With the support of the Engineering Department, and Architectural Review Board,
Planning staff finds no conflict with this request. Staff hereby recommends approval of the critical slope
waiver request [Section 4.2.3.2] with the following condition, to be met prior to final approval of the site plan
amendment:

1. The Engineering Department must approve a grading permit, and all erosion and soil control
measures prior to the establishment of the waste area; and,
2. Design Planner approval of measures for re-vegetation of the waste area, and issuance of a
Certificate of Appropriateness.

PROJECT DESCRIPTION
THE THOMAS JEFFERSON PARKWAY
Monticello, Thomas Jefferson's home in Albemarle County, is the only house in
America listed on the World Heritage List. The 1.6 miles of Route 53 from Route 20 to the
Monticello entrance serve as the gateway for 550,000 visitors each year. Both the Thomas
Jefferson Memorial Foundation, which owns and operates Monticello, and Albemarle County
have recognized the need for a scenic, protected, and safe approach to Monticello.
Albemarle County's Comprehensive Plan is a blueprint for future growth in the
County. In 1991, the Planning Commission and Board of Supervisors modified it with the
recommendation that a "scenic and protective" parkway be constructed to Monticello within
the existing Route 53 right-of-way. The parkway's purpose is to provide for safe and
efficient access for motorists, bicyclists, and pedestrians while preserving the area's rural
character. The Board of Supervisors subsequently designated Route 53 the Thomas Jefferson
Parkway.
The Thomas Jefferson Memorial Foundation undertook the task of creating a parkway
in the true sense of the word: a linear park which contains a scenic road. This parkway is
designed to protect and enhance the existing vehicular corridor, offer access to Monticello by
other modes of transportation, and provide a recreational and educational amenity which
broadens and enriches the visitor's experience, but also stands alone as a community park.
In 1993 and 1994, the Commonwealth Transportation Board of the Virginia
Department of Transportation committed a combined total of $2.5 million to the Thomas
Jefferson Parkway from Enhancement monies made available through the Intermodal Surface
and Transportation Efficiency Act. The Foundation matched this grant with $750,000 funds
donated by enthusiastic supporters of the project. Phases I and II will be under construction
in the spring of 1996.
The Foundation is now ready to undertake the final phase of construction. Phase III
will include a vehicular and pedestrian stone bridge over Route 53 near the Monticello's
Gatehouse, and a tunnel under Route 53 just east of its intersection with Route 20. Both of
these projects, by avoiding an on-grade crossing of a busy highway, are critical for assuring
safe access to Monticello by pedestrians, bicyclists, and motorists.
Thomas Jefferson himself proposed in a bridge at what is now the Monticello
entrance:
The north side of Monticello below the thoroughfare roundabout quite down to the river and
all Montalto above the thoroughfare to be converted into park and riding grounds, connected at
the Thoroughfare by a bridge, open, under which the public road may be made to pass so as
not to cut off the communication between the upper and lower park grounds.

The vehicular stone bridge, originally included in Phase III of the Conceptual Plan
submitted in 1993, will provide the capstone to the Thomas Jefferson Parkway.

► It will significantly improve the safety of the Monticello entrance by
eliminating the need for a vehicular, left-hand turn lane, and by avoiding
dangerous on-grade crossings for pedestrians and bicyclists.
► Stone bridges are the defining image of the best American parkways.
► Thomas Jefferson wrote admiringly of stone bridges, calling one of them "the
most handsome bridge in the world," and considered a bridge at this very
location.
In addition, the Foundation hopes to complete other Phase III projects shown in the
original conceptual plan: hiking trails, the scenic overlook, and additional plantings in the
park and arboretum. These Phase III projects are so essential to the completion of the
Thomas Jefferson Parkway that the Foundation will raise $1.5 million to match the $750,000
in funding requested of the ISTEA program -- a 200 percent commitment rather than the
requisite 20 percent. The stone bridge, pedestrian tunnel, and other Phase III projects will
lend safety, durability, and beauty to a Parkway that many believe is the showcase of the
ISTEA legislation nationwide.

