The Planner for the Planning Services Division of the Albemarle County Department of Community Development
will recommend approval of the plan referred to above when the following items have been satisfactorily
addressed. (The following comments are those that have been identified at this time. Additional comments or
conditions may be added or eliminated based on further review.) [Each comment is preceded by the applicable
reference to the Albemarle County Code.]
1. [14-302(A)4; 14-303(E); 14-302(A)5; 14-302(A)6] Clarify the purpose of the new driveway depicted on the plat. Is
this proposed to be a shared driveway for both subject parcels? If it is shared, is this proposed to be located within
an easement?
There appears to be another driveway along the western boundary of TMP 31-26D that provides access to TMP
31-30A. Why is this driveway not shown on the plat, or proposed to be used in some way?
2. [14-302(B)5] Include in the zoning note for this plat that the properties are also located within the Airport Impact
Area Overlay District.
3. [14-302(B)7] Clarify in the note that the Chris Greene Lake watershed is a water supply watershed.
4. [14-303(A)l In the owner's approval note, the property is identified as "Parcel A." However, elsewhere on the plat,
the parcel is identified as "Parcel X." Fix this discrepancy to ensure the property is always identified consistently.
5. [14-303(E)] Include a note on the cover sheet of the plat that maintenance of the new driveway shall be by the
owners of the lots affected by the driveway, not by the Virginia Department of Transportation or the County of
Albemarle.
6. [14-303(N)] Include the following note on the cover sheet of the plat:
UNLESS SPECIFICALLY DENOTED AS PUBLIC, THE STREETS AND OTHER REQUIRED IMPROVEMENTS IN THIS SUBDIVISION ARE
PRIVATE IN NATURE AND WILL NOT BE MAINTAINED BY EITHER THE VIRGINIA DEPARTMENT OF TRANSPORTATION OR ANY OTHER
PUBUC AGENCY. THE MAINTENANCE THEREOF IS THE MUTUAL OBLIGATION OF THE AFFECTED LOT OWNERS. FAILURE TO
MAINTAIN THE IMPROVEMENTS IN SUBSTANTIALLY THE SAME CONDITION AS ORIGINALLY APPROVED BY THE COUNTY MAY
CONSTITUTE A VIOLATION OF COUNTY ORDINANCES)
7. [14-308.1] Because the lots in this subdivision are less than 21 acres, a Tier 2 Groundwater Assessment is required.
The County performs this assessment. However, the fee of $406.64 must be paid.
8. [14-309; 14-310] Because these lots in this subdivision are both less than five acres, review by the Health
Department is required. This BLA plat is currently under review by the Health Department. Comments or approval
from the Health Department will be forwarded to the applicant upon receipt by County staff.
