Prior to any construction within any existing right-of-way, including connection to any existing road, a permit shall be obtained from the Virginia Department of Transit (VDOT). This plan as drawn may not accurately reflect the requirements of the permit.Where any discrepancies occur the requirements of the permit shall govem. 2. All materials and construction methods shall conform to the current specifications and standards of VDOT unless otherwise noted. 3. Erosion and siltation control measures shall be provided in accordance with the approved erosion control plan and shall be installed prior to any clearing, grading or other construction. 4. Work shall be subject to inspection by Albemarle County Service Authority inspectors. The Contractor will be responsible for notifying the proper service authority officials at the start of the work. 2. The location of existing utilities across the line of the proposed work are not necessarily shown on the plans and where shown, are only approximately correct. The contractors shall on his own initiative locate all underground lines and structures as necessary. 3. All materials and construction shall comply with the current edition of the general water and sewer construction specifications as adopted by the Albemarle County Service Authority. 4. Datum for all elevations shown in National Geodetic Survey. 5. The contractor shall be responsible for notifying "MISS UTILITY" (1-800-552-7001). 6. The information and data shown or indicated with respect to the existing underground utilities at or contiguous to the site are based on information and data furnished to the owner and engineer by the owners of such underground facilities or others. The owner or engineer shall not be responsible for the accuracy or completeness of such information or data. The contractor shall have full responsibility for confirming the accuracy of the data, for locating all underground utilities, for coordination of the work with owners of such underground utilities during construction, for the safety and protection thereof and repairing any damage thereto resulting from the work. When working adjacent to existing structures, poles, etc., the contractor shall use whatever methods that are necessary to protect structures from damage. The contractor shall be responsible for protecting all existing site structures from damage and Coordinating work so that the owner can make necessary arrangements to modify/protect existing structures from damages. 4. The contractor shall be responsible for notifying all utility owners, adjacent land owners whose property may be impacted and the Virginia Department of Transportation prior to completing any off -site work. 5. Where the flood level rim of plumbing fixtures are below the elevation of the manhole cover of the next upstream manhole in the public sewer, the fixtures shall be protected by a backwater valve installed in the building drain, branch of the building drain, or horizontal branch serving such fixtures. Plumbing fixtures having flood level rims above the elevation of the manhole cover of the next upstream manhole in the public sewer shall not discharge through a backwater valve. Pursuant to Section 33.3 of the Albemarle County Zoning Ordinance, the Owner hereby voluntarily proffers the conditions listed below which shall be applied to the Property if it is rezoned to the zoning district identified above. These conditions are proffered as a part of the requested rezoning and the Owner acknowledges that the conditions are reasonable. Each signatory below signing on behalf of the Owner covenants and warrants that it is an authorized signatory of the Owner for this proffer statement. This proffer statement amends the proffers applicable to the Project that were accepted in conjunction with ZMA2001-00020, Hollymead Town Center Area C. These conditions are proffered as part of the requested zoning and it is agreed that: 1) the rezoning itself gives rise to the need for the conditions; and 2) such conditions have a reasonable relation to the rezoning request: Development shall be in general accord with the Application Plan entitled Rezoning Application Plans for Hollymead Town Center Regional Service Area C, (Sheets A-1, A-2, only), prepared by Rivanna Engineering & Surveying, PLC, revised, last revised July 7, 2003 with plan revisions to Sheet A-2 prepared by Shimp Engineering, P.C. dated December 18, 2019 (collectively, the "Application Plan"). The standards of development and central features and major elements within the Property essential to the design of the development shall be in general accord with the Block Exhibit, the Code of Development's Narrative, and the Code of Development's tables and appendices set forth in the attached Application Booklet, entitled "Revised Application Booklet for Code of Development ZMA201700005: A Revision to ZMA 201300004 Originally Revised from ZMA 01-20- 2001 (Area C) `At Hollymead Town Center"' dated June 19, 2017 and last revised December 18, 2019. The Owners have presented, as part of their rezoning application, a number of conceptual plans and illustrations for various purposes, but principally to provide justification for the rezoning actions they are seeking. Unless specifically referenced in these proffers, all plans and illustrations submitted as part of the Applicant's rezoning application, other than the Application Plan as defined above, shall be deemed illustrative only, and such plans and illustrations shall not be deemed proffers. The Owners reserve the right to reconfigure the internal block improvements, consisting of buildings, parking and drive aisles and drive -through window features and as shown on the Application Plan in order to: i) comply with conditions imposed by Special Use Permits, and ii) assure compliance with ARB requirements and iii) and provide all necessary storm water management and BMP's as necessary. 