Staff has reviewed your revised submittal for the zoning map amendment, ZMA202000012 Montclair Zoning Map
Amendment (ZMA). We have a few remaining comments which we believe should be addressed before we can recommend
favorably on your ZMA request. We would be glad to meet with you to discuss these issues. Our comments are provided
below:
General Comments:
1. Please revise the narrative so that the section on impacts to public schools identifies Crozet Elementary School as
the elementary school that would serve this development.
Code of Development:
1. See attached comments from Stacy Pethia regarding affordable housing. On page 11 of the COD, please revise the
language as requested.
2. See comment #1a in the "Application Plan" section below. If necessary, Table D will need to be revised so that
additional greenspace is provided to mee the minimum 20%. Table C will need to be revised so that it states an
accurate acreage and unit figures in Block 2.
Application Plan:
1. Since the ZMA has been revised to only include rezoning a portion of TMP 56E-2, please provide further
information on how the applicant determined the acreage of that parcel that would be rezoned. Has the applicant
conducted a metes & bounds survey of the proposed zoning district line to verify that the 2.8 acres can
accommodate the improvements and other features that would be built within that portion of the NMD?
a. Tables C and D of the COD identify Block 2 as 2.7 acres, but the Application Plan states that 2.8 acres of
TMP 56E-2 is being rezoned. Please verify and revise either the COD or the Application Plan as necessary
so a consistent acreage figure is stated. Please revise the acreage label for Block 2 on Sheet 1(if
necessary).
2. The application should provide the proposed shared use path along the entire frontage of TMP 56E-2 along Route
240 as shown on previous iterations of the Application Plan.
3. Please see attached Engineering Division comments. Please revise the plan to show the intermittent stream and
WPO buffer through Block 2 and north of Block 2.
4. Since Public Road C crosses the stream mentioned in the previous comment, mitigation measures will be needed.
The applicant should consult with the Engineering Division regarding the specific mitigation techniques that need
to be shown on the ZMA.
5. Please see attached Fire Rescue comments. Fire Rescue staff have asked that several notes be added to the plan
(comments #2-4).

For -Sale Affordable Dwelling Units
• Replace sentence, 'All purchasers of the affordable units shall be approved by the Albemarle County Community
Development Department or its designee ("Community Development")', with
'All purchasers of the affordable units shall be approved by the Albemarle County Office of Housing'.
• The current maximum affordable sales price for Albemarle County 65% of Virginia Housing's maximum sales
price/loan limit for their first-time homebuyer program loans.
For -Rent Affordable Dwelling Units
• RENTAL RATES: housing affordability is based on GROSS rent. Maximum rents for affordable units must include an
allowance for tenant provided utilities. Suggest the changing the first sentence to:
The gross rent (unit rent plus tenant provided utilities) for each rental housing unit which shall qualify as an Affordable Dwelling
Unit (" For -Rent Affordable Dwelling Unit") shall not exceed HUD' s affordability standard of thirty percent ( 30%) of the income
of a household making eighty percent ( 80%) of the area median income ( as determined by HUD from time to time).'
• Delete the third sentence in the paragraph.
• In last sentence, replace 'VHDA' with 'Virginia Housing'.

