Dear Mr. Reitelbach,
Please see SOA's bulleted responses to the March 24, 2023, SUB-2022-00043-Rivanna Solar - FSP Review #3.
1. [SP2019-00010] The final site plan must demonstrate conformance with all of the conditions approved by the Board of
Supervisors with the special use permit request SP2019-00010. See the attached Action Letter and Resolution. Comment
still applies. The following items do not appear to demonstrate conformance at this time.
a. The area of solar panel development between parcels 93-46B and 93-46A extends closer to Buck Island Road than is
shown on the concept plan. Revise the site plan to match the envelope area shown on the concept plan. Provide the email
from Bill Fritz and Francis MacCall for review and so it can be added to the file for this application. No emails from Mr.
Fritz or Mr. MacCall were provided. The email that was provided has no correspondence from either one of them.
Please see the July 29, 2021, email that Adapture Renewables received from Bill Fritz and Francis MacCall. The
email provides an explanation of the differences seen in the solar envelope due to property boundaries that
changed when taken from a GIS format to property boundary survey by a VA PLS. Neither Mr. Fritz or Mr.
MacCall had any comments related to the change. Additionally, it is still in compliance with all County setback
ordinances. Attached is the Updated Solar Envelope that was presented to Bill & Francis.
2. [General Comment] The final site plan must demonstrate conformance with all requirements of Section 18-32.6 of the
Zoning Ordinance. The checklist for the initial site plan requirements is helpful as a good place to start. That checklist can
be found at the following link: https://www.albemarle.org/home/showpublisheddocument/1014/637540811404730000.
Comment still applies.
• A completed checklist has been included on sheet C-003. The checklist includes notes from the FOR where items
can be found in the set with sheet numbers, are not applicable, or needed additional clarification.
3. [32.5.2(a)] On the cover sheet of the plan, provide the setback lines for the appropriate zoning district. Comment
partially addressed. There is a setback schedule in the top right comer of Sheet C-200 that differs from the RA setbacks.
Where is this schedule coming from? In addition, setbacks for the inverters is not depicted. Where is the "SUP 100' + 501"
Setback note coming from? What is this setback for? The rear setback is 35'. The listed rear setback of 25' on sheet C-200 is
incorrect. Ensure the setback schedule on sheet C-200 matches the setbacks identified on the cover sheet.

• The setback table on C-200 has been updated to state 35 foot for the rear setback. The site plan already conformed
to the 35' requirement. Dimensions were added to the site plans.
4. [32.5.2(b)] On the cover sheet of the plan, provide a schedule of parking on the site, including the amount of parking
required by the ordinance, and the amount of parking actually provided on the site. If no parking is proposed with this
project, provide a letter addressed to the Zoning Administrator with a request for no parking and the justification for this
request, including identifying where any maintenance vehicles or other employee cars would be parked on the site when
work is being done on the facility. Not addressed. Request for no parking still required to be submitted for review.
Comment addressed. Parking request approved by the Zoning Division. See response below from Francis MacCall,
Deputy Zoning Administrator:
"Zoning is fine with the applicanfs parking request. The area noted for'STAGING AND TEMPORARY PARKING
AREA; as well as the areas around the facility for maintenance vehicles to move around to maintain various equipment,
should be sufficient for the limited amount of vehicular access that will happen at the site."

