The permitted uses of the Property are provided in Section 24 of Chapter 18 of the Albemarle County Code ("Zoning Ordinance"), linked below. The Property is subject to the Entrance Corridor and Steep Slopes Overlay Districts described in Section 30 of the Zoning Ordinance. • Adjacent zoning designations are as follows: North: Richmond Road right-of-way, South: HC, West: HC, East: NMD. Adjacent zoning designations can be viewed on the Zoning Map linked below. • The Property is subject to three Special Use Permits: SP200200014 & SP200200042, approved November 19, 2002, for a garden center and contractor storage, and SP200500025, approved January 11, 2006, for outdoor storage and display of vehicles. • There are no additional special or conditional use permits, variances, zoning map amendments or proffers associated with the Property. • The Property is subject to multiple site development plans, most recently SDP200600032, approved May 31, 2006. It appears that the Property was developed in accord with the plan. • To the best of my knowledge, the Property is currently in compliance with all applicable requirements of the Zoning Ordinance. A review of our files found (i) no zoning or building violations applicable to the Property, whether pending, contemplated, or having already occurred, (ii) no fees due or pending with respect to any matter before the County Zoning Office and (iii) no pending application for rezoning of the Property or for a special or conditional use permit or variance in connection with the Property. Further, no proceedings to challenge the zoning or other governmental approval or use of the Property is pending or overtly threatened to the best of my knowledge. In the event of casualty, whole or in part, the Property may be rebuilt substantially in its current form upon satisfaction of all required building permits and site plans, as applicable.
