The ROW has not been adjusted so prior to VDOT acceptance an agreement will need to be made for the homeowners associations to accept maintenance responsibility for the sidewalks. Please inform the applicant that the Homeowners Association will need to enter into an agreement to maintain the sidewalks in this development prior to VDOT taking over maintenance of Hathaway. VDOT's policy is that any feature of a public road that is to be maintained by VDOT shall have no less than 1 foot of Right of Way behind the outermost feature that will be maintained. I understand that the first phase of this development aligns the back of the sidewalk and the ROW but this is incorrect. If the developer chooses to keep the design this way they run the risk of VDOT not being able to maintain the sidewalk and it would be the responsibility of the homeowners to repair it. I recommend that they consider adjusting the typical on phase II and consider putting easement behind the sidewalk for the previous phase if possible. If you have any questions, please contact me.
