Box 5207 Charlottesville, VA 22905 RE: Swimming pools in Forest Lakes North and Forest Lakes South Dear Mr. Franco: You have asked for a clarification of the zoning regulations that apply to pools and clubhouses built in Forest Lakes North and Forest Lakes South. We understand that The Kessler Group is negotiating the conveyance of these facilities to the homeowners' association(s) of Forest Lakes North, Forest Lakes South and Springridge. We further understand that the residents of these three communities are all allowed to use both of these facilities. And, we understand that The Kessler Group is exploring the possibility of allowing the residents of other developments, either existing or future, to use these facilities. It has been the longstanding and consistent administrative practice of this department to allow private pools and clubhouses in residential developments. These are permitted by right because they are considered to be accessory to the primary use of the property which is residential. These facilities are approved with reduced parking requirements because it is assumed many will walk or ride bicycles to them. Commercial clubs and swim, golf, tennis, or similar athletic facilities that are not accessory to a particular residential development but are located in a residential zoning district require a special use permit. We have determined that such a facility can be considered accessory when its membership is limited to residents of dwelling units that were identified on the plan at the time the facility was initially approved. We recognize that this may be difficult to interpret in some instances. However, in this case, in order for the facilities in Forest Lakes North to be considered accessory to a primary residential use and, therefore, permitted by right, its membership must be limited to residents of Forest Lakes North.
