We have authorized family divisions where the grantee is the custodian for a minor if the conveyance complies with the
Virginia Uniform Transfers to Minors Act (Virginia Code 31 -37 et seq.). We have not authorized family divisions where the
grantee is a trust and the beneficiary of the trust is a minor.

Family Division
I know you love these questions so consider this my Christmas present to you:
In doing a family division does the age of the family member matter. The thinking goes like this. If
you give property to a minor they don't really control it, because they are a minor. Therefore, the
property is really in the hands /ownership of a trustee. Is this really a family division?