2. The Owners of Area C, as shown on the Application Plan (the "Owner") shall cause completion of the following road improvements that shall be roads constructed to VDOT standards and either be accepted by VDOT or be bonded for VDOT's acceptance as follows: A. Construction of Timberwood Boulevard, as depicted on the Application Plan and further described as follows: i) from the intersection at US Route 29 to a new terminus within Hollymead Town Center that is shown at the extension of the VDOT future road improvement project of Airport Road, this will provide the connection to Airport Road from Route 29 as previously proffered as part of ZMA-94-08. The constructed improvements shall include two Eastbound lanes in conjunction with the improvements designed for TM 32 Parcels 41D1 and 41A to the first dual lane roundabout at access road B and Westbound lanes of dual left lanes; one thru lane and one continuous right turn lane -from the roundabout at access road B to the intersection with Route 29, from the roundabout at access road B a two lane section shall be constructed to the VDOT extension, with additional turn lanes at intersections located in Area C pursuant to road plans approved by the Virginia Department of Transportation ("VDOT") and the County as part of the Area C site plan. B. Construction of dual left turn lanes at the intersection of Route 29 and Timberwood Boulevard, from northbound Route 29 into Timberwood Boulevard. The turn lane and taper lengths will be determined with final road plans to be reviewed and approved by VDOT. C. Signalization at Timberwood Boulevard and Route 29 shall include reconstruction at the Forest Lakes Subdivision entrance location, as scheduled in coordination with VDOT. All turn movements shall be signaled at the intersection of Route 29 and Timberwood Boulevard, as approved by VDOT. The existing intersection exiting Forest Lakes shall be reconstructed to maintain the dual left lanes, the continuous right turn lane and add a through lane according to the final design in the previous paragraph. D. The Owner proffers to dedicate land and construct a third through lane on Route 29 (consisting of lane width, shoulder and drainage improvements) southbound from the entrance road, (Timberwood Boulevard) at the Property's Northern boundary. The Owner also shall dedicate land or cause to be dedicated and construct: i) a continuous through lane 500-feet to the Southern boundary of Area C, ii) a taper lane consisting of a 200 foot taper beginning at the Southern boundary and Route 29 (in the event area B is not rezoned and their proffers accepted), and iii) a continuous right turn lane starting at the right -in at the Northern boundary of TM 32 Parcel 41A to the right -in at the Southern entrance of Area C. E. Construction of one additional continuous right turn Northbound lane starting 1090 feet south of Timberwood Boulevard at the location of the beginning of the turn and taper of Worth Crossing and Route 29, and terminating at Timberwood Boulevard. F. Access Road C, between Area A and its intersection with Timberwood will be built or bonded before the issuance of the first certificate of occupancy within Area B. If bonded, the road will be constructed for acceptance by VDOT within one year of the first certificate of occupancy. The road improvements listed in proffer 2A, 2B, 2C, 2D, 2E and 2F above shall be constructed, in accordance with road plans submitted by the Owner and approved by VDOT. All of the foregoing improvements shall be i) constructed to VDOT design standards pursuant to detailed plans agreed to between the Applicant and VDOT, and ii) accepted by VDOT for public use or bonded for VDOT's acceptance as a condition for issuance of any certificate of occupancy for Area C improvements (except as otherwise provided in proffer 2F). All road improvements listed in proffer 2 above shall be substantially completed prior to the issuance of the first Certificate of Occupancy in Area C; notwithstanding the foregoing, the road proffers described in proffer 2 above shall be satisfied if the Owner has submitted plans for all such road improvements for review by VDOT, and although such improvements are not fully completed by the issuance of a Certificate of Occupancy for Area C, sufficient bond has been supplied to satisfy all costs to complete such improvements in accordance with plans approved by VDOT. Substantially complete for the purposes of these proffers shall mean approved sub -base gravel, curb and gutter, intermediate surface and necessary storm water management improvements and satisfactory completion of road improvements required for public safety, and signalization; but shall not include final activated signals which are subject to testing and synchronization according to VDOT inspection. All proffers to make road improvements contained in proffer 2 of these proffers are conditioned upon VDOT's approval of an entrance permit at the Timberwood Boulevard intersection with Route 29 as shown on the Application Plan. The Owner shall submit to VDOT plans for such road improvements within 30 days of the rezoning and shall diligently pursue such approvals from VDOT. 4. Upon request of the County, the Owner shall contribute $10,000.00 to the County or VDOT for the purposes of funding a regional transportation study for the Route 29 Corridor. The $10,000.00 contribution shall be made within 30 days after requested by the County after the first final site plan or subdivision plat is approved in Area C and, if not expended for such purposes within three years from the date the funds were contributed such funds shall be refunded to the Owner. 