5. [32.5.2(i)] On the site plan, provide any existing or proposed access easement, rights -of -way, and travelways. Comment
still applies. Access easements for stormwater management facilities will be required to be shown on the site plan once
the easement plat has been approved and recorded.
• Please see the attached easement submittal documents with receipts for submittal provided by Adapture
Renewables. The access easement includes the entire fenced area and was approved by Frank Pohl and Matthew
Wentland.
6. [32.5.2(i)] On the site plan, provide the centerline radii and pavement widths for any proposed travelways. Comment
still applies. No width is provided.
• Dimensioning throughout the site plan sheets has been updated to show road width and centerline radii, see
sheets C-201 to C-206.
7. [32.5.20); 32.5.2 (k)] Label all existing and proposed water, sewer, and storm drainage easements by type and include a
size/width measurement. For existing easements, state the deed book and page of the recorded instrument. For proposed
easements, an easement plat will need to be submitted, reviewed, approved, and recorded at the courthouse prior to
approval of the final site plan being granted. Comment still applies. Stormwater management easements will likely be
required by the Engineering division. Stormwater management easements must be approved and recorded prior to final
site plan approval.
• Please see the attached easement submittal documents with receipts for submittal provided by Adapture
Renewables. The access easement includes the entire fenced area and was approved by Frank Pohl and Matthew
Wentland.
8. [32.5.2(n)] Provide the locations and dimensions of all existing and proposed improvements on the site, including the
following:
a. Trash containers. Are these going to be permanent or just during construction?
• All trash containers shown on the site plans are temporary for construction use. The callouts for the trash
containers have been updated to include the word "temporary," see sheets C-201 to C-206.
b. Landscaped areas and open space. A landscaping plan has not been provided.

The line of mixed shrubs planted among the existing trees right along Thomas Jefferson Parkway that are depicted on the
concept plan are not provided on the site plans landscaping plan. These shrubs must be included as well. These shrubs
are not included on the plat. In the concept plan, they are identified as MC and IG, depicted right along the right-of-way.
These shrubs are not shown on Sheet L-101 of the site plan., and the landscaping schedule on this sheet says that the
count for both MC and IG is "0". Provide the required shrubs.
• The line of shrubs has been added to sheet L-101 of the site plan and the landscaping schedule has been updated.
However, due to VDOT entrance sight line requirements the line of shrubs does not extend as far as it does in the
concept plan.
Regarding the email dated October 24th from Bryson Meier - although the full extent of landscaping depicted on the
landscaping plan along Buck Island Road is not required, street trees and screening that comply with sections 32.7.9.5 and
32.7.9.7 of the zoning ordinance are still required and must be depicted on the landscaping plan and included in the
landscaping schedule

.7MISTIM-S32.7.9.5LAALST). The street tree landscaping required by the ordinance must be depicted on the landscaping
plan. Referencing the ordinance sections is not sufficient. None of this landscaping appears to be shown on the plans.
• We reached out to Andy Reitelbach to confirm this item because the remaining areas between the proposed
landscaping and roads already have established vegetation.
• Before planning, we would request that the County perform a site walk with project stakeholders to ensure
compliance.
9. [32.5.2(o)] Identify all areas, if any, proposed to be dedicated to public use, and identify the entity (VDOT, the County,
etc.) to which those areas will be dedicated. Areas of dedication will require a plat and/or deed. It is likely that
stormwater management and drainage easements will be required by the Engineering division. Once those easements are
identified, they will need to be depicted on the site plan. Comment still applies.
• The SWM Forest and Open Space dedication has be filed by Adapture Renewables. Please see the attached
checklist, easement, and submittal receipts.
10. [32.5.2(p)] Provide a landscaping plan that complies with Section 18-32.7.9 of the Zoning Ordinance, including the tree
conservation checklist if proposed, as well as any relevant conditions of the approved special use permit. Comment not
addressed. A landscaping plan has not been provided. The completed tree conservation checklist has not been included
with the landscape plan. Comment still applies. The conservation checklist has not been signed. It must be signed by an
appropriate signatory.
• See updated L-001. The checklist has been signed by Adapture Renewables.
11. [32.5.2(q)] Provide the estimated traffic generation figures for this facility. Comment not addressed. This information
needs to be provided on the site plan. (Most applicants put this information on the cover sheet.)
• Total traffic generation and supporting language has been added to the Cover Sheet on sheet C-001.
12. [32.5.2(r)] Provide a legend showing all symbols and abbreviations used on the plan. Comment still applies
throughout review process.
• The master legend on C-003 has been reviewed and updated.
13. [Advisory Comment] Additional comments may be provided during the review of the next submittal depending on
any revisions made and depending on any comments from other departments or agencies.

