RE: New Special Use Permits and Rezoning Applications
Enclosed is the list of special use permit and rezoning applications received on April 19,2004. Special uses and
rezonings will no longer be going to the Site Review Committee meeting; however, if a special meeting is needed with
the applicant,you will be contacted. We will provide your written comments to the applicant in approximately two and a
half weeks. Please review these applications and provide comments by May 14,2004 as follows:
SP 2004-00013 Old Trail Golf Club Amendment: Request to amend SP-02-16 to remove condition#2, regarding the
alignment of the road serving the golf course being in conformity with the Crozet Master Plan,once adopted. The
property,described as Tax Map 55,parcels 71, 103F and 105 and Tax Map 56, Parcel 17B is zoned RA, Rural Areas
in the White Hall Magisterial District. The property is designated Rural Area on the Comprehensive Plan in the Crozet

SP 2004-00014 Gary T.Dalton: Request for a special use permit to allow a Home Occupation Class B for Furniture
Making in accordance with Section 10.2.2.31 of the Zoning Ordinance,which allows for Home Occupations Class B.
The property is described as Tax Map 94, Parcel 90,contains 2.1 acres, and is zoned RA, Rural Area.The proposal is
located at 3830 Whitetail Lane(Route 828), approximately.25 miles from the intersection of Whitetail Lane and
Running Deer Road(Route 808), in the Scottsville Magisterial District.The Comprehensive Plan designates this

SP 2004-00015 Bethel Baptist Church Amendment: Request for amendment of a special use permit for an existing
church to allow for a parking lot expansion, in accordance with Section 10.2.2.35 of the Zoning Ordinance which allows
for church uses in the RA(Rural Areas). The subject parcel,described as Tax Map 21, Parcel 25,contains
approximately 3.004 acres zoned RA. This site is located just east of Route 29 North at the intersection of Bumley
Station Road(Route 641)and Watts Passage(Route 600). The property lies within the Rivanna Magisterial District in
the area designated as Rural Areas 2 by the Comprehensive Plan. (Rebecca Ragsdale)
Ninth Swim and Tennis CIub1lRequest for special use permit to allow all Forest Lakes
Associates developments within the Forest Lakes North and Forest Lakes South neighborhoods to use the swim and
tennis club amenities of either neighborhood in accordance with Sections 15.2.2.4 and 5.1.16 of the Zoning Ordinance
which allow for swim,golf,tennis and similar facilities. The property,described as Tax Map 46B3 Parcel B contains
8.559 acres, and is zoned R-4(Residential). The proposal is located at 1824 Timberwood Boulevard(Route 1721)in
the Forest Lakes North development,within the Rivanna Magisterial District. The Comprehensive Plan designates
this property as Neighborhood Density in the Community of Hollymead.(Margaret Doherty)
SP 2004-00017 Forest Lakes South Swim and Tennis Club: Request for special use permit to allow all Forest
Lakes Associates developments within the Forest Lakes North and Forest Lakes South neighborhoods to use the
swim and tennis club amenities of either neighborhood in accordance with Sections 20.4.2.1,22.2.2.6, 18.2.2.4 and
5.1.2 of the Zoning Ordinance which allow for swim,golf,tennis and similar facilities. The property,described as Tax
Map 46B5 Parcel 1 B contains 6.552 acres, and is zoned PUD(Planned Unit Development). The proposal is located
at 1650 Ashwood Boulevard(Route 1670)in the Forest Lakes South development,within the Rivanna Magisterial
District. The Comprehensive Plan designates this property as Neighborhood Density in the Community of Hollymead.

SP 2004-00018 Leroy and Helen Moyer—ALLTEU Nix Way: Request for special use permit to allow the
construction of a personal wireless facility with a monopole, approximately 80 feet in total height and 10 feet above the
height of the tallest tree within 25 feet The proposed facility includes flush-mounted panel antennas and ground
equipment. This application is being made in accordance with Section [10.2.2.6]of the Zoning Ordinance which
allows for microwave and radio-wave transmission and relay towers in the Rural Areas. The property,described as
Tax Map 92 Parcel 5663,contains 8.98 acres, and is zoned RA Rural Areas and EC, Entrance Corridor Overlay
District. The proposal is located on Thomas Jefferson Parkway(Route 53), approximately 1.3 miles east of the
intersection of Thomas Jefferson Parkway and James Monroe Parkway(Route 795), in Scottsville Magisterial District.
The Comprehensive Plan designates this property as Rural Areas in Rural Area 4. (Stephen Waller)
SP 2004-00019 Christian Aid Mission—ALLTEL: Request for special use permit to allow the construction of a
personal wireless facility. The applicant proposes to construct a flagpole approximately 85 feet in total height. The
cables and antenna will be located within the flagpole,ground mounted equipment will be located adjacent to the pole.
The proposed diameter of the flagpole is approximately 18 inches. This application is being made in accordance with
Section [23.2.2.3]of the Zoning Ordinance which allows for microwave and radio-wave transmission and relay towers
in the Commercial Office District. The property, described as Tax Map 59 Parcel 23G1,contains 12.5 acres, and is
zoned CO, Commercial Office and EC, Entrance Corridor Overlay District The proposal is the location of Christian Aid
Mission on Ivy Road(Route 250)approximately 0.78 miles west of the intersection of Ivy Road and Farmington Drive,
in the Jack Jouett Magisterial District. The Comprehensive Plan designates this property as Rural Areas in Rural Area