Please note in the narrative the potential impact on public safety of the development
Though not necessary to address at this stage of submission, to help in planning future steps for this project, here are some
points of concern for ACFR at future review steps of projects, especially at the site plan phase (Please acknowledge
understanding of the potential need to meet these requirements):
1) The concept plan illustrates roads that fall below the requirements to be considered a fire apparatus access road. Not all
roads are necessary to fullol the fire apparatus access road requirements for all buildings, but any road that is necessary to
fullfil the fire apparatus access road requirements must meet the following criteria:
a) To accommodate emergency/fire vehicle access, emergency vehicle access roads)/route(s) are required and arranged
SO that they provide access to within 150 feet (45 720 mm) of all portions of the facility and/or all portions of the
exterior wells of the first story of the buildings as measured by an approved route around the exterior of the buildings or
facility from the road.
b) An emergency/fire vehicle access mad/route needs to provide an unobstructed travel way width of 20 fL if
buildings/stmcthres are under 30 feet tall and 26 ft. if buildings/structures are over 30 feet tall. No Parking- Fire Lane
or markings are required as appropropuate to prevent parked vehicles from encroaching the required travel way
width.
c) An emergency/fire vehicle access mad/route needs to provide a suitable surface to sustain the weight of emergency
apparatus weighing up to 75,0001bs. in all weather conditions.
d) Emergency/fire vehicle access roads need to be clear of overhead obstructions at 13 It 6 in. and below
e) To accommodate fire apparatus, turn radii serving fire apparatus access roads generally require a minimum of 25 ft.
based on the largest piece of fire apparatus expected to respond.
f) To ensure that parking does not obstruct the emergency apparatus fravel way as described above, any parking must be
designed to and/or No Parking - Fire Lane signs or markings are required to maintain the required unobstructed travel
MY widths.
g) Any dead-end longer than 150 ft requires an approved turn around for emergency apparatus.
h) It is desired the road grade does not exceed 10 W
2) Provide a note on the plans of the required ISO fire calculation for the buildings_
3) Indicate on the plan the latest ACSW flow test to ensure adequate fire flow per calculation in comment # 2.
4) Provide the locations of fire hydrants as determined by calculations in # 2, with spacing in accordance with the required fire
lbw calculation (This starts at 500 feet and arranged so that no building is more than 250 feet from a hydrant, but the distances
am further reduced as the required fire flow increases).
5) In areas without buildings, then hydrant spacing is required every 1000 ft to accommodate transportation emergencies.
6) If not within the ACSW service area, provide a note identifying location of closest water source suitable for emergency/fire
apparatus operations
7) Fire suppression, fire alerting systems and other building design features, such as exits, interior finishes, building access
etc., are the purview of the building official and required as directed by Mat office_
8) If fire suppression systems or standpipes are installed the FDC must face the road, on address side and Mere needs to be
hydrant within 100 ft. of the FDC, arranged so that when hydrant and FDC are in use for emergency operations, hose does
not obstruct travel way. The threads for the appliances (FDC, etc) must conform to C & O standard.
9) During construction, the following fire prevention steps am required, so please note them on the plan:
a) Smoking shall be prohibited in areas where smoking makes conditions such as to make smoking a hazard and these
areas shall be designated with no smoking signs per Virginia Statewide Fire Prevention Code.

and demolition sites, provide access to within 100 ft. of temporary or permanent fire department connections, and
have no overhead wiring or other overhead obstructions lower than 13 ft. 6 inches; this access may be via
permanent or temporary road, but shall be capable of supporting fire apparatus in all weather conditions-
d) Contractor shall ensure the street numbers are always plainly visible from the frontage street during construction per
the Virginia Statewide Fire Code.
e) An approved water supply for firefighting operations shall be in piece and available as soon as combustible materials
arrive on site
f) Waste and combustible debris shall be removed from the building at the end of each day and disposed of in
accordance with the Virginia Statewide Fire Code.
g) Fire extinguishers shall be provided, with not less than one approved fire extinguisher at each stairwell, on all floor
levels where combustible materials have accumulated, in every storage and construction shed and in areas of special,
hazards, such as where flammable and combustible liquids are stored or used, in accordance with the Virginia
Statewide Fire Code.
h) Operations involving the use of cuting and welling shall comply with the Virginia Statewide Fire Prevention Code and
shall require a permit from the Albemarle County Pine Marshal's Office.

Section has reviewed the White Gate Village ZMA, dated December 19, 2022 as submitted by
Shimp Engineering, and find them generally acceptable:

pressures are greater than 80 psi.

Most applications for a Zoning Map Amendment require at least one public hearing by the Planning Commission and one public
hearing by the Board of Supervisors. Virginia State Code requires that notice for public hearings be made by publishing a legal
advertisement in the newspaper and by mailing letters to adjacent property owners. Therefore, at least two fees for public notice
are required before a Zoning Map Amendment may be heard by the Board of Supervisors. The total fee for public notice will be
provided to the applicant after the final cost is determined and must be paid before the application is heard by a public body.
