HomeMy WebLinkAboutSUB200800048 Review Comments Family Division Plat 2008-04-30OF ALg� �IRGII County of Albemarle Department of Community Development MEMORANDUM To: Reid Murphy via email (murphy.reid@agmail -com) From: Megan Yaniglos, Planner Division: Zoning and Current Development Date: April 30, 2008 Subject: Murphy- Family Division (SUB2008 -048)- Revisions dated 4/17/08 The Planner for the Zoning & Current Development Division of the Albemarle County Department Community Development will recommend approve the plan referred to above when the following items have been satisfactorily addressed. (The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated based on further review.) [Each comment is preceded by the applicable reference to the Albemarle County Code.] 1. [Sec. 14- 302(A)(1)] Name of subdivision. The plat that was submitted is not a survey, but a family division, revise title to state family division. Rev 1: Comment addressed. 2. [Sec. 14- 302(A)(9)] Building sites on proposed lots. Provide the dimensions of the building sites along with the following note: "Parcel [letter or number] and the residue of Tax Map /Parcel [numbers] each contain a building site that complies with section 4.2.1 of the Albemarle County Zoning Ordinance." Rev 1: Comment addressed. 3. [Sec. 14- 302(A)(10)] Right of further division of proposed lots. Provide the number of lots as assigned by the subdivider, into which each proposed lot may be further divided by right pursuant to section 10.3.1 of the zoning ordinance, if applicable. The plat shall also contain the following note: "Parcel [letter or number] is assigned [number] development rights and may /may not be further divided and when further divided these rights shall not comprise more than [number] acres. The residue of Tax Map /Parcel [numbers] is retaining [number] development rights and when further divided it shall not consist of more than [number] acres." Rev 1: Comment addressed. 4. [Sec. 14- 302(B)(1)] General information. Provide a current date for the drawing. Rev 1: Comment addressed. 5. [Sec. 14- 302(B)(5)] Zoning classification. Provide with a note the zoning classification of the property. Rev 1: Comment addressed. [Sec. 14 -302 (13)(7)] Reservoir watershed; agricultural- forestal district. Provide a notation as to whether the land is within an Albemarle County and /or City of Charlottesville water supply watershed or an agricultural - forestal district. Rev 1: Comment addressed. 6. [Sec. 14 -302 (13)(9)] Flood plain. Provide current flood plain information using the most recent FEMA maps dated February 2005. Rev 1: Comment addressed. 7. [Sec. 14 -303 (A)] Statement of consent to division. Provide the following statement on the plat: "The division of the land described herein is with the free consent and in accordance with the desire of the undersigned owners, proprietors and trustees. Any reference to future potential development is to be deemed as theoretical only. All statements affixed to this plat are true and correct to the best of my knowledge." Rev 1: Comment addressed. 8. [Sec. 14 -303 (C)] Boundary lines. Provide the degrees, minutes, and seconds for the proposed new boundary lines. Rev 1: Comment addressed. 9. [Sec. 14 -303 (D)] Acreage of lots. Provide the acreage for the residue parcel. Rev 1: Comment addressed. 10. [Sec. 14 -303 (N); Sec. 14 -412 (A)(4); Sec. 14 -235 (B)] Statement pertaining to private streets. Add the following statement for Catlin Road to the plat: "The streets in this subdivision may not meet the standards for acceptance into the secondary system of state highways and will not be maintained by the Virginia Department of Transportation or the County of Albemarle." Rev 1: Comment addressed. 11. [Sec. 14 -303 (0)] Signature panels. Provide signature panels for each owner and for the agent for the board of supervisors. The signature panel for the owner shall be located immediately below the statement required in Section 14 -303 (A). Rev 1: Comment addressed. 12. [Sec. 14 -303 (P)] Notary panels. Provide notary panels for the notary to acknowledge the signature of the owner. Rev 1: Comment addressed. 13. [Sec. 14 -303 (S)] Control points. Provide at least four (4) control points, evenly distributed across the property and located at survey property corners, and shown on each sheet depicting the property. At the option of the subdivider, the control points may be shown on a copy of the final plat, rather than on the original final plat. Rev 1: Comment not addressed. Show control point either on plat, or on a copy of the plat. 14. [Sec. 14 -211; Sec. 14- 212(A)] Verification of Family Division. Provide a copy of affidavit, deed, or letter from attorney stating: grantee, grantor and their relationship; and certifying that this is a Family Division in accordance with Section 14 -208 and related provisions of the Albemarle County Code. Please find attached template of an affidavit. Rev 1: Comment not addressed. Provide verification of family division. 15. [Sec. 14 -212 (C)] Plat note. Add note stating the following: "No lot shown on this family subdivision plat may be sold or conveyed to a person other than an eligible `member of the immediate family,' as that term is defined in Chapter 14 of the Albemarle County Code, for a period of two (2) years from the date of recordation of this plat is conveyed back to the grantor during the two (2) year period, it shall be recombined with the parent lot within (6) months after such conveyance." '-Iv 1: Comment �--'dressp ' 16. [Sec. 14 -212 (B); Sec. 14 -316] Approval of entrance onto public streets. All entrances onto a public street shall comply with Virginia Department of Transportation (VDOT) standards and be approved by VDOT. Please provide a letter stating such compliance and approval for the entrance of Catlin Road onto Owensville Road. Rev 1: Comment not addressed. Provide verification of VDOT approval of entrance. 17. [Sec. 14 -412] Add a note stating: "The existing and /or proposed right of way is of adequate width and horizontal and vertical alignment to accommodate a travelway passable by ordinary passenger vehicles in all but temporary extreme weather conditions, together with area adequate for maintenance of the travelway, as required by section 14 -412 of the Albemarle County Code.
