Glass, Principal Planner From: Amy Pflaum, Engineering Review Subject: SUB - 2008 - 00099, Cutright, Pat (2 Lot), Waiver Request Date received: 12 April 2008 Date of Comment: 30 May 2008 The applicant has requested a waiver of Section 14 -404 of the Albemarle County Subdivision Ordinance for the subdivision of TMP 88 -6AL Subsection 14 -404.A of the Ordinance states that "Each lot ... shall have reasonable access to the building site from only one street, shared driveway or alley established at the same time as the subdivision; provided that a lot may be located so that its driveway enters only onto a public street abutting the subdivision if: (i) the commission grants a waiver under subsection (C); (ii) the subdivider obtains entrance permit from VDOT for the access; (iii) the entrance complies with the design standards set forth in sections 14- 404(F) and 14 -404 (G); and (iv) the subdivider demonstrates to the agent prior to the approval of the final plat that the waiver does not violate any covenants to be recorded for the subdivision." Subsection 14 -404.0 of the Ordinance provides for the waiver of Section 14 -404 if "(ii) because of unusual size, topography, shape of the property, location of the property or other unusual conditions, excluding the proprietary interest of the subdivider, strict application of the applicable requirements would result in significant degradation of the property... In approving a waiver, the commission shall find that requiring the standard would not forward the purposes of this chapter or otherwise serve the public interest; and granting the waiver would not be detrimental to the public health, safety or welfare, to the orderly development of the area, to sound engineering practices..." The engineering analysis of the requests is as follows: Waiver of the requirement of County Code section 14 -404: Parcel 88 -6A1 contains 9.62 acres and is located at the corner of Red Hill School Road (State Route 760) and US 29, with a pond and dry hydrant in the northeast corner. Currently, the North Garden Volunteer Fire Company utilizes the dry hydrant to refill tanker trucks, accessing it via a gravel pull- out along US 29. The parcel has one existing dwelling that is accessed by an existing paved driveway onto Red Hill School Road. The applicant is proposing to divide the parcel into two lots (Lot B = 3.00 ac and Lot C = 2.09 ac) and a Residue (4.53 ac). Each proposed lot and the residue will have frontage onto Red Hill School Road. The proposed subdivision will place the existing dwelling into Lot B and create Lot C for an additional dwelling. The residue is to be donated to the North Garden Volunteer Fire Company with the condition that it will not permanent structures. A new shared driveway to accommodate both lots would require more construction and environmental degradation as opposed to the construction of the single driveway to Lot C. A shared entrance constructed on the new lot line between Lot B and Lot C would be off -set approximately 20 feet from an existing driveway on the opposite side of Red Hill School Road accessing parcel 88 -7A2. This could create a potentially awkward situation with cars turning onto Red Hill School Road from these adjacent entrances. In the alternative scenario, the new single driveway for Lot C would be approximately 110 feet away from the existing driveway accessing parcel 88 -7A2 and 250 feet away from Bonny View Lane on the opposite side of Red Hill School Road, providing safer separation. The existing driveway could remain in its current location for Lot B and Lot C would be accessed by a new driveway from State Route 760. This alternative is recommended for the waiver request with the following condition: The applicant submits a subdivision plat in general accord with the exhibit provided by the applicant that shows TMP 88 -6A1 being subdivided into only two lots with a residue.
