Our firm represents Home Depot, which is the owner of tax map parcels 06100-00-00-13100, 06100-00-00- 131A0, 06100-00-00-13200, and 06100-00-00-13300, containing the majority of the Fashion Square Mall and surrounding parking and accessways, and is zoned Planned Development Shopping Center (PDSC). Home Depot proposes to build a Home Depot department store in the same general location of the overall Mall where the existing Sears building is located – on the northern end of the Mall. The proposed location, along with the parking, loading, and drop off and pick-up areas are conceptually shown on Attachment 1 and on Attachment 3. As part of its planning, Home Depot requests an official letter of determination that the proposed changes and improvements are in general accord with the Application Plan approved with SDP 1979-0007 Fashion Square Site Plan Amendment (the “Application Plan”) included in Attachment 2. The Application Plan for Fashion Square Mall is comprised of a main “thru mall” and four attached large building areas for various retail department stores. Except for the portion of the Mall labeled for the Leggett department store, the Mall was shown on the Application Plan as a one-story building. The Sears portion, now vacant, is located at the north side of the Mall and included an auto service center as part of the building, and an area for a future gasoline island in the adjacent parking area to the north. The auto service center included an area for cars awaiting repair to be parked as well as associated parking for customers and employees. On the eastern side of the Sears building a pickup and drop off area is shown, as well as a loading dock/loading area. Home Depot proposes to locate a new store in the same location of the Mall as the existing Sears building. The Sears building is located on the northern end of the Mall, and Home Depot proposes to 2 build its store in the same location on the northern end of the Mall. Home Depot proposes to make the following changes to the Mall building as shown conceptually in more detail in Attachment 1: 1. Provide additional parking and drop off/pick up areas in the front (on the western side). As with the Sears store, the main entrance to the Home Depot store will be located on the west ern side of the Mall. 2. Include a garden center, that will not be covered, in the parking area to the north of the building adjacent to Rio Road, in the same general location where the future gas station island is shown on the Application Plan. 3. Improve the design of the travelway into the site from Rio Road to be consistent with the traffic/turn movement pattern shown on the Application Plan. This would include removing the current entrance alignment consisting of a long straightaway from the Mall entrance along Rio Road intersection along the entire frontage of the existing Sears store. That alignment encourages speeding in an area where pedestrians are walking between their vehicles and the store entrance. The proposed realignment would require vehicles to slow down and would minimize conflicts with pedestrians at the front of the store. An aerial image showing the current unsafe condition is shown below, as is an inset from the approved Application Plan showing the intended entrance alignment and turning movement pattern. Despite the minor changes to the parking and alignment of the current unsafe travel ways, the overall travel and accessways around the Mall are being maintained. 4. Minor shifts in the location of the loading dock in the rear of the building, although it continues to be located on the east side of the Mall. The conceptual plan also proposes to include a truck turn-around area that will improve the safety of the area. 3 Current Entrance and Travelway Alignment: Turn Movement Pattern Shown on approved Application Plan: 4 The proposed Home Depot will be approximately 108,841 square feet, with an approximately 26,691 square foot open air garden center. As shown on the approved Application Plan, the Sears portion of the Mall was 104,102 square feet, however that did not include the areas for the future gas station or parking for the auto service center. Regardless, the proposed Home Depot building is very similar in size to the existing Sears building, but when these other areas are considered, the proposed Home Depot is actually smaller than the total permitted area of the Sears store. This issue is discussed in more detail below. The proposed Home Depot (including the proposed open-air garden center) is proposed to be in the same location of the overall Mall as the existing Sears building (including its permitted future gas station) – on the northern end of the Mall adjacent to Rio Road. To compare the square footage of the proposed Home Depot against what was approved for the Sears portion of Fashion Square Mall, the following information has been provided. First, a map created with the County GIS indicating the square footage of the areas of parking associated with the auto service center, which is approximately 25,620 square feet in the aggregate. In addition, based on the guidance of the Community Development Department staff that we consider the size of the gas station island associated with the Kroger at Rio Hill Shopping Center, using the County GIS, we measured that area to be approximately 22,500 square feet. With this information we created two charts showing the comparison of square footage between the Application Plan and the proposed Home Depot, as shown below. This data demonstrates that the proposed square footage for the Home Depot with a garden center at 135,532 square feet is actually smaller than the 145,124 square foot area designated for the Sears building with its auto service and gas station areas. Specifically, the central features and major elements of the approved Application Plan remain in the same location as shown on the Application Plan (on the north end of the Mall). In addition, the proposed Home Depot, including the parking areas, travel ways, and other design elements, are of the same general character, scope, and scale as shown on the approved Application Plan. See Attachment 3 which contains an overlay of the proposed Home Depot on the approved Application Plan and demonstrates this conformity. • The proposed Home Depot is consistent with the purpose and intent of the Planned Development Shopping Center zoning district, which is “to serve areas not conveniently and adequately provided with a broad range of commercial and service facilities. Regulations provided are intended to encourage planned commercial centers with carefully organized buildings, service areas, parking areas and landscaped areas .” • The proposed use of the space for a Home Depot department store is the same use as the prior Sears department store. A department store is a by-right use within the Planned Development Shopping Center, as described in Section 25.2.1: “Uses permitted by right in the C-1, CO and HC districts, except for storage yards. Outdoor storage, s ales or display shall be permitted only when enclosed by appropriate visual screening .” Section 22.2.1 (permitted uses in a C-1 district) permits a Department Store in a C -1 district, therefore a Department Store is permitted in the PDSC district. Furthermore, Section 24.2 (permitted uses in the HC district) includes several additional uses that are comprised of the Home Depot department sto re, including: building materials sales, hardware store, and retail nurseries and green houses. For all of these reasons, we believe we have demonstrated that the proposed Home Depot is in general accord with the approved Application Plan, and we request your confirmation of that determination.