5. The Owner shall contribute $200,000.00 (the "total contribution") to the County for the purpose of funding capital improvements related to the Hollymead Town Center. The contribution shall be paid as follows: $100,000.00 shall be contributed to the County within 30 days after the first final site plan or subdivision plat containing dwelling units is approved in Area C; the remainder of the contribution shall be paid on a pro rata basis at the time a certificate of occupancy is issued for each dwelling unit; the pro rata contribution shall be based upon the number of dwelling units approved as part of the first final site plan or subdivision plat. If five years after the date of approval of the first final site plan or subdivision plat the total contribution has not been fully paid, the Owner shall contribute the unpaid balance within 30 days upon the request of the County. If the fund is not exhausted within 10 years from the date the last contribution is made, such unexpended funds shall be refunded to the Owner. 6. RWSA shall approve all construction materials and methods of construction. A preconstruction conference shall be held with RWSA prior to the start of any work. The contractor shall be responsible for notifying Miss Utility (1-800-552-7001). RWSA Engineer (Victoria Fort at (434) 977-2970 ext. 205) shall be notified three business days prior to the start of construction. All work is subject to inspection by RWSA staff. No tie-ins to the existing system shall be made without coordination with and the presence of RWSA staff. No work shall be conducted on RWSA facilities on weekends or holidays without special written permission from RWSA. For sanitary sewer line construction: RWSA may require bypass pumping for tie-ins to the existing system. All doghouse manholes must be pressure -tested before a connection is made to the system. The location of existing utilities as shown on the plans is from data available at the time of design and is not necessarily complete or accurate. The Contractor shall be responsible for the verification of the location, size and depth of all existing utilities, both surface and subsurface. The Contractor shall immediately notify the Engineer of any discrepancies between the plans and field conditions. The Contractor shall use due diligence to protect all utilities and structures from damage at all times, whether shown on the plans or not. Damage to any existing utilities shall be repaired by the Contractor to the original condition at no additional cost to the Owner. Erosion and sediment control facilities shall not be permitted in the RWSA easement without special written permission from RWSA. No grading shall be permitted in the RWSA easement unless permitted otherwise by RWSA in writing. No blasting shall be permitted within 100 feet of RWSA facilities without written permission and RWSA approval of the blasting plan. Ground monitoring during blasting and a pre -blast survey may be required. For blasting within 100 feet of any operative RWSA sewerlines, bypass pumping and/or pre- and post -CCTV may be required. RWSA may also require certification from a licensed professional engineer stating that the proposed blasting will not damage any RWSA facilities. Damage to any utilities due to blasting shall be repaired by the Contractor to the original condition at no additional cost to the Owner. The contractor shall observe minimum separation requirements for utility crossings. When a crossing is made under an existing facility, adequate structural support shall be provided for the existing pipe. The area of the crossing shall be backfilled with compacted 57 stone to the springline of the existing pipe. New water main installations shall be pressure tested, chlorinated, flushed and have water samples approved prior to making any permanent connection to the public water system. Approved methods of filling and flushing new water mains will be required to prevent any contamination of the public water system. All easements for new RWSA facilities shall be recorded prior to placing the new facilities into:, service. No permanent structural facilities will be permitted in the RWSA easement. It is not the intent of this plan to enumerate every detail which must be considered in the construction of each stage but only to show the general features necessary to provide for proper handling of traffic. The construction techniques ultimately used by the Contractor are to be reviewed by the Engineer. The Contractor shall submit traffic control plans not expressly outlined in the Virginia Work Area Protection Manual for approval at least 30 days prior to performing the work. No deviations from the plans will be allowed without prior approval from the Engineer. 2. The phases in this sequence of construction shall be followed unless the contractor submits an alternate sequence and secures the approval of the engineer for a sequence which will both expedite construction and lessen the effect of such construction upon the traveling public. Portions of roadways in the different phases may be constructed provided they do not interfere with existing traffic flow and/or do not cause any delay in project completion. 3. Under no circumstances will concurrent construction left and right of any lane be allowed unless otherwise directed by the Engineer or shown on these plans. 4. All work is to be performed in accordance with the latest revisions of each of the following: the 2011 MUTCD, the Virginia supplement to the MUTCD, the 2011 Virginia Work Area Protection Manual, 2020 Road and Bridge Specifications, 2016 Virginia Road and Bridge Standards, and as directed by the Engineer. 