I have no comments. The important thing to do to get this project done is to submit the site
plan so that official comments can be prepared. Please remember that it is a two step process,
initial and final. This provides an opportunity to address any issues that come up or even for

Hello, Francis and Bill.
I hope you are doing well. As you may know, we had a meeting with Frank Pohl and Scott Clark
regarding the wetland delineation on the Rivanna Solar's Site. Overall, we are finalizing a Project Site
Plan to submit for Site Plan Approval, and we would like to present the updates on the draft Plan
comparing to the Conceptual Plan for the SUP.
Attached you will find the updated Rivanna Solar Site Plan. Here is a list of items that have changed
following:
1. Updated property lines based on ALTA Survey
1. Property lines are now accurate compared to the Conceptual Plan for the SUP, which
used GIS data.
2. Offsets from the Property lines are the same as the SUP. 50 ft 75 off route 729, 100ft off
route 53.
3. Fence locations at these offsets are the same as the SUP.
4. Vegetation buffers have been adjusted to match the updated Property lines from the
accurate ALTA survey.
2. Updated topography lines
1. The topography survey has been conducted and is more accurate than GIS topography on
the Conceptual Plan.
2. Critical Slopes (25%+) have been documented. Locations have slightly changed in the
southeast area.
- Some new areas are now showing in the southwest corner and the wetland buffer
area.
3. Small Critical Slope Islands that were in the SUP layout now do not exist due to the more
accurate Topo analysis.
3. The project fence is now encompassing the whole project site. The Original SUP had the project
broken up into three different sections.
1. Dominion's Transmission line easement will now not be fenced in.
- This has been discussed with Dominion. They have given a verbal blessing.
2. The fence will cross the Transmission line at close to 90-deg (2 locations).
3. The fence will Cross wetland Buffer and wetlands.
4. Wetlands & Stream have been documented more accurately, and a site visit has been
conducted.
1. Wetland & Stream are in more areas than in the SUP layout. There are now three
additional "Fingers" shapes that were documented in the Water Protection Ordinance.
2. 100ft buffer has been placed around the Wetlands and Stream.
In the attached Rivanna Updated Solar Site Plan, we have tried to keep the same parameters in the
SUP. The listed Items were updated due to a proper ALTA survey, Topography survey, and a wetland/
steam location site visit. The updated Rivanna Solar Envelope is decreased in size by a fair amount, but
we are confident that we can still create the same size project and produce the same production
results.
If there are any questions, comments, or concerns, please let us know. We would like to make sure
that the Zoning Department considers these updates in general accord with the SUP. Also, it would be
better to set up a call to walk through the updates with our engineering and design team; please let me
know when the best time for the call would be.

Sec. 14-300 Persons authorized to prepare plat.
Each plat shall be prepared by a professional engineer or a land surveyor, to the limits of his license.
Sec. 14-301 Form and style of plats.
Each subdivision plat shall comply with the following:
A. Standards. Except as otherwise provided in subsection (E), each plat shall meet the standards for plats set
forth in 17 VAC 15-60-10 et seq.; provided that each final plat to be submitted for recordation
in the office of the clerk of the Albemarle County circuit court shall meet the standards for plats
set forth in 17 VAC 15-60-10 et seq.
B. Scale. The plat shall be drawn to a scale of one (1) inch equals fifty (50) feet or to such scale as may be
approved by the agent in a particular case.
C. Size. The plat shall be prepared on one (1) or more sheets, provided that no sheet shall exceed twenty-four
(24) inches by thirty-six (36) inches in size, and further provided that if the plat is prepared on
more than one (1) sheet, match lines shall clearly indicate where the several sheets join.
D. Approximate North. The top of each sheet shall be approximately north.
Sec. 14-302 (A) Contents of preliminary plat. Please see section 14-303
A preliminary plat shall contain the following information:
A. A preliminary plat shall contain the following information, which must be included in
order for a preliminary plat to be deemed complete under section 14-218:
❑ 1. Name of subdivision. The title under which the subdivision is proposed to be recorded. The title shall
not duplicate or be a homonym of an existing or reserved subdivision name within the county, the City of
Charlottesville, or the Town of Scottsville, except if the subdivision is an extension of an existing
subdivision.
❑ 2. Vicinity map. A map at a scale of one (1) inch equal to two thousand (2,000) feet showing the
property and its relationship with adjoining land and streets, its relationship with landmarks in the
area and, if the subdivision is a phased subdivision, all other phases of the subdivision for which a final plat
has been approved, in detail adequate to describe the location of the property without field review.
❑ 3. Existing or platted streets. The location, width and names of all existing or platted streets and all other
rights -of -way.
❑ 4. Private easements. The location and dimensions of all existing and proposed private easements.
Existing easements shall be labeled with the deed book and page number and the name of the owner of
record.
❑ 5. Public easements. The location and dimensions of all existing and proposed public easements outside

