Fire Official approval of the placement of the required fire hydrant when the new water line across Free Bridge is installed. The hydrant shall be within 400 feet of the struc- ture with 1,000 gpm at 20psi; 2. Landscape plan to be approved by staff; recommend several 6' to 8' white pines or other evergreens on east and west sides of the parking lot and a planting area with azaleas and red maple. MIDDLE BRANCH FARM, PHASE TWO, FINAL PLAT Location: Between Routes 710 and 696 northwest of North Garden. Acreage: 138+ acres Zoning: A-1, Agricultural Proposal: Seven lot subdivision, lots ranging from 5+ to 59+ acres. History: The preliminary plat was approved by the Planning Commission on June 20, 1978, with six conditions. Staff Comments: Although the arrangement of the seven lots has changed from the preliminary plat, Staff recommends approval, subject to the following conditions: Recommended Conditions of Approval: 1. Grading permit for private road. Adequacy of proposed bridge to be checked under grading permit (detail of bridge on preliminary plat) ; 2. Virginia Department of Highways and Transportation approval of commerical entrance; 3. Health Department approval; 4. Compliance with private road requirements including road constructed to appropriate stan- dard and maintenance agreement; 5. Appropriate approvals for access to lot 2. 1 CLARK'S STORE SITE PLAN • Location: On the north side of Route 6, near Schuyler. Acreage: 1.30 acres Zoning: A-1, Agricultural History: June 13, 1978: VA-78-30 - The applicant was granted a variance from Section 18-3-1 for reconstruction of the general store which was destroyed by fire. The variance granted was for 130 feet from the scenic highway, Route 6, with conditions. July 11, 1978: VA-78-38 - The applicant was granted relief from Section 16-35 to allow the store to be reconstructed to its original floor area. July 11, 1978: SP-78-33 - The Planning Commission approved this request with seven conditions. July 12, 1978: SP-78-33 - The Board of Supervisors approved the request subject to the same seven conditions. Staff Comments: Should the Planning Commission choose to approve the application, staff re- commends the following conditions: • SORT - Planning Commission Meeting October 24, 1978 ARK'S STORE SITE PLAN (CONT. ) Recommended Conditions of Approval: 1. Compliance with conditions imposed by the Board of Zoning Appeals (VA-78-30) and Board of Supervisors (SP-78-33) ; 2. Landscape plan to be approved by staff; recommend white pines along frontage west of the entrance; shrubs and trees along side of building; and planting island in front of gas pumps (low shrubs, not to interfere with subdivision. ) ; 3. Highway Department and County Engineering Department approval of curbing to restrict access; 4. Parking in front of gas pumps to be moved to the south, (leaving a 12 foot aisle between gas ' pumps and parking) and have access to these spaces to allow for 24 foot aisle (paved area may have to be extended) ; 5. Note loading zone as "temporary" and put handicap spaces there. WOODBROOK SHOPPING VILLAGE SITE PLAN AMENDMENT Location: At the southeast corner of Route 29 North and Woodbrook Drive. Acreage: 3.2 + acres Zoning: B-1, Business History: The original site plan was approved by the Planning Commission in December, 1972. Proposal: The applicant proposes to amend his plan by moving 12 parking spaces from the side of the buildings to the edge of the property. Staff Comments: Staff recommends approval of this request subject to the following conditions Recommended Conditions of Approval: 1. None of the existing trees along the eastern border of the property shall be disturbed (Planning Commission approved condition June 27, 1978) . SUMMIT ROAD FINAL PLAT Location: West of Bennington Road and north of Westpark Drive. (State Route 1408) Proposal: Summit Road was proposed to connect with Georgetown Road to the west. On August 9, 1978, the Board of Supervisors abandoned the right-of-way of the road. The plat shows the division of the abandoned portion of the road, 20 feet to both lots lA and 19A. • • STAFF REPORT VA-78-30. Albert & Percy Clark fax Map: 126 Parcel: 33D Acreage: 1.300 Zoned: A-1 Existing Activity Country Store (non-conforming) destroyed by fire Proposed Variance Applicant requests a variance from section 18-3-1 for reconstruction of their country store, allowing for a 130 foot variance from the scenic highway, Route 6. Zoning Ordinance Requirements Section 10-7-1 states if a nonconforming structure or a structure the use of which is nonconforming shall be destroyed or damaged in any manner to the extent that the cost of restoration to its condition before such de- struction or damage shall exceed seventy-five percent (75%) of the total replacement or restoration cost of such structure, the same may be repaired and/or reconstructed only if such structure and the use thereof shall conform to the provisions of this ordinance relating to the district in which such structure is situated. Section 18-3-1 states no structure, except as hereinafter provided in the case of certain signs, shall be constructed within one hundred fifty (150) feet of the right-of-way of any designated scenic highway or Virginia byway having a right-of-way width of fifty (50) feet or more, nor within one hundred seventy-five (175) feet of the right-of-way of any such highway or byway having a right-of-way width of less than fifty (50) feet. Staff Recommendation The right-of-way of this lot, according to the Highway Department, is either 50 or 60 feet. A highway spokesman has stated the property line properly establishes the right-of-way. The applicant has submitted a petition of names of the area in support of this variance. The store was destroyed by fire. The staff recommends approval with the following conditions: • 1) lif; :;».c : Department revi.ew 'and recommendation of the off the road entrance prior to site plan review. 2) Landscape plan submitted in conjunction with site plan submittal . 3) The setback not exceed any greater than the present foundation and that the applicant provide the Zoning office for this file the exact determination of the right-of-way. 4) All parking to the store be limited to the side of the building and within the lot rather than to the immediate front of the building for highway safety in ingress and egress. (Note: The A-1 zone is not regulated by a 50 foot setback requirement as are B-1 zone business. Since this is a business, staff feels for both highway safety and the scenic highway purpose, the above condition should be approved.' STAFF REPORT VA-78-38. Zoning Ordinance Requirements General Store , Country: A single store , the ground floor area of which is four thousand (4 ,000) square feet or less and which offers for sale primarily, most of the following articles : candy, papers and magazines , and general hardware articles . With specific approval through the special use permit process , gasoline may also be offered for sale , but only as a secondary activity of a country general store and no more than three (3) gasoline pumps shall be permitted. /Z �y /iv Staff Recommendation The new definition of country store restricts square footage to 4,000 square feet . The original store was -8" square feet . Applicant seeks to restore the store to its original square footage .
