County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to act on any
VSMP permit by issuing a project approval or denial. This project is disapproved for reasons listed below.
The VSMP application content requirements can be found in County Code section 17-401.
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must contain
(1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary.
1. Revise title pg. of SWPPP to reference WP02022-00050. (Rev. 1) Addressed.
2. Once revisions complete, include I I" x 17" plan inserts, Sec 4 /5 (ESC /SWM plans). (Rev. 1) Persists.
(Rev. 2) Comment revised: Please remove plans from Sec. 4/5. Once plan review comments addressed
and plan is approved, Engineering will mark plan approved and append plan at Sec. 13 of SWPPP. DEQ
requires an approved plan marked approved be part of the SWPPP.
3. Sec. 1 /Registration Statement:
a. Sec. II.F. —List `Albemarle County' since project located in Albemarle County MS4. (Rev. 1)

4. Sec. 8: List /name qualified personnel responsible for SWPPP inspections. (Rev. 1,1) Persists. Applicant
response (letter d. 2/22/23): `This will be provided once a contractor is selected.'
Required for Grading Permit, not plan approval.
5. Sec. 9: Signed Certification (is blank): Complete form with next submittal. (Rev. 1,, Persists. Applicant:

6. Sec. 11: Insert 26-p. 2019 VAR10 CGP. Available at this link. (Rev. 1) Partially addressed. Asfollow-

C. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a SWMP. This
plan is disapproved for Admin. items listed below (recorded easement plat /SWM maintenance agreement).
The storrnwater management plan content requirements can be found in County Code section 17-403.

a. Revise WPO plan title and Calc. packet title to include reference to WP02022-00050. (Rev. 1)
Addressed.
b. Recommend also ref WP02022-000491 Maplewood Development, TMP 461344 /adjacent parcel
(Rev. 1) Apparently addressed. Applicant response (1/10/23 letter):' WP0202200049 is now
referenced." County cannot locate reference. (Rev. 2) Withdrawn. Applicant: `Upon further
discussion with the Owner, we are no longer proposing a temporary grading easement on the
adjacent parcel. The grading is not needed for this project. Maplewood Development will need an
easement in the future, regardless, in order to make a connection to this parcel so it was
determined that an additional grading easement for this project would not accomplish much.'

show roads clearly w/ identifiable EP features (gray solid line). Only existing contours and Worth
Crossing and EOP labels are provided, but not distinct EP linework, which is now requested.

coordinate with Ana Kilmer, 434,296-5832 -x3246 ( akilmeraalbemarle.org) prior to purchase to ensure
bill of sale /Affidavit include requisite project data. Nutrient purchase not required for plan approval but is

D. Erosion and Sediment Control Plan (ESCP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP. This plan
is disapproved for (minor label) reasons listed, below. The erosion control plan content requirements can be
found in County Code section 17-402.

10:19 AM explains ROE is a last resort reserved for extenuating circumstance, that
easement plat is the vehicle to show off -site easement. SUB20230001 I can (and does)
show easement to benefit Forest Lakes Self -Storage (TMP 46B4-3) on TMP 46134-4.
iii. Note: Once a WPO plan is approved, SWM Agreement is recorded, and Grading Permit
issued for Maplewood Development (TMP 46134-4), Albemarle will have right to enter
adjacent parcel, but development plans often change, so i./ii. are required, unless iii.
(Rev. 1) Persists, see 3.a.i, ii, above: Applicant: "Acknowledged, access will be
provided by way of easement/ROE agreement." (Rev. 2) NA; Also, pls. see SWM plan,

iv. Regardless of status of Maplewood Development, if Forest Lakes Self -Storage receives
plan approval, then, absent ROE ifi above), Maplewood (Owner, TMP 461344) must be
party to ESC plan bond, since ESC measures for TMP 46134-3 (Self -Storage) are located
on 461344 (Maplewood). This requirement is inflexible until such time development of
TMP 46B4-4 advances to point that no self -storage ESC measures are located on TMP
46B-4. All of this (item. 3.a.i.-iv.) may be avoided if Forest Lakes coordinates WPO plan
design with Maplewood Development design (Collins Engineering) to show no grading
and no ESC measures on TMP 46134-4. Either option is acceptable: 3.a.i.-iii, or 3.a.iv.
(Rev. 1) Persists: Applicant: "The grading easement has been agreed to by both parties
to make the connection easier so an ROE agreement will be provided." (Rev. 2) NA;

labels (and sheet), since cannot locate riprap outfall dimension labels in plan view. (Rev. 2) Partially
addressed. Applicant: 'Please reference the riprap labels on sheet C3, as well as the outlet protection
dimension table on sheet CIO. Riprap dimensions are now shown on sheet C8 and C9 as well.' Asfollow-

'Next Steps' after WPO plan approval
Purchase Nutrient Credits (34-7 3.34 lb. required)
a. PLEASE coordinate with the County reviewer before working with (Ivy Creek) nutrient bank. The
reviewer must confirm if your project must follow the DEQ hierarchy requirements (Ivy Creek is only
eligible nutrient bank since project discharges to S. Fork Rivanna River, which is impaired).
b. Letter of availability must be provided on the WPO approved plans.
c. Applicant must contact/coordinate nutrient credit purchase with Ana Kilmer,
akilmer albemarle.org.
d. Affidavit of Purchase must be provided to Ana Kilmer before a grading permit can be issued.
2. Post WPO Bond
a. Applicant must submit a 'Request to Establish a Bond' form and fee to CDD.
i.Complete the form and email it to akilmer"bemarle.org, along with proof of payment (see
below).
b. Payment can be made either online or with a check.
i.If paying online:
1. Go to the online payment portal.
a. Select WPONSMP as the application 'type.'
b. Type in the WPO number and project name in the Notes/Details section of the
form.
C. Type in the `payment amount' as $294.34.
d. Click "Proceed to Secure Checkout" link to make payment.
2. You will receive a receipt in an email.
ii.Email a copy of the receipt to akilmergalbemarle.org.
c. Once the bond request and payment are received, the applicant can provide the bond estimate
(completed on the County worksheet), or Engineering staff will complete the estimate. Once the
estimate is approved, Ana Kilmer will contact and work with the applicant to post the bond.

Obtain DEQ Permit (if required, required since LOD =4.09 Ac.)
After nutrient credits have been purchased and the bond has been posted:
a. County staff will register the project with DEQ.
b. Applicant/operator listed on the Registration Statement will receive an email with instructions on
how to pay the DEQ permit fee.
c. Applicant must email a copy of the DEQ receipt of payment to charris e albemarle. org_
d. DEQ typically will issue a permit within 2 weeks of receiving payment.
4. Request pre -construction meeting:
a. Complete and email the Request for a Preconstruction Meeting and Grading Permit
to charris(iWbemarle.org.
b. Pay the fee via the online payment portal or a check at the pre -construction meeting. If paid
online, email a copy of the receipt to charris(o)albemarle.org.
All steps must be completed before the grading permit can be issued.