ZMA 2004-00004 Avon Park: Request to rezone 8.5 acres from R1, Residential to NMD, Neighborhood Model District
to allow 91 dwelling units(15 single family detached 16 duplex and 60 townhouse). The property, described as Tax
Map 90, Parcel 35J and 35K and Tax Map 91, Parcel 14 is located in the Scottsville Magisterial District on Avon Street
Ext. (Route 742)approximately one-half mile south of the intersection of Avon Street Ext. and Mill Creek Drive on the
east side of the street. The Comprehensive Plan designates this property as Urban Density, recommended for 6-34
dwelling units per acre, in Neighborhood Four. (Margaret Doherty)
ZMA 2004-00005 Monticello Historic District Planned District-Monticello Historic District(PD-MHD)-Request to
rezone approximately 868 acres from RA (Rural Areas)to PD-MHD Planned District-Monticello Historic District
(reference ZTA 04-03),to allow uses specifically related to the operation of Monticello as a historic house museum and
historic site, including visitor facilities, educational, research, and administrative facilities, agricultural uses, and certain
residential uses. The properties proposed for rezoning are within the Scottsville Magisterial District in the vicinity of
Monticello, south of Interstate 64 and east of Route 53, and are identified more particularly as follows:Tax Map 78,
Parcels 22(Monticello), 23, 25, 28A, 28B, 29; and Tax Map 79, Parcel 7A. The Comprehensive Plan designates these
properties as Rural Area 4. The density for new residential development authorized in the PD-MHD district would be in
accordance with the regulations of the RA Rural Areas Zoning District,which is currently one dwelling unit per twenty-
one acres, plus one dwelling unit per two acres for each development right. (Joan McDowell)
ZMA 2004-00007 Belvedere : Request to rezone approximately 243.722 acres from R-4, Residential to NMD,
Neighborhood Model District, to allow up to 661 dwelling units,with an overall density of 4.4 dwelling units per acre,
ranging from a density of 1.4 dwelling units per acre in some areas to 9.5 dwelling units in others. The property,
described as Tax Map 61 Parcels 154, 157, 158, and 160, Tax Map 62 Parcels 2B and 2C, and Tax Map 62A3 Parcel
1, is located in the Rio Magisterial District on the east side of Rio Road(Route 631) immediately east of the Southern
Railroad. The Comprehensive Plan designates this property as Neighborhood Density in the northern portion of the
property(3 to 6 dwelling units per acre), Urban Density in the middle and southern portions(6 to 34 dwelling units per
acre), and Community Service adjacent to the railroad, in Neighborhood Two.(Susan Thomas)
ZMA 2004-00008 Clifton Lake Amendment: Request to amend the conditions of the PRD(Planned Residential
Development)zoning of 62 acres, to remove requirements for a road over a dam established in the initial PRD
rezoning. The property, described as Tax Map 79 Parcel 23 and Tax Map 79C Parcel 1 is located in the Scottsville
Magisterial District on Shadwell Estates Road approximately 0.12 miles from its intersection with US 250. The
Comprehensive Plan designates this property as Rural Area. (Scott Clark)
(LTA 2004-00003 Monticello Historic District: Planned District-Monticello Historic District(PD-MHD)-Amend
Section 4.15.8, Sign Regulations applicable in the RA, VR, R-1 and R-2 Zoning Districts; Amend Section 7,
Establishment of Districts,Amend Section 8.1, and add Section 11 of Chapter 18, Zoning, of the Albemarle County
Code, by adding Planned District-Monticello Historic District as a zoning district within Albemarle County, to state the
intent of the zoning district, to establish the permitted uses and associated regulations applicable within the zoning
district. The proposed district would allow uses specifically related to the operation of Monticello as a historic house
museum and historic site, including visitor facilities, educational, research, and administrative facilities, agricultural
uses, and certain residential uses. The density for new residential development authorized in the PD-MHD district
would be in accordance with the regulations of the RA Rural Areas Zoning District, which is currently one dwelling unit