instrument whereby the property was created, as recorded in the office of the clerk of the circuit court of the
county.
❑ 14. Land to be dedicated in fee or reserved. The location, acreage, and current owner of all land
intended to be dedicated in fee or reserved for public use, or to be reserved in a deed for the common use of
lot owners in the subdivision.
❑ 15. Identification of all owners and certain interest holders. The names and addresses of each
owner of record and holders of any easements affecting the property.
Sec. 14-302 (B) Contents of preliminary plat.
B. A preliminary plat shall also contain the following information, provided that the preliminary plat
shall not be deemed incomplete for purposes of section 14-218 if it does not include this information in the
initial plat submittal:
❑ 1. General information. The date of drawing, including the date of the last revision, the number of
sheets, the north point, and the scale. If true north is used, the method of determination shall be shown.
❑ 2. Name of plat preparer. The name of the person who prepared the plat.
❑ 4. Places of burial. The location of any grave, object or structure marking a place of burial located on the
property.
❑ 5. Zoning classification. The zoning classification of the property, including all applicable zoning
overlay districts, proffers, special use permits and variances.
❑ 6. Tax map and parcel number. The county tax map and parcel number of the property.
❑ 7. Reservoir watershed; agricultural -forestal district. A notation as to whether the land is within an
Albemarle County and/or City of Charlottesville water supply watershed or an agricultural -forestal district.
❑ 9. Flood plain. The location of any part of the property within the flood hazard overlay district, as set forth
in section 18-30.3.
❑ 10. Stream buffers. The location of stream buffers required by the water protection ordinance, with the
following note: "The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle
County Water Protection Ordinance."
Sec. 14-303 Contents of final plat.
❑ In addition to containing all of the information required by section 14 -302, except for the information
required by section 14-302(A)(12), a final plat shall contain the following information:

