RE: COMMENT RESPONSE to 2nd Review, SUB202200126, Victorian Heights Subdivision

Please find below our responses to review of the plat referenced above (Victorian Heights Subdivision Plat); we appreciate your
comments and review. Included (below) are comments provided by Albemarle County with responses (in red), accordingly:
1. [General Comment] Review the comment letter for SDP2022-00047 Victorian Heights Final Site Plan as well, as many of
the comments are the same or similar. Because the development is made up of attached units, and a site plan is required,
the site plan and the subdivision plat must match, with the subdivision lines reflecting the approved design of the site plan.
Comment still applies during concurrent review of the site plan. The site plan and the subdivision plat must match
before approval can be granted. Noted / addressed. Surveyor and Engineer have coordinated plat content with
that of site plan for alignment of content; Please note the following:
• Access Easement for Taurus Lane is shown as '30' & Variable' on plat and as 31' on site plan.
Easement is'30' & Variable as shown on plat.
• A small triangular Private Storm Drainage Easement is now shown on the plat near the
intersection of Perseus and Berkmar Drive. This portion was previously shown with the public
SWM Facility easement and now aligns with site plan delineation.
• Setback lines for Lot 35 were previously 'broken' on the plat and are now consistent through the
total lot configuration.
• Prior mention of 37 lots in plat note 22 (also see comment 2 below) has been amended on the
plat.
2. [14-302(A)9] Provide the following note on the cover sheet of the plat: "Lots 1-35 each contain a building site that complies
with section 4.2.1 of the Albemarle County Zoning Ordinance." Revise this note (note #22) on the cover sheet. The note
mentions Lots 1-37; however, it appears that there are only 35 lots proposed now, since the three multi -family buildings
are all on one lot. Addressed.
3. [14-302(B)1] Provide the date of last revision of the plat on all future submittals. Comment still applies to all future
submittals. Addressed.
4. [34-302(B)5] In the zoning note, identify that this development is using the cluster and bonus density options in the R-15
District, along with the actual density of the final layout (since it will be greater than 15 units per acre). Provide a note
(either under the cluster development note or the AIA note #12) that the Planning Commission, on April 25, 2023,
determined that this development would reduce or be equivalent to hazard and/or noise impacts anticipated under
standard level -conventional development of the underlying zoning district. Addressed. This note has been inserted
within Survey Note 1 under the Cluster Development narrative therein.
5. [14-302(B)S] If the special exception application requesting modifications to the required setbacks is approved by the
Board of Supervisors, a note stating the Board's action will need to be added to this plat under the zoning section on
the cover sheet. Provide a note on the plat, under the setbacks section, stating that the special exception
application SE2022-00043 was approved by the Board of Supervisors on March 15, 2023, modifying the setback
requirements. Addressed.

6. [New General Comment] Note #16 should reference Albemarle County instead of VDOT, since the right-of-way is being
dedicated to the County, and not the Commonwealth. Addressed.
