Rivanna Ridge/Woodburn Ridge Final Plat
The Site Review Committee reviewed the above referenced plan/plat on
March 16, 1995. Pertinent comments from the following agencies are attached:

Please revise the plan/plat to include the attached comments and submit seven (7) full
size copies and one 11" x 17" copy of the revised plan/plat no later than 5:00 p.m.

No plan/plat will be approved administratively or scheduled for Planning Commission
review until all necessary information and items marked with ** on the comments are
submitted, in a form satisfactory to the Director of Planning and Community
Development.
Provided that you meet the stated deadline for revisions, and the revisions are
satisfactory, your plan/plat will be reviewed under the Planning Department's
administrative review process unless the plan is appealed by a member of
the Planning Commission or Board of Supervisors or an adjacent property owner
by March 27, 1995. If necessary the application would be heard by the Planning
Commission on April 18, 1995, 7:00 p.m.,Meeting Room #7, Second Floor County
Office Building, 401 McIntire Road. THE APPLICANT OR REPRESENTATIVE
MUST BE PRESENT AT THE PLANNING COMMISSION MEETING.
The Planning Commission will not review plans/plats which occasion sight distance,
grading, or other easements (excluding those for public utilities), without evidence from
the developer that permission is obtainable. This evidence must be submitted by the
revision deadline for this item to proceed to the Planning Commission at the above-
noted date.
In such case in which the developer does not revise the plan to include
recommendations of the committee, the developer shall submit in writing to the agent
by the revision date a statement as to the reasons and justification for not incorporating
such recommendations in the revised plan.

FINAL PLAT
The following items must be addressed by the revision deadline March 27, 1995, in
order to be eligible for administrative approval or to remain tentatively scheduled for
Planning Commission review on April 18, 1995. If you choose not to incorporate a
comment of the Site Review Committee, you should submit a written justification
detailing the reason the revision was not made. All information, studies, maps,
arguments, or other materials which you wish to be considered by the Planning
Commission must be submitted in writing to this Department no later than the revision
deadline. Information submitted after this date or during the public hearing will not be
considered by the Planning Commission in its deliberation. If the plan is not
resubmitted by the revision deadline, your item will be removed from the Planning
Commission's tentative agenda and rescheduled after this Department has had an
opportunity to review the revised plan.
** 7. Please renumber the lots so there is only one number assignment to each lot.

The following are our comments:
(SDP-95-015) Branchlands Village, Phase 2 Preliminary Site Plan, Rt. 866
No comments, development is served by private roads.
(SUB-95-026) Rivanna Ridge Final Plat, Rt. 631
1) Plat should indicate tie in to proposed centerline of Route 631. (See
attached copy of plan)
2) Recommend right of way dedication to accommodate proposed improvements to
Route 631.
3) The proposed subdivision is located in the path of the proposed Route 29
Bypass (also known as Alternative 10) .
4) Upon approval, the applicant will need to acquire a permit for the
entrance and improvements.
(SUB- - ) Woodburn Ridge Preliminary Plat, Rt. 659
1) The proposed subdivision is located in the path of the proposed Route 29
Bypass (Alternative 10) . Lots 1,2, & 3 will be affected.
2) Plan was previously approved for entrance design.

RE: Site Review Comments
Rivanna Ridge and Woodburn Ridge, Preliminary and Final Plats
Watershed Boundary - South Fork Rivanna River watershed, South Fork Rivanna Reservoir
subwatershed, unnamed intermittent tributary drainage basins.
Streams/Watercourses - Four unnamed intermittent tributaries to the South Fork Rivanna
Reservoir.
Wetlands - There are potential wetlands associated with the streams.
Water Resources Ordinances - The Water Resources Protection Areas Ordinance and the Runoff
Control Ordinance apply.
A preliminary plat for Rivanna Ridge was approved by the Planning Commission on 8 March
1994, and a preliminary plat for Woodburn Ridge was approved on 14 Dec. 1993. Those
approvals have now expired. Albemarle County Engineering cannot recommend final approval
of the plats until the following required items are satisfactorily addressed. Where possible, each
item is preceded by the applicable section of the Subdivision Ordinance.
1. Location and dimensions of proposed...easements [18-52(e)] On Rivanna Ridge, indicate
the lengths of the permanent drainage easements through lots 4, and show dimensions to
property lines or corners to establish locations.
2. In addition to the requirements of the preliminary plat and plans [18-55] On Rivanna
Ridge, show the property lines north of the entrance on State Route 659 and T.M.45-28.
3. Plans and specications...shall be prepared by a certified land surveyor, to the limit of his
license or licensed engineer[18-51] Have the plats sealed, with date and signature, by a

qualified professional.
4. The final plat shall include...Temporary cul-de-sacs where needed. [18-55(l)] Show and
specify the dimension of the temporary cul-de-sac on Rivanna Ridge Lane.
5. Location and dimensions of proposed...easements [18-52(e)J On Woodburn Ridge,
indicate the lengths of the permanent drainage easements through lots 3, 4 and 11, and
show dimensions to property lines or corners to establish locations.
In addition, final plat approvals will be subject to the following conditions.
a. VDOT approval of entrance locations and right-of-way improvements.
b. Albemarle County Engineering approval of an Erosion Control Plan.
c. Construction and/or bonding of the roads in accordance with the approved final private
road plans.

RE: Woodburn Ridge & Rivanna Ridge
The above-mentioned plats border and drain into the South Fork
Rivanna Reservoir. Since the developments create less than 5%
impervious cover, a Runoff Control permit is not required.
However, due to the sensitive location of the proposed
developments, I strongly recommend the voluntary use of runoff
control structures.
The proposed developments each have man-made channels to convey
runoff from the roads into intermittent streams that feed the
reservoir. The use of check dams in these channels would slow down
storm flows and allow sediment and some nutrients to settle out.
Check dams would be appropriate measures to control runoff for
these sites. If check dams are constructed, they should conform to
the specifications in the Virginia Erosion and Sediment Control
Handbook, but should be permanent structures. Check dams cannot be
required through the Runoff Control Ordinance for these
developments.

RE: (SUB 94-026) Rivanna Ridge/Woodburn Ridge Final Plat
This is in response to your memorandum to me dated March 9, 1995
regarding the above referenced subject.
It is my opinion that the County cannot require reservation of the right-of-
way for the Route 29 (Alternative 10) bypass unless the need for the right-of-way is
substantially necessitated by the subdivision or the County (or VDOT) is prepared to
initiate condemnation proceedings to take the property and compensate the owner. This
is consistent with Mr. St. John's opinion given to staff in 1993. Of course, the County
can request the reservation in the hope that the landowner will voluntarily reserve the
right-of-way recognizing that if the bypass is built that its impact on the development
would be better planned by reserving the right-of-way.
On the greenway issue, the proffer clearly says that "upon demand" the
County can require the dedication of a minimum of a 100 foot strip for a pathway along
the reservoir frontage. If the County is prepared to identify the property which will be
demanded for dedication, it is my opinion that the property can be required to be
reserved for that purpose on the subdivision plat.
