RE: COMMENT RESPONSE to 1st Review, SUB202200126, Victorian Heights Subdivision

Please find below our responses to review of the plat referenced above (Victorian Heights Subdivision Plat); we appreciate your
comments and review. Included (below) are comments provided by Albemarle County with responses (in red), accordingly:
Planning:
1. [General Comment] Review the comment letter for SDP2022-00047 Victorian Heights Final Site Plan as well, as
many of the comments are the same or similar. Because the development is made up of attached units, and a site
plan is required, the site plan and the subdivision plat must match, with the subdivision lines reflecting the approved
design of the site plan. Acknowledged. Surveyor and Engineer have aligned site plan to plat. (to date)
2. [General Comment] It is recommended that the easement plat be submitted asa separate application, as it generally
makes for a quicker and less complex review and approval process. Noted, and understand notion of separating.
However, for this plat, and in accordance with desires of developer, easements shall be included with subdivision
plat formatting.
3. [ZO 18-30.2.61 This development will require review by the Planning Commission to determine anticipated impacts
of the cluster development and bonus density provisions and regulations on the Airport Impact Area overlay district.
Provide a narrative justifying why this proposed development will not have a negative impact on the AIA
requirements. (Comment also found in site plan review letter.) Site plan /engineering topic —Collins Eng. to address.
4. [ZO 18-2.2] The calculations for open space and the bonus density appear to be incorrect. See Zoning Division
comments in the final site plan review letter for SDP2022-00047. (Comment also found in site plan review letter.)
Please see 'Density, Units, & Open Space note header on plat cover (SH 1); reported items for density to align with
site plan report of same. Open space 'proposed' is based on area calculations incidental to plat.
5. [14-302(A)3] Revise the right-of-way dedication notes to indicate they are being dedicated to the County of
Albemarle (not the Commonwealth of Virginia). Addressed.
6.[14-302(A)4;14-302(A)5] Lot 18appears toencroach onautility easement. Addressed.
7. [14-302(A)9] Provide the following note on the cover sheet of the plat: "Lots 1-35 each contain a building site that
complies with section 4.2.1 of the Albemarle County Zoning Ordinance." Addressed. Please see note 22, sheet 1.
8. [14-302(B)1 ] Provide the date of last revision of the plat on all future submittals. Addressed.
9. [14-302(B)5] In the zoning note, identify that this development is using the cluster and bonus density options in
the R-15 District, along with the actual density of the final layout (since it will be greater than 15 units per acre).
Addressed.

10. [14-302(B)5] If the special exception application requesting modifications to the required setbacks is approved by
the Board of Supervisors, a note stating the Board's action will need to be added to this plat under the zoning
Engineer (Collins) has advised that this component is pending. Surveyor acknowledges that plat approval shall be
contingent on this County approval / exception. Once action is documented, a note shall be added accordingly.
11. [14-302(B)8] Ensure the side setbacks for Lots 1 and 35 meet the requirements of 18-4.19, since the adjacent
parcel is zoned R-6. If the buildings on those lots are over 35 feet in height, then they must be set back five feet,
plus one foot for each foot the dwelling unit exceeds 35 feet in height. (Staff recognizes that this requirement will
largely be reviewed with the site plan; however, as mentioned previously, it is important to ensure the plat and site
plan match.) Acknowledged. Side setbacks confirmed as 5 feet.
12. [14-303(M)] Label the proposed new alley with a street name. (See also the comment memo from E911, which is
attached.) Addressed.. see Perseus and Taurus Lanes, now noted.
13. [14-303(N)] Add the following note to the cover sheet: "The streets in this subdivision may not meet the standards
for acceptance into the secondary system of state highways and will not be maintained by the Virginia Department
of Transportation or the County of Albemarle." Addressed. Please see survey note 18.
14. [14-303(Q)] Provide a note on the cover sheet indicating whether this subdivision will be served by a public water
supply and public sewage system. Addressed. Please see survey note 23.
15. [ZO 18-4.6.4] The rear yard setbacks are measured from the edge of the alley easement, not the property line.
Revise the setback lines on the lots adjacent to the alley. This requirement can be modified with a special exception,
however. Surveyor acknowledges that plat approval shall be contingent on this County approval / exception. Once
action is documented, a note shall be added accordingly.

Emily Cox, ecox2@albemarle.org —Requested changes; seethe comments below:
-Ensure easement labels match those on the site plan (SDP202200047). This includes public vs. private labels.
Addressed. Easement labels align with site plan.
-Storm easement from SWM facilityto outfall should be public, not private. Storm drains collecting water from public
ROW should be public. Addressed.
-Public storm & SWM facility easements will need associated deeds. Engineering will draft these deeds when the final plat
is readyfor signatures. Noted. Developer/ legal team action item.
Albemarle County Information Services (E911)
Andy Slack, aslack@albemarle.org— Requested changes; see the attached memo. (restated below)
The access way shown as'Alley'will require a road name for addressing the future structures. Please provide
a list of three (3) potential road names to this office for approval. The road will need to be named before
final approval can be given. Noted, addressed. See road names (Perseus and Taurus)
