The permitted uses of the Property are provided in Section 10 of Chapter 18 of the Albemarle County Code ("Zoning Ordinance"), linked below. The current uses of the Property are consistent with those permitted by RA zoning. The Property is subject to the Steep Slopes and Entrance Corridor Overlay Districts described in Section 30 of the Zoning Ordinance. • The Property is subject to multiple site development plans, the most recent of which is SDP199200018, approved April 9, 1992. This plan has been amended several times, most recently with SDP200600019, approved June 6, 2006. • The Property is subject to multiple special use permits: SP197200228, approved February 28, 1973, and SP197600028, approved May 5, 1976, to allow gift, craft, and antique shops, SP199900029, approved August 11, 1999, to amend the conditions of previous approvals, and SP199800042, approved October 21, 1998, to allow off -site parking. Each special use permit approval is subject to conditions. • There is no rezoning, proffered condition, or variance associated with the Property. • To the best of my knowledge, the Property is currently in compliance with all applicable requirements of the Zoning Ordinance. A review of our files found (i) no zoning or building violations applicable to the Property, whether pending, contemplated, or having already occurred, (ii) no fees due or pending with respect to any matter before the County Zoning Office and (iii) no pending application for rezoning of the Property or for a special or conditional use permit or variance in connection with the Property. Further, no proceedings to challenge the zoning or other governmental approval or use of the Property is pending or overtly threatened to the best of my knowledge. • This office is not aware of any proceedings, pending or threatened, to revoke, rescind, alter, or declare invalid any laws, ordinances, codes, approvals, permits or certificates applicable to or issued in connection with the Property.