5. At the end of each day no more than 2 inches grade difference between travel lanes will be allowed during construction of the proposed roadway. 6. The clear zone is to be free of stored materials and parked equipment. See the Maintenance of Traffic Typical Sections for the required clear zone. Also, horizontal and vertical sight distances shall not be impacted by parked construction equipment. 7. All areas excavated below pavement surfaces at the conclusion of each workday shall be backfilled with aggregate base material to form an approximate 6:1 wedge against the existing pavement surface for the safety and protection of vehicular traffic as outlined within Appendix A of the Va. WAPM 2011 (latest revision). ,All costs for furnishing, placing, maintaining, and removing the 6:1 wedge shall be included in the price bid for other items in the contract and no additional compensation will be allowed. 8. Existing pedestrian access shall be maintained during construction. If existing condition cannot be maintained a pedestrian diversion or detour shall be installed meeting ADA requirements. 9. The contractor shall provide temporary drainage as required to prevent ponding of the water on the roadway and adjacent properties. Any temporary drainage on the project is the contractor's responsibility. The cost to install temporary drainage structures is to be included in the price bid for other items in the contract and no other compensation will be allowed. 10. The contractor shall maintain a minimum of 2 lanes 11 ft. wide, with the exception of pavement overlay operations. All lane closures to be proceeded by variable message sign notification of closure. When one lane of traffic is maintained, said lane is to be 14 ft. wide, including gutterpan. 11. All travel lanes shall be asphalt throughout construction unless otherwise approved by the Engineer. 12. Only uniformed law enforcement officers are allowed to directed traffic through an operating signal (see section 46.2-834 of Highway Laws of Virginia). Floggers do not have the authority and shall not direct traffic through a signalized intersection. 13. When proceeding from one phase of construction to another phase, any existing or construction pavement markings that conflict with the new traffic pattern shall be eradicated and re -striped accordingly. 14. The contractor shall be responsible for maintaining any existing signs, unless otherwise advised by VDOT Engineer to remove or relocate. 15. Existing signs no longer applicable or in conflict with intended traffic control shall be removed or covered with opaque material. All other signs are to be maintained. 16. The contractor shall submit a Traffic Control Plan to the engineer for approval prior to the beginning of each phase. The Traffic Control Plan shall show all necessary traffic control devices, including signs, pavement markings and channeling devices. 17. All permanent pavement is to be constructed through the base course only in the initial stages. The final surface course is to be applied prior to switching traffic onto the new location or as approved by the Engineer. 18. The contractor shall review with the project engineer the final plan to maintain traffic for all phases of work. Any significant changes in Phase of Construction will require approval of the Virginia Department of Transportation (VDOT) Traffic Engineer. Minor adjustments of the maintenance of traffic plan shall be approved by the Project Engineer. 19. All signs mounted to Type III Barricades shall be crashworthy and shall be in accordance with the 2011 Virginia Work Area Protection Manual (latest revision). 20. All protective devices shall be in place to protect all signal foundations and poles prior to exposing to traffic. 21. The existing posted speed limits shall be maintained during construction unless otherwise approved by the engineer. 22. The Contractor must have at least one person certified in Work Zone Training at the Intermediate Level to design and at least one person certified at the Basic Level to install and maintain the work zone. 23. Flagging operation shall not hold traffic longer than 5 minutes without approval of the Engineer. 24. The Contractor shall provide notice to the Police, Fire, and Rescue, and the School Superintendent 48 hours in advance concerning all detours and road closures of any nature. 25. The contractor is responsible for coordinating the construction, signing and traffic management plan with other adjacent project under construction. 26. No traffic pattern switches will be allowed on Friday, Saturday, or Sunday and/or the day before a holiday or as directed by the project engineer. 27. A suitable foundation shall be provided for channelizing devices and all associated cost shall be included in the price of Group II channelizing devices. 28. The contractor and VDOT are to coordinate in notifying the public of proposed Lane Closures. The process developed by the Traffic operations Center for this purpose is as follows: a. Contractor submits to the Project Manager or Designee planned lane closures for the following week by 3 P.M. on Tuesday. b. Project Manager or Designee submits planned lane closures for the upcoming week using the Lane Closure Form. This form is to be submitted to the Traffic Operations Center and the Culpeper District Public Affairs office by Noon on Wednesday for the following week. c. Traffic Operations Center is to review the planned lane closure schedule and return it to the Project Manager or Designee by 9 A.M. Friday. d. Contractor to update the Project Manager or Designee of planned lane closures a minimum of 24 hours in advance of proposed lone closure as previously scheduled. e.
