Bill, you will need to do this with Pat. But, I would recommend that they show us a preliminary plat that reflects their variation request before we move to final. We would then approve the variation with the preliminary site plan. In terms of Mr. Hevener, I think we need his approval. We didn't look for his approval with the rezoning because it was up to the PC and Board and he had an opportunity for input; however, with this change, he needs to be ok with it. You have told us the following: The colors on the plan mean: Grey area—designating the bio-filter to be removed. Orange area—designating the relocated lots and residual lots (not to exceed original approved lot density [30 market rate and 6 affordable]) Red area—designating modification to existing road layout (shift adele street south toward trailhead park) Blue area—designating 4 bay quality facility to collect water and then outlet into stream which flows to adjacent Lickinghole, LLC pond Green area—to remain undisturbed area in trailhead park providing access from the street through the lots to the trailhead park in the west. Yellow area—tot lot and trailhead to remain per the proffer The grading shown in the stream buffer and trailhead park is residual from earlier plan iterations. It is not proposed. The sketch is intended to show design changes, not grading. The sketch relies on off-site stormwater management to the north on property partially owned by the applicant. Wayne and I have made the following conclusions after consultation with, Greg, Amelia, Dan, Glenn, and Rebecca. 1. The request for a change in design to allow future access from Claudia Street through the mobile home park, instead of Adele Street through the mobile home park is a variation Wayne can approve, per Amelia. 2. Off-site stormwater management may be allowed and a change in location of the swm does not conflict with the proffers because the proffers emphasized the location of the trailhead parks. Stormwater management may be relocated by variation, according to Greg. 3. By changing the future access from Claudia Street, the road connecting from the mobile home park to Eastern Avenue will be further east which allows for the stream buffer on the western side of the property to remain undisturbed. 4. Off-site stormwater management to the north will allow for the trailhead park on the northern part of the site and minimize the grading needed in that area for a bmp. 5. The plan cannot be reviewed and has not been reviewed in detail for the bmp's shown on the plan because of the old grading lines and scale of the drawing. 6. The Planning Director will authorize the requested variations after the following occurs: a. The applicant shall contact the mobile home park owner to the south concerning the change in future access from Adele Street to Claudia Street and provide a letter from that owner indicating he has seen the plan and that the change in access is not problematic. b. The applicant shall provide a formal variation request. 1/28/2008 Page 4 of 4 7. Approval of the variation would not be approval of grading shown on the plan, bmp's shown on the plan, or any other stormwater management shown on the plan. Approval would be for change in location of the future access street from Claudia, the path to the park on the west, the change in layout for four lots on the western side of the development, and a commitment that the trailhead park to the north would not be used for stormwater management and would result in minimal grading. 8. As a condition of approval of the preliminary plat, the owner of the adjoining property must provide legal consent for use of his property for stormwater management from Westhall. The simple response is that we would want to have the concurrence of the trailer park owner. The difference here as compared to the original re-zoning is that we do not notify adjacent owners for a variation as we do for a re-zoning. Therefore, if the owner is relying on the original re-zoning approval for which he was notified he would not have the chance to weigh in on this change that has a direct relationship to roads in his property. For that reason, we would want to know that he has no opposition to the variation. I hope this addresses this matter and let us know if you need any other information. The stormwater management facility shall be designed such that its shape, placement, and land form (grading) transition between the adjacent street, greenway, and trails to the satisfaction of the Department of Parks and Recreation and minimize disturbance of the stream buffer within Parcel C shown on the Application Plan to the satisfaction of the Program Authority. Open space areas dedicated to public use shall be for the use and enjoyment of the public, including the residents of the project. The Owner shall make a contribution of $3,000 to the County to be used by the Parks and Recreation Department for the construction of a pedestrian bridge in the general location shown on the Application Plan. The contribution shall be payable prior to issuance of the first building permit for the property. If the bridge is not constructed within 10 (ten) years of rezoning approval of the property, the contribution shall be reallocated to the County's Capital Improvement Program for park improvements for the community of Crozet.