0 A. Statement of consent to division. A statement that: "The platting or dedication of the following
described land [insert a correct description of the land subdivided] is with the free consent and in accordance
with the desire of the undersigned owners, proprietors and trustees, if any."
F B. Section name or number. The name or number of the section if the property is a part of a larger piece
of land.
0 C. Boundary lines. The exterior boundary lines of the property with bearings in degrees, minutes and
seconds. Curvilinear data shall include radius, central angle, arc length, and tangent distance. All dimensions
shall conform to the standards set forth in this chapter.
F A Acreage of lots. The total acreage of each existing lot and each proposed lot.
F E. Dimension standards and information on all lots, streets, alleys, easements, and shared driveways.
All linear, angular, and curvilinear dimensions of lots, streets, alleys, public easements and private
easements and shared driveways shall conform to the requirements set forth in 8 VAC 10-20-370(C), a
copy of which shall be on file in the department of community development. Curvilinear data shall include
radius, central angle, arc length, and tangent distances and may be shown either directly on the
corresponding boundary or surveyed line or in table form. Easements shown for private streets, alleys and
shared driveways shall be labeled as "private street easement', "alley easement' or "shared driveway
easement." The easement holder(s) shall be identified on the plat. If shared driveways are shown, a note
shall be added to the plat stating that maintenance shall be by the owners of the lots affected by the shared
driveway easement, not by the Virginia Department of Transportation or the county.
F F. Identification of sections, blocks and lots. Sections (phases) shall be identified by numbers; blocks
shall be identified by letters; lots shall be identified by numbers, assigned in numerical order.
0 H. Monuments. The location and material of all permanent reference monuments. Monuments found or
installed prior to plat recordation may be referred to if they are permanent and undisturbed. If any monument
required by this chapter will be installed after recordation of the final plat, the certification of the
professional engineer or land surveyor shall so note.
F L Bearing and distance ties. A definite bearing and distance tie between not less than two (2) permanent
monuments on the exterior boundary of the property and further tie to existing street intersection where
possible and reasonably convenient.
F L. Public utility, drainage and sight distance easements. The location and dimensions of each public
utility, drainage and sight distance easement outside of a street right-of-way; for each existing easement,
include a note stating the deed book and page number.
F O. Signature panels. Signature panels for each owner and for the agent or his designee. The signature
panel for the owner shall be located immediately below the statement required by paragraph (A).
F P. Notary panels. Notary panels for the notary to acknowledge the signature of the owner.

EASEMENT PLAT CHECKLIST
0 A. Statement of consent to division. A statement that: "The platting or dedication of the following
described land [insert a correct description of the land subdivided] is with the free consent and in accordance
with the desire of the undersigned owners, proprietors and trustees, if any."
F B. Section name or number. The name or number of the section if the property is a part of a larger piece
of land.
0 C. Boundary lines. The exterior boundary lines of the property with bearings in degrees, minutes and
seconds. Curvilinear data shall include radius, central angle, arc length, and tangent distance. All dimensions
shall conform to the standards set forth in this chapter.
F A Acreage of lots. The total acreage of each existing lot and each proposed lot.
F E. Dimension standards and information on all lots, streets, alleys, easements, and shared driveways.
All linear, angular, and curvilinear dimensions of lots, streets, alleys, public easements and private
easements and shared driveways shall conform to the requirements set forth in 8 VAC 10-20-370(C), a
copy of which shall be on file in the department of community development. Curvilinear data shall include
radius, central angle, arc length, and tangent distances and may be shown either directly on the
corresponding boundary or surveyed line or in table form. Easements shown for private streets, alleys and
shared driveways shall be labeled as "private street easement', "alley easement' or "shared driveway
easement." The easement holder(s) shall be identified on the plat. If shared driveways are shown, a note
shall be added to the plat stating that maintenance shall be by the owners of the lots affected by the shared
driveway easement, not by the Virginia Department of Transportation or the county.
F F. Identification of sections, blocks and lots. Sections (phases) shall be identified by numbers; blocks
shall be identified by letters; lots shall be identified by numbers, assigned in numerical order.
0 H. Monuments. The location and material of all permanent reference monuments. Monuments found or
installed prior to plat recordation may be referred to if they are permanent and undisturbed. If any monument
required by this chapter will be installed after recordation of the final plat, the certification of the
professional engineer or land surveyor shall so note.
F L Bearing and distance ties. A definite bearing and distance tie between not less than two (2) permanent
monuments on the exterior boundary of the property and further tie to existing street intersection where
possible and reasonably convenient.
F L. Public utility, drainage and sight distance easements. The location and dimensions of each public
utility, drainage and sight distance easement outside of a street right-of-way; for each existing easement,
include a note stating the deed book and page number.
F O. Signature panels. Signature panels for each owner and for the agent or his designee. The signature
panel for the owner shall be located immediately below the statement required by paragraph (A).
F P. Notary panels. Notary panels for the notary to acknowledge the signature of the owner.
