Subject: SDP2022-00047 — Victorian Heights — Final Site Plan; 31 Submittal
The Planner for the Planning Services Division of the Albemarle County Department of Community
Development will recommend approval of the plan referred to above when the following items have been
satisfactorily addressed. (The following comments are those that have been identified at this time.
Additional comments or conditions may be added or eliminated based on further review.)
Comments — First Review of Victorian Heights — Final Site Plan (SDP2022-00047):
1. [30.2.61 This development will require review by the Planning Commission to determine
anticipated impacts of the cluster development and bonus density provisions and regulations on
the Airport Impact Area overlay district. Provide a narrative justifying why this proposed
development will not have a negative impact on the AIA requirements. Staff has no concerns
with this request. Staff will work with the applicant to schedule this item for consideration
by the Planning Commission. This item has been tentatively scheduled as an Action Item for
the Planning Commission's meeting on Tuesday, April 25".
2. [4.191 The setback note will need to be updated if the Board of Supervisors approves the special
exception request for modifying the setback regulations. Response noted. See also comment
below under SE2022-00043. The special exception to modify the setback requirements was
approved by the Board on March 15". (See the attached resolution.)
Provide the revised setback requirements on the cover sheet of the site plan.
Add a note on the cover sheet of the site plan, under the zoning note, stating that this plan is
subject to SE2022-00043, approved March 15, 2023.
Include a copy of the approved SE resolution on the site plan.
3. [4.161 Provide a substitution waiver request for the recreational facilities, as there is a note on the
cover sheet indicating one would be provided. However, one was not submitted with this
application. Staff cannot fully analyze the recreational facilities without knowing what is
proposed to be provided. The facilities as currently proposed do not meet the requirements.
Revise the request for substitution of recreational facilities. The area required for rec
facilities is not to exceed 5% of the gross site area, which is 10,718 square feet (or
approximately 0.246 acres). See 184.16.1 pasted below. Although you are permitted to go
above 5% of the gross site area with the square footage of the recreational facility areas,
you are not required to do so. Please let staff know whether you would like to revise the
recreational facilities substitution request or not, and staff reviewers will move forward in
the review accordingly.

4. [32.7.91 Landscaping Plan
a. An easement will be required for any landscaping located on private lots. An
easement plat must still be submitted for review and approval prior to
approval of the final site plan. (See comment below also.)
5. [32.5.20), 32.5.2(k)] An easement plat will be required. This easement plat must be recorded
prior to approval of the site plan. Provide a separate easement plat. This comment is still
outstanding. An easement plat must be submitted and approved prior to approval of the
final site plan.
SE2022-00043 — Victorian Heiebts — Special Exception:
1. This application has been scheduled for consideration by the Board of Supervisors. The special
exception request SE2022-00043 was approved by the Board of Supervisors on Wednesday,
March 15, 2023. See the attached resolution from the clerk.

RESOLUTION TO APPROVE
SE202200043 VICTORIAN HEIGHTS
BE IT RESOLVED that, upon consideration of the staff reports prepared in conjunction with the
SE202200043 Victorian Heights application and the attachments thereto, including staffs supporting
analysis, all of the comments received, and all of the factors relevant to the special exceptions in Albemarle
County Code §§ 18-4.19(4), 18-4.19(5), and 18-33.9, the Albemarle County Board of Supervisors hereby
finds that the proposed special exceptions are consistent with the intent of the R-15,Residential zoning
district and the Neighborhood Model Principles of the Comprehensive Plan.
WHEREUPON, the Albemarle County Board of Supervisors hereby approves SE202200043
Victorian Heights and (a) grants a modification of Albemarle County Code § 18-4.19(4) from the maximum
front setback for residential buildings from 25 feet to 38 feet for one building, to 54 feet for a second
building, and to 71 feet for the third building, all as depicted in the application; and (b) waives the
requirement in Albemarle County Code § 18-4.19(5) of a minimum 15-foot stepback, to allow a fourth story
to be constructed without a stepback.

The Victorian Heights Final Site Plan has been reviewed by engineering. The following comments will
need to be addressed before approval:
1. Easement plat must be recorded before final site plan can be approved. Rev. 1: Comment
not addressed. Rev. 2: Comment not addressed.
2. The plan does not match the approved WPO. WPO amendment must be submitted and
approved before final site plan can be approved. Rev. 1: Comment not addressed.
WPO was submitted but is not approved yet. Please note that the WPO and the site
plan should match. Differences were noted in the grading and storm along
Woodburn Rd. Rev. 2: Comment addressed.
3. Ensure the maximum proposed slope is 2:1. Please add a note showing the maximum 2:1
slope. Rev. 1: Per County Code 18-4.3.3-C-1, it appears the area between buildings 1
and 2 and Berkmar Dr. requires a reverse slope bench because it is a 2:1 slope over
20 ft. This should be adjusted on the WPO as well. See below:

4. Engineered signed and sealed retaining wall plans will be necessary before final site plan
approval. Rev. 1: Comment not addressed. Rev. 2: Please provide a copy of the signed
and sealed retaining wall plans.
5. Sheet 5 appears to show public drainage easements that are not shown on Sheet 3A.Rev.

Dear Mr. Collins:
We have reviewed the plans entitled "Victorian Heights - Final Site Plan," dated
January 9, 2023. The following comments need to be addressed.
General
1. Provide update water/sewer data sheets based on ACSA comments.
2. ACSA is not included as a second grantee in the offsite sewer deed of easement.
An updated deed listing ACSA as second grantee will be required. A sample
deed will be provided for reference.
3. RWSA approval will be required prior to final approval.
Sheet 3A
1. Additional sewer easement will be required based on the table below from ACSA
Construction Specifications.
F. EASEMENTS
Easements shall be required for all water, sewer lines, and appur-
tenances except where installed within a public right-of-way of the Virginia
Department of Transportation (VDOT). If the utility is placed within the outer ten
(10) feet of VDOT right-of-way, additional ACSA easements shall be provided to
allow a minimum of ten (10) feet from the center of any utility. Such easements
shall not be less than twenty (20) feet in width centered on the water main.
Combined sewer and water easements shall not be less than thirty (30) feet in
width with both mains ten (10) feet from the edges of the easement. Easements
for sanitary sewer mains shall adhere to the table below:

1. Lot 32 has two sewer laterals. Delete one of these.
2. Water main can be reduced to 6-inch after FHA near Lot 19.
3. Locate the tee going to the hydrant, near Lot 28, to the other side of the drive isle
to shorten the hydrant line crossing the road.
4. Building 2 requires a 1.5-inch meter.
5. Update Building 3 meter to show a meter box and 1-inch setter. Remove gate
valve and 4-inch tee. Callout a 1-inch corp stop.
6. Relocate fire hydrant in-between the future road connection and gate valve, near
Lot 1. This will eliminate the need for additional easement in the proposed
location.

1. Sewer segment S11_S10 should be DIP.
