Variance of Section 4.6.1.a for the entirety of Block K,to require no street frontage. 2.) Variance of Section 2.1.5, Section 4.11.3.A.3 and Section 18.3 to reduce required yards as follows: a.) These variances will allow for a logical subdivision and creation of lot lines that conform to existing streets, buildings and other improvements. Yard reductions noted as"approximate"are done so because their associated lot lines may need to move to conform with changes to the proposed private street lines required by the County Engineer. Variance Application for Cheetah Investment Company, LLC and Barracks West, LLC January 31, 2011 5)Justification. A. The strict application of this ordinance would produce undue hardship. If approved, this application will improve the availability of for sale, affordable housing in Albemarle County. The Applicants are seeking these variances in order to obtain subdivision approval for 133 existing townhouses to permit separate, fee simple ownership for each townhouse owner. The townhouse lots proposed are part of the larger Barracks West neighborhood. The Barracks West neighborhood units were constructed in the late 1960s as apartments. The entire neighborhood of 364 units consists of a mixture of one,two and three bedroom garden-style apartments and attached townhouses. In 2007, all 364 units were converted to a condominium. After the proposed subdivision is recorded, the neighborhood will continue as a 231 unit condominium and a 133 townhouse development. No new buildings, structures or amenities are proposed. All residents of Barracks West will enjoy access to and use of the same amenities as in the condominium. The only difference will be that the owners of the townhouse lots will own their units in fee simple and the others will own their units as condominiums. The subdivision is being driven by marketing experience since 2007. The regulations for Fannie Mae and FHA insured mortgage financing effectively preclude owners who wish to purchase Barracks West condominium units for their own occupancy from obtaining Fannie Mae and FHA mortgages. Ironically, these regulations do not pose the same barrier for units to be financed that are fee simple townhouses. Therefore, the proposed change in the legal form of ownership from condominium to townhouse will increase the stock of housing available to families who need Fannie Mae or FHA assistance to obtain a mortgage and thereby afford a house in Albemarle County. But for the set-back and street frontage requirements at issue, the proposed subdivision is permitted under the County of Albemarle's ordinances. Therefore, the strict application of the ordinances poses an undue hardship by depriving the owners a conventionally- recognized form of ownership — the townhouse lot — that is otherwise permitted by law. This form of ownership is supported by the statutes of the Commonwealth of Virginia as well as the County of Albemarle ordinances. B. Such a hardship is not shared generally by other properties in the same zoning district and the same vicinity. Barracks West is an anomaly in several respects. The neighborhood is zoned R-15, but exists outside the growth area of the Comprehensive Plan. We find no examples of similarly situated properties in the same zoning district or in the same vicinity that are or have been precluded from being subdivided as townhouse lots. Therefore, granting this variance application will not likely create a broader precedent throughout the County. In fact, we found examples in the vicinity involving existing townhouse lots which fail to meet the same setback and street frontage requirements at issue in this application. Attached is a copy of the subdivision plat for Section 2 of the Huntwood Townhouses. [approved August 13, 1981]. This plat reveals that townhouse lots 9 and 19 do not comply with the street frontage requirement that the proposed lots are being required to comply with. Thus the strict application of this ordinance not only poses an undue hardship to the Applicants, it treats two similarly situated properties in an unfair and disparate fashion. C. The authorization of the variance will not be a detriment to adjacent property and the character of the district will not be changed by granting the variances. The effect of the variance will be to allow a subdivision involving existing structures and improvements. No new structures or improvements will be permitted by the granting of this application. The physical characteristics of the property and improvements will exist as they have for nearly forty years—unchanged.