To Whom It May Concern:
Excavation for the Thomas Jefferson Parkway Bridge will generate approximately 28,000
cubic yards of excess fill. Our client, the Thomas Jefferson Memorial Foundation, is requesting
a critical slope waiver to allow for placing the fill in two small valleys adjacent to the
construction site.
The grading plan and `before and after" illustrations show the placement of the fill. The
grades will be no steeper than 3:1 in the fill area and the construction documents require the
contractor to compact and place the fill to meet the requirements of the inspecting geotechnical
engineer. With the exception of erosion control measures, that is the extent of development on
these slopes. Therefore, we are asking the Planning Commission for a waiver to allow for this
improvement to the slopes adjacent to the new bridge.
With regard to the five health, safety and welfare concerns addressed in the Zoning
Ordinance(4.2), we offer the following:
1. The fill is being placed in accordance with the recommendations of a geotechnical
engineer to protect against the rapid and/or large-scale movement of soil and rock:
2. Stormwater will be carried in pipes under the fill to a sediment basinibioretention
facility designed so store the water and slow its runoff;
3 The same sediment basin/bioretention facility will allow for siltation to occur before
runoff leaves Monticello property;
4 The illustrations included show "before and after" views, The end result will be that
the valleys in the pastureland will be more gently sloped;

RE: Thomas Jefferson Parkway Bridge (Monticello entrance), site plan
amendment
The revised letter received on 7 July 2000 requesting a waiver for critical slopes to place excess
fill on adjacent property at the site of the Thomas Jefferson Parkway bridge has been reviewed.
This letter addresses each of the concerns of section 4.2 of the Zoning Ordinance, and refers to
the erosion and sediment control plan received on 2 June 2000. The critical slopes are not
delineated.
The proposed disturbance of critical slopes is to place excess fill from the bridge project. Soil
will be placed over the existing slopes at 3:1 (33%), in two swale areas, one of which contains a
spring and small stream which is proposed to be piped under the fill. The proposal comprises
about a 2 acre critical slope disturbance. Below, each of the concerns of section 4.2 are
addressed:
"movement of soil and rock"
Proper slope construction and vegetative stabilization will prevent any movement of soil.
No special stability measures have been proposed.
"excessive stormwater runoff'
The slopes being constructed are comparable in steepness to the existing slopes, which
range from 40% to 10%. The existing slopes are mostly grassed pasture. When this is re-
established, no significant increases in runoff are expected.
A change in the nature of runoff is anticipated with the 24" pipe placed under the fill.
Stormwater flow through this pipe can be expected to be more concentrated and of a
higher velocity than occurs now.
"siltation"
Inspection and bonding by the County will ensure siltation control during construction.
Silt traps are proposed during construction. After the construction phase, proper
stabilization and maintenance may ensure long term stability. Fill dirt is generally looser
and more susceptible to erosion than naturally occurring soils. Its placement in a natural
swale area where runoff collects at the bottom of the mountain may increase erosion in
the swales.

This is not relevant.
The waiver request appears supportable. Prior to the Engineering Department
recommending approval, the applicant will need to provide additional information to
address section 4.2.5.2 of the Zoning Ordinance. Of particular interest is any information
summarizing possible alternatives to the placement of the fill on critical slopes. In

Dear Glenn:
As we discussed, enclosed is a print of the erosion control/grading plan revised to show
tying into existing grade between the two fill areas. To achieve your objective of diverting the
water off the fill areas and into the area left at existing grade, we are proposing to make
permanent the dikes installed for erosion control. These dikes will be lined with EC III as shown
on the detail. We have also added a note that, should erosion occur in areas, Class I riprap will
be installed.
With regard to your other concern, since this is a landscape of critical slopes, we feel the
only alternative to placing the fill adjacent to the bridge construction site is hauling it away at a
cost of S60,000.
I hope this addresses your concerns. I apologize for getting this to you on your last day
before vacation. I have copied Mark Graham as you suggested he might deal with it in your
absence. Also, as promised, I am enclosing a copy of the"before" and "after" computer-
generated images of the proposed fill areas.

RE: Thomas Jefferson Parkway Bridge (Monticello entrance), site plan
amendment
As requested in the Engineering Department memorandum of 17 July 2000, the applicant has
supplied additional information regarding the plans for the fill next to the Thomas Jefferson
Parkway Bridge. A drawing delineating the areas of critical slopes was provided in a meeting
with the applicant on 8 August 2000, and a revised grading plan and letter were received on 11
August 2000.
The two concerns identified in the review have both been satisfactorily addressed. The
first concern was regarding alternative locations for the fill which would not disturb
critical slopes. There do not appear to be any better locations in the immediate vicinity,
and the applicant indicates that the cost of hauling the material rules out locations further
away.
The second concern was the handling of runoff in the fill areas. The applicant has revised
the grading plan to allow an overflow area between fill areas with diversion dikes around
the fill.
With this additional information and revision to the plan, the Engineering Department
supports the critical slope waiver request